SUBMITTED BY: BYRD, JEDIDIAH 0737 (AR16-19772)(16-77109) DID UNLAWFULLY AND KNOWINGLY TAKE, OBTAIN OR USE OR ENDEAVOR TO TAKE, OBTAIN OR USE THE PROPERTY OF WAL-MART, TO WIT: 43 MISCELLANEOUS ITEMS CARRYING AWAY THE SAID MERCHANDISE, WITH INTENT TO TEMPORARILY OR PERMANENTLY DEPRIVE, A MERCHANT, OF THE POSSESSION, USE, BENEFIT, OR FULL RETAIL VALUE OF SAID PROPERTY, SAID PROPERTY BEING OF A VALUE OF LESS THAN $300.00, IN VIOLATION OF FLORIDA STATE STATUTES 812.015, 812.014(1), AND 812.014(3)(A). ON 060616, I WAS DISPATCHED TO 2461 EAST GULF TO LAKE HIGHWAY (WAL-MART), IN REFERENCE TO A SHOPLIFTER IN CUSTODY. UPON ARRIVAL, I MADE CONTACT WITH THE COMPLAINANT, LOSS PREVENTION OFFICER, MR KENNETH CHEW JR, WHO ADVISED ME THAT HE OBSERVED A WHITE FEMALE, LATER IDENTIFIED AS THE DEFENDANT, MS MEGHAN SMITH, IN THE SELF-CHECKOUT LANE NOT SCANNING MULTIPLE ITEMS AND THEN PLACING THEM IN HER CART AS IF SHE HAD PAID FOR THEM. HE ADVISED THAT HE OBSERVED VIA CC TELEVISION FROM THE LOSS PREVENTION OFFICE. HE ADVISED THAT THE DEFENDANT PAID FOR SOME ITEMS AND THEN PROCEEDED TOWARDS THE STORE EXIT CROSSING ALL POINTS OF SALE, WITHOUT ATTEMPT TO PAY FOR THE UN-SCANNED ITEMS. HE APPROACHED THE DEFENDANT AND IDENTIFIED HIMSELF AS LOSS PREVENTION AND THE REASON FOR HIM STOPPING HER AND ESCORTED THE DEFENDANT BACK TO THE LOSS PREVENTION OFFICE. THE COMPLAINANT ADVISED ME THAT HE INVENTORIED THE ITEMS AND FOUND 43 MISCELLANEOUS ITEMS THAT WERE NOT SCANNED WITH A TOTAL OF $141.14. I THEN MADE CONTACT WITH THE DEFENDANT AND I READ HER HER MIRANDA RIGHTS VIA AN AGENCY PREPRINTED CARD AND SHE STATED SHE UNDERSTOOD HER RIGHTS AND SHE AGREED TO SPEAK WITH ME. SHE ADVISED ME THAT IT WAS AN ACCIDENT THAT SHE DID NOT SCAN MULTIPLE ITEMS AND THAT SHE DID NOT REALIZE THAT SHE DID NOT SCAN THE ITEMS, AND THAT SHE WAS WILLING TO PAY FOR THEM. I DID ADVISE HER THAT SHE WOULD BE PLACED UNDER ARREST FOR RETAIL THEFT. THE DEFENDANT HAD IN HER PRESENCE HER DAUGHTER, BAILEY SMITH, WHO WAS 12 YEARS OLD. CONTACT WAS MADE WITH THE DEFENDANT'S MOTHER TO COME PICKUP THE DEFENDANT'S DAUGHTER, ALONG WITH THE PAID FOR GROCERIES. THE COMPLAINANT PROVIDED ME WITH A SWORN WRITTEN STATEMENT, THE TRANSACTION RECEIPT FOR THE UNPAID ITEMS, ALONG WITH A SECURITY DIGITAL VERSATILE DISC (DVD). THE DEFENDANT WAS HANDCUFFED (DOUBLE LOCKED) BEHIND HER BACK SEARCHED AND SECURED IN THE REAR SEAT OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY AND TURNED OVER TO THEIR STAFF. BOND SET AT $500.00 PER THE SCHEDULE. THE SWORN WRITTEN STATEMENT WILL BE TURNED IN TO RECORDS AND THE DIGITAL VERSATILE DISC (DVD) WILL BE TURNED IN TO EVIDENCE. |
