Probable cause affidavit: | SUBMITTED BY: STRICKLAND, JASON 0583 (AR09108359) DID UNLAWFULLY AND KNOWINGLY OBTAIN OR USE, OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, CIRCLE K, TO WIT: THE DEFENDANT ATTEMPTED TO STEAL A CAN OF BEER FROM THE CIRCLE K, SAID PROPERTY BEING OF A VALUE OF $1.19 WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATE STATUTES 812.014(1) and 812.014(3)(a). ON 032709, AT APPROXIMATELY 0215 HOURS, I WAS DISPATCHED TO THE CIRCLE K CONVENIENCE STORE LOCATED AT 2025 NORTH LECANTO HIGHWAY IN LECANTO, IN REFERENCE TO A WHITE FEMALE ATTEMPTING TO STEAL A CAN OF BEER. UPON MY ARRIVAL I MADE CONTACT WITH THE ON DUTY CASHIER WHO ADVISED THAT THE WHITE FEMALE STANDING OUTSIDE THE CONVENIENCE STORE, WEARING A PINK SHIRT AND BLUE JEANS, LATER IDENTIFIED AS MS MELISSA RIEHLE, HAD JUST ATTEMPTED TO TAKE A CAN OF BEER AND STUFF IT DOWN THE FRONT OF HER PANTS AND WALK OUT OF THE CONVENIENCE STORE WITHOUT PAYING. THE CASHIER FURTHER ADVISED THAT WHEN SHE SAW THE DEFENDANT WALKING out THE FRONT DOOR SHE ADVISED THE DEFENDANT TO PLACE THE BEER BACK INSIDE THE COOLER OR SHE WAS GOING TO CALL THE COPS. AT THAT TIME THE DEFENDANT THEN PLACED THE BEER ON A SHELF AND WALKED OUT THE FRONT DOOR. THE CASHIER FURTHER ADVISED THAT SHE FELT SHE SHOULD STILL NOTIFY THIS AGENCY OF THE INCIDENT. AT THAT TIME THE CASHIER REPLAYED THE SECURITY VIDEO FOOTAGE OF THE DEFENDANT ATTEMPTING TO STEAL THE CAN OF BEER WITHOUT PAYING. AT THAT TIME I RECEIVED A COPY OF THE FOOTAGE ON A COMPACT DISC, WHERE I THEN FILLED OUT A PROPERTY RECEIPT REGARDING THE CAN OF BEER AND ALSO THE SECURITY DISC. THE CAN OF BEER WAS THEN RETURNED BACK TO THE STORE AND THE COMPACT DISC WILL BE TURNED OVER TO EVIDENCE. I THEN MADE CONTACT WITH THE DEFENDANT AND OBTAINED ALL PERSONAL INFORMATION FROM THE DEFENDANT. I THEN PLACED THE DEFENDANT UNDER ARREST FOR ONE COUNT OF PETIT THEFT, DUE TO THE CASHIER WISHING TO PROSECUTE THE DEFENDANT. THE DEFENDANT WAS THEN PLACED IN HANDCUFFS DOUBLE LOCKED BEHIND HER BACK AND SECURED IN THE REAR SEAT OF MY PATROL VEHICLE. SHE WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. WHILE AT THE CITRUS COUNTY DETENTION FACILITY THE DEFENDANT'S BOND WAS SET AT $250.00 PER THE BOND SCHEDULE. NO FURTHER POLICE ACTION TAKEN AT THIS TIME. *NOT-EXEMPT* |
