| Probable cause affidavit: | SUBMITTED BY: CROSNOE, ROBERT 0234 (AR07100379) did unlawfully and knowingly obtain, use or endeavor to obtain or use the property of THE VICTIM, to-wit: A 1999 GMC yukon, of the value of three hundred dollars ($300.00) or more, but less than twenty thousand dollars ($20,000.00), with the intent to either temporarily or permanently deprive the victim of a right to the property or a benefit thereof, or did appropriate the said property to his own use or the use of any person not entitled thereto, in violation of Florida Statutes 812.014(1) and 812.014(2)(c)(6) ON 111707 AT APPROXIMATELY 2350 HOURS, DEPUTY CRUZ ran the tag of a vehicle which came back to a 1999 gmc yukon. AFTER RECEIVING THE INFORMATION FROM FCIC/NCIC DEPUTY CRUZ NOTICED THAT THE TAG came back a stolen vehicle. at that time, deputy cruz ran the same tag through teletype which advised that the vehicle had been entered as stolen on 111507 from levy county. deputy cruz then initiated a traffic stop on the vehicle at the intersection of highway 44 east and stotler avenue. AT THAT TIME, I ARRIVED ON SCENE WHERE DEPUTY CRUZ AND MYSELF DID CONDUCT A FELONY TRAFFIC STOP WHERE WE EVENTUALLY PLACED BOTH THE DRIVER WHO IDENTIFIED HIMSELF AS MICHAEL KITCHEN (defendant) and THE FRONT SEAT PASSENGER IN CUSTODY. THE DEFENDANT WAS READ his MIRANDA RIGHTS VIA PRE PRINTED CARD BY DEPUTY CRUZ and WAS QUESTIONED ABOUT THE VEHICLE. THE DEFENDANT STATED THAT HE TOOK HIS MOTHER'S VEHICLE TWO DAYS AGO AND WAS PLANNING ON RETURNING IT WHEN SHE WENT TO BED, HOWEVER DUE TO HIS MOTHER HAVING SIX rottweilers HE COULD NOT SNEAK THE VEHICLE BACK INTO HER YARD, THEREFORE HE KEPT DRIVING IT. THE DEFENDANT WAS THEN PLACED UNDER ARREST FOR GRAND THEFT AUTO. THE DeFENDANT WAS SECURED IN THE REAR SEAT OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WHERE HIS BOND WAS SET AT $2,000.00 PER THE BOND SCHEDULE. *not-exempt* |
