Probable cause affidavit: SUBMITTED BY: SCHAFFER, HEATH 0652 (AR08105393) DID UNLAWFULLY AND KNOWINGLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: CANNABIS, COMMONLY REFERRED TO AS MARIJUANA, IN AN AMOUNT OF 20 GRAMS OR LESS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(B). ON 092508, AT APPROXIMATELY 1445 HOURS, WHILE PATROLLING THE AREA OF HIGHWAY 44 EAST AND EDEN GARDENS I OBSERVED WHAT APPEARED TO BE A KNOWN DRUG USER RIDING HIS BICYCLE EAST ON HIGHWAY 44. I THEN MADE A U-TURN AND PROCEEDED TO TRAVEL WEST AND ATTEMPTED TO INITIATE A CONSENSUAL ENCOUNTER WITH the DEFENDANT. UPON FURTHER OBSERVATION, THE DEFENDANT INCREASED SPEED AND ATTEMPTED TO FLEE AND ELUDE ME. I THEN PULLED IN BEHIND HIM WHERE HE WRECKED HIS BICYCLE AT WHICH TIME; HE BEGAN TO FLEE ON FOOT. I THEN EXITED MY PATROL VEHICLE AND UPON ME EXITING MY VEHICLE, THE DEFENDANT STOPPED. WHILE PULLING IN BEHIND HIM I OBSERVED HIM TO HAVE THROWN A GREEN OBJECT OUT OF HIS RIGHT HAND WHICH WAS LATER OBSERVED TO BE A METAL CYLINDER CONTAINER CONTAINING APPROXIMATELY TWO GRAMS OF MARIJUANA. UPON CONTACT WITH the DEFENDANT, I COULD NOT AT FIRST LOCATE THE GREEN CONTAINER. I DID REQUEST FROM the DEFENDANT WHERE THE SAID CONTAINER WAS TO WHICH HE ADVISED; THAT HE DID NOT KNOW WITH A VERY NERVOUS ANSWER. I REQUESTED THAT HE STAND TO THE BACK OF MY PATROL VEHICLE WITH HIS HANDS IN PLAIN SIGHT SO THAT I COULD LOOK FOR THE METAL CONTAINER. I FINALLY FOUND THE METAL CONTAINER APPROXIMATELY TEN FEET FROM WHERE the DEFENDANT WAS STANDING. I THEN PLACED THE DEFENDANT IN HANDCUFFS TO DETAIN HIM WHILE I OBSERVED the CONTENTS OF THE METAL CONTAINER. AFTER CONFRONTING THE DEFENDANT ABOUT the CONTENTS OF THE METAL CONTAINER, the DEFENDANT WAS PLACED UNDER ARREST, AND SEATED IN THE REAR SEAT OF MY PATROL VEHICLE. BEFORE TRANSPORTING THE DEFENDANT, I ASKED IF HE HAD ANY MORE NARCOTICS ON HIM AND ADVISED HIM THAT IT WAS ILLEGAL TO BRING NARCOTICS INTO THE CORRECTIONS FACILITY. THE DEFENDANT ADVISED THAT HE HAD MORE CANNABIS IN HIS RIGHT SHOE. I THEN REMOVED APPROXIMATELY TEN GRAMS FROM the DEFENDANT'S SHOE AT WHICH POINT; THE DEFENDANT STATED THAT IT WAS ALL HE HAD. I THEN TRANSPORTED the DEFENDANT TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. ALL EVIDENCE WAS COLLECTED AND LATER TURNED IN TO EVIDENCE. *NOT-EXEMPT*
