SUBMITTED BY: HESSE, NICHOLAS 0689 (AR10117142) DID, BEING A PERSON UNDER THE AGE OF TWENTY-ONE YEARS, UNLAWFULLY AND KNOWINGLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION AN ALCOHOLIC BEVERAGE, IN VIOLATION OF FLORIDA STATE STATUTE 562.111 ON 093010, AT APPROXIMATELY 0200 HOURS, I OBSERVED THE DEFENDANT, MR MELVIN PATTERSON, DRINKING FROM A CAN LABELED "MAX VIBE", WHICH IS AN ALCOHOLIC BEVERAGE WITH 12% ALCOHOL BY VOLUME. I OBSERVED THE DEFENDANT WHILE ON AN EXTRA PATROL AT GRIFF'S BAR LOCATED AT 102 WEST MAIN STREET AS the DEFENDANT STEPPED IN TO his VEHICLE AND LEFT IN A BLUE DODGE STRATUS BEARING FLORIDA LICENSE PLATE R973FP. IT IS IMPORTANT TO NOTE, THAT the DEFENDANT DID POSSESS THE OPEN CONTAINER AS HE ENTERED THE VEHICLE AND I ALSO OBSERVED AN INOPERABLE HEADLIGHT ON the DRIVERS SIDE. I THEN FOLLOWED THE VEHICLE NORTHBOUND ON US 41 WHERE I CONDUCTED A TRAFFIC STOP BY INITIATING MY EMERGENCY LIGHTS, AT which TIME the VEHICLE CAME TO REST IN THE AREA OF 1010 NORTH FLORIDA AVENUE. I IMMEDIATELY MADE CONTACT WITH THE DRIVER/DEFENDANT WHO WAS IDENTIFIED VIA D.A.V.I.D., AND IT WAS REVEALED THAT HE WAS 19 YEARS OF AGE. I SPOKE WITH THE DEFENDANT FURTHER, WHO SPONTANEOUSLY STATED THAT HE DID DRINK FROM the ALCOHOLIC BEVERAGE BEFORE GIVING IT TO the PASSENGER WHO CLAIMED IT AS HIS. AT THAT TIME, I CONDUCTED A WANTS and WARRANTS CHECK ON THE DEFENDANT VIA NCIC/FCIC, WHICH REVEALED THAT THE DEFENDANT HAD A VALID FLORIDA LICENSE AND CURRENTLY HAS NO WARRANTS. I AGAIN MAD CONTACT WITH THE DEFENDANT AND ADVISED HIM TO STEP OUT OF THE VEHICLE. HE WAS SEARCHED, HANDCUFFED (DOUBLE-LOCKED) AND PLACED UNDER ARREST FOR POSSESSION OF ALCOHOL BY PERSON UNDER 21. I THEN SPOKE WITH DEPUTY VALDES, WHO REMAINED ON SCENE AND COMPLETED A VEHICLE TOW SHEET and AWAITED THE ROTATION WRECKER TO REMOVE the VEHICLE; FOR FURTHER REFER TO HIS SUPPLEMENT. I THEN TRANSPORTED THE DEFENDANT TO THE CITRUS COUNTY DETENTION FACILITY WITHOUT INCIDENT WHERE HE WAS PROCESSED and TURNED OVER TO STAFF. THE DEFENDANT'S BOND WAS SET AT $250.00, PER THE BOND SCHEDULE.
