Probable cause affidavit: | SUBMITTED BY: REID, THOMAS N654 FWC (AR14-10968) On 062914 at approximately 2000 hOUrs, I, OfFICER Thomas Reid and LIEUTENANT Doug Loyed of the Florida Fish and Wildlife Conservation Commission (FWC) were conducting water patrol on THE Homosassa River in Citrus County. I observed a shallow water skiff (FL3567FJ, 1986 homemade vessel), traveling west on the river. I noticed that the vessel did not have the required registration number displayed on the port side of the vessel. I approached the vessel and conducted a vessel safety inspection. There were three occupants aboard the vessel, the operator MR Matthew James Cooper (DL#C160-550-92-294-0), MR Steven Charles Winburn (DL# W516-783-84-335-0) and one other male passenger who was under the age of 21. As I approached the Vessel, I noticed a distinct odor of alcohol, as well as the presence of several empty beer cans. I asked MR Cooper to see his vessel registration, as well as three lifejackets. MR Cooper's speech was extremely slurred and difficult to understand. As MR Cooper was leaning against a plastic chair to help stabilize himself, he advised that he did not have the registration but the registration numbers were displayed on each side of the vessel, although they were not. MR Cooper asked if I needed to see anything else and I restated that I needed to see THREE life jackets. MR Cooper pulled the required safety equipment out of the vessel and asked if they could go. I advised MR Cooper that he would need to come aboard my vessel in order for me to conduct afloat sobriety tasks. Horizontal Gaze Nystagmus: Lack of smooth pursuit in right and left eye. Distinct and sustained Nystagmus at maximum deviation in right eye. Onset of Nystagmus prior to 45 Finger to Nose: Opened eyes during task. Did not bring down hand after attempting to touch nose. Wrong hand Hesitated and searched while trying to find his nose. Palm Pat: Did not follow instructions Did not increase Speed Did not continue until told to stop At this point I informed MR Cooper that we would be proceeding to Magic Manatee Marina, which was the nearest location where I could safely administer the remaining on shore tasks. Upon arrival at the marina, I administered both the Walk and Turn and One Leg Stand. The tasks were read from prepared text and demonstrated. I observed the following indicators of impairment. Walk and Turn: Did not touch heel to toe on any of the 9 steps there or the 9 steps back. One Leg Stand: Sways slightly while balancing Did not count thousands At this time, based on my probable cause, I advised MR Cooper he was under arrest for operating a vessel while impaired. MR Cooper was handcuffed and double locked. MR Cooper became belligerent and asked repeatedly what he was being arrested for and I advised MR Cooper several times of the charges and the reason for the initial stop. At this point I read MR Cooper Miranda advising him of his rights, off of a prepared text. MR Cooper was then placed into a Citrus County Sheriff patrol VEHICLE and transported to Citrus County Detention Facility. Upon arrival at Citrus County Detention Facility, MR Cooper was read his implied consent requesting him to submit to an approved test of his breath to determine his breath alcohol content. MR Cooper stated that he would not submit to the approved test of his breath. At this time Cooper was issued a citation (V368931) for operating a vessel under the influence of alcoholic beverages, any chemical substance set forth in s. 877.111, or any substance controlled under chapter 893, when affected to the extent that the personâs normal faculties are impaired, 327.35(1) (a) with a mandatory court appearance on 071414 at 0930 hOUrs, at the Citrus County Court House. |
