ON 103114, AT APPROXIMATELY 0520 HOURS, I WAS DISPATCHED TO 635 WEST NORVELL BRYant highway in hernando, florida (burger king/citgo) in reference to a verbal disturbance. upon arrival i made contact with the complainant, ms teresa mace, who advised when she arrived at work today she got into a verbal argument with a gentleman outsIde of her store. the complainant advised AFTER SHE got into the verbal argument with the gentleman she got back into her vehiCle in the parking lot and waiting for our arrival. the complainant stated the gentleman began walking arOund front and back of the business until i arrived. i next made contact with two different employees who were also present when this occurred. their VERBAL statements coincided with what the complainant had already advised me. i then spoke with the defendAnt, MR michael horton, who was sitting on the ground in front of the burger king door. the defendant denied saying anything to anyone and said he did not even see anyone. he just wanted to go into the store and purchase cigarettes. where the burger king is located there is a citgo attached and neither business was open at the time this incident occurred. i advised the defendant he was being trespassed from the store. the defendant AGAIN began pleAding his case when i advised him he was being trespassed. the defendant stated he just wanted to go buy cigarettes. i advised the defendant a second time he was being trespassed and i advised him to leave or he would be arrested for trespassing after warning. at that time he stated he did not understand how the burger king management could trespass him from their store. i advised the defendant for a third time he was trespassed and needed to leave. the defendant again stated that this was not right and we could not do this to him. i then placed the defendant under arrest for trespass afTer warning and handcuffed him behind his back, double locked, and secured him in the rear seat of my patrol vehicle. i then trAnsported the defendant to the citrus county detention facility and turned him over to BOOKING staff. the defendant's bond was set at $1,000.00 per the bond schedule. |
