| Commentaries: | Comments According to official documents Warness plead guilty in Snohomish County Superior Court on 10/25/1993 to one count of Second Degree Rape. He was sentenced to 198 months in prison. This conviction was the result of Warness sexually assaulting the known (for only a few days) 20 year old female victim. The victim had gone to Warness's residence where they listened to music and drank alcohol. At one point they went to a trailer on the property where Warness was staying. Once there he asked her to kiss him and she refused. She laid down and pretended to be asleep when Warness began kissing her on the head touching her sexually. The victim told him to stop and told him no several times. The victim struggled and at one point bit Warness's hand. Warness pushed her head into a pillow, held her hands and then sexually assaulted her. On 11/28/1988 Warness was found guilty by jury trial of one count of Third Degree Rape. He was sentenced to 12 months and one day in prison. This conviction was the result of Warness sexually assaulting the known adult female victim. Warness called the victim and asked her to go out. They drove around and ended up at a marina. Warness told the victim he wanted to show her his relative's boat and she declined. He went to the boat and when he returned he told her he wanted her to meet his relatives. She agreed but only if he would then take her home afterward. Once on the boat she realized there was no one else there and tried to leave. Warness pushed her onto a bed and began removing her clothes. She resisted and Warness physically assaulted her and then sexually assaulted her. On 02/15/1989 Warness plead guilty in Snohomish County Superior Court to one count of Third Degree Rape and one Count of First Degree Rape. He was sentenced to 15 months in prison for the Third Degree Rape and to 72 months in prison for the First Degree Rape. The Third degree rape conviction was the result of Warness sexually assaulting the unknown adult female victim. Warness met the victim at a tavern and he was invited to the victim's residence where he was allowed to sleep in a spare bedroom. The victim was asleep in her room when she awoke to being sexually assaulted. She struggled with Warness and was physically assaulted, including being bitten on the nose. The victim was able to scream and attracted attention. Warness fled the residence leaving his wallet and identification. The First Degree Rape conviction was the result of Warness sexually assaulting the unknown adult female victim. The victim was sitting on her front porch when she was approached by Warness who asked her for a cigarette. He then asked her to go to a tavern with him. She refused. Warness became angry when he tried to give her a card with his phone number and she refused it. The victim said goodbye and went into her residence, locking the door. A few minutes later Warness crashed through the locked door knocking the victim to the ground. Warness attacked the victim who fought with him. Warness sexually assaulted the victim while he continued to physically assault her. During the struggle Warness bit the victim on the nose. The victim received several injuries as a result of the assault. It should be noted that the three 1988 crimes all occurred within a 2 1/2 week time period and Warness became more violent in each attack. Warness participated in sex offender treatment while in custody for the 1988 crimes. He was eventually terminated from treatment for a lack of progress. On 11/03/2009 Warness was transferred to the Special Commitment Center pending trial for civil commitment as a sexually violent predator. Warness was recently found not to meet criteria as a sexually violent predator. After his release from the SCC on 05/09/2011, Warness will be on active supervision with the Washington State Department of Corrections for a period of 24 months and has the following conditions: Do not enter bars, taverns, casinos, or lounges or any location where alcohol is the primary item for sale Do not have direct or indirect contact with any victim for life Do not purchase, own or have in your possession or under your control any firearm or deadly weapon Do not use , posess, purchase, or consume alcohol Do not use, possess or consume controlled substances unless you have a legally issued prescription Maintain lawful employment and provide proof of employment to DOC staff as directed Report to and be available for contact with assigned community corrections officer as directed Shall reside at a location and under living arrangements as approved by CCO Shall work at the DOC-approved education, employment, and /or community service Submit to breathalyzer and urinalysis testing as directed Submit to polygraph examinations as directed |
