Probable cause affidavit: | SUBMITTED BY: FHP TROOPER TODD CLOUD (AR15-16137) THE DRIVER OF ANY VEHICLE INVOLVED IN A CRASH RESULTING ONLY IN DAMAGE TO A VEHICLE OR OTHER PROPERTY DRIVEN OR ATTENDED BY ANY PERSON, SHALL IMMEDIATELY STOP SUCH VEHICLE AT THE SCENE OF SUCH CRASH OR AS CLOSE THERETO AS POSSIBLE, AND SHALL, FORTHWITH RETURN TO AND IN EVERY EVENT SHALL REMAIN AT THE SCENE OF THE CRASH UNTIL HE HAD FULFILLED THE REQUIREMENTS OF 316.061(1). A PERSON WHO VIOLATES THIS SUBSECTION COMMITS A MISDEMEANOR IN THE SECOND DEGREE. THE DRIVER OF A VEHICLE INVOLVED IN A CRASH WHILE OPERATING ON PUBLIC OR PRIVATE PROPERTY THAT RESULTS IN INJURIES TO A PERSON OTHER THAN SERIOUS INJURIES SHALL IMMEDIATELY STOP THE VEHICLE AS CLOSE THERETO AS POSSIBLE AND SHALL REMAIN AT THE SCENE OF THE CRASH UNTIL HE HAS FULFILLED THE REQUIREMENTS OF 316.061 WILLFULLY VIOLATES THIS PARAGRAPH COMMITS FELONY IN THIRD DEGREE, IN VIOLATION OF FLORIDA STATE STATUE 316.027(2)(A) ON 082215, AT APPROXIMATELY 2235 HOURS, I ARRIVED AT THE SCENE OF A TRAFFIC CRASH INVOLVING A VEHICLE AND A MOTORCYCLE. UPON ARRIVAL, I WAS ADVISED THAT THE DEFENDANTâS VEHICLE WAS TRAVELING SOUTHBOUND ON U S HIGHWAY 19 IN THE INSIDE LANE. THE DEFENDANTâS VEHICLE WAS STRUCK FROM BEHIND BY A MOTORCYCLIST WITH A PASSENGER. THE MOTORCYCLE DRIVER, MR JOSEPH SIMMONS, WAS INJURED BUT REFUSED TREATMENT. THE PASSENGER, MS LAURIE SIMMONS, WAS TRANSPORTED FROM THE SCENE OF THE CRASH TO SEVEN RIVERS HOSPITAL. BEFORE MY ARRIVAL, I WAS ADVISED THAT DEPUTY SHERIFF BRYAN HESSE (0755) HAD STOPPED THE HIT AND RUN VEHICLE ON U S HIGHWAY 19 AND LONGFELLOW STREET. UPON SPEAKING TO THE DEFENDANT, MR MICHAEL MERLE ANDERSON, HE ADVISED ME THAT HE WAS DRIVING SOUTH ON HIGHWAY 19 AND HE WAS STOPPING BECAUSE OF ANOTHER MOTORCYCLE CRASH IN FRONT OF HIM. THE DEFENDANT STATED THAT HE FELT A BUMP, BUT LEFT THE SCENE BECAUSE OF RECENT PROBLEMS HE WAS HAVING WITH HIS INSURANCE COMPANY. AT APPROXIMATELY 2348 HOURS, THE DEFENDANT WAS PLACED UNDER ARREST FOR LEAVING THE SCENE OF A TRAFFIC CRASH WITH PROPERTY DAMAGE AND LEAVING THE SCENE OF A TRAFFIC CRASH WITH INJURY. THE DEFENDANT WAS HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK AND PLACED IN THE REAR OF MY PATROL VEHICLE. THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING, WHERE HE WAS CHARGED WITH LEAVING THE SCENE OF CRASH WITH PROPERTY DAMAGE WITH A BOND OF $500 AND WITH LEAVING THE SCENE OF AN CRASH WITH INJURY WITH A BOND OF $5,000.00, FOR A TOTAL BOND AMOUNT OF $5,500.00, PER THE BOND SCHEDULE. THE DEFENDANT WAS ISSUED TRAFFIC CITATION NUMBER A43LATE, FOR LEAVING THE SCENE WITH PROPERTY DAMAGE AND TRAFFIC CITATION NUMBER A43LASE, FOR LEAVING THE SCENE WITHOUT RENDERING AID TO THE INJURED. |
