SUBMITTED BY: RUBY, SAMUEL 0562 (AR11120144) did commit certain acts which are of such a nature as to corrupt the public morals or outrage the sense of public decency or affect the peace and quiet of a person who may witness them, or did engage in brawling or fighting, or in such conduct as to constitute a breach of the peace or disorderly conduct, in that THE DEFENDANT did YELLING OBSCENITIES AT PASSING VEHICLE TRAFFIC CAUSING ALARM TO LOCAL RESIDENTS, in violation of Florida Statute 877.03; DID KNOWINGLY DISPLAY, CAUSE OR PERMIT TO BE DISPLAYED, AND HAVE IN HIS POSSESSION A SUSPENDED DRIVER'S LICENSE KNOWING THAT SUCH LICENSE HAS BEEN SUSPENDED, TO WIT: SUSPENDED ON 0315210 FOR FAILURE TO PAY FINANCIAL OBLIGATIONS, IN VIOLATION OF FLORIDA STATE STATUTE 322.32(1); ON 040611 AT APPROXIMATELY 2042 HOURS, I WAS DISPATCHED TO THE AREA OF WEST GROVER CLEVELAND BOULEVARD AND SOUTH SPRING SONG TERRACE IN HOMOSASSA IN REFERENCE TO A POSSIBLE INTOXICATED INDIVIDUAL FALLING DOWN IN THE ROADWAY WHILE RIDING HIS BICYCLE. I WAS ADVISED THAT THE INDIVIDUAL WAS YELLING OBSCENITIES AT MOTOR VEHICLE TRAFFIC AND CAUSING VEHICLES TO STOP AND OR SWERVE TO PREVENT HITTING THE DEFENDANT. UPON ARRIVAL IN THE AREA, I OBSERVED THE DEFENDANT, MR MICHAEL MCBRIDE, STANDING NEXT TO THE STREET SIGN AT THAT LOCATION WITH HIS BICYCLE LEANING AGAINST THE STREET SIGN. WHEN I MADE CONTAC WITH THE DEFENDANT, I OBSERVED HIM TO BE BLEEDING FROM HIS LEFT EYE. I ASKED THE DEFENDANT IF HE NEEDED EMERGENCY MEDICAL SERVICES (EMS) WHICH HE REFUSED. I ASKED THE DEFENDANT IF HE HAD ANY IDENTIFICATION. THE DEFENDANT THEN HANDED ME A BLACK TRI-FOLD WALLET AND ADVISED THAT "IT'S IN THERE". I ASKED HIM IF HE HAD A DRIVER'S LICENSE OR IDENTIFICATION CARD, HE ADVISED THAT HIS DRIVER'S LICENSE WAS SUSPENDED AND THAT HE HAD AN IDENTIFICATION CARD. WHILE LOOKING FOR HIS IDENTIFICATION CARD, I LOCATED A FLORIDA DRIVER'S LICENSE, NUMBER M216541590600. I ASKED THE DEFENDANT WHY HE STILL HAD THE DRIVER'S LICENSE IN HIS POSSESSION AND THE DEFENDANT STATED THAT "HE DID NOTHING WRONG". I ASKED THE DEFENDANT HOW HE HAD HURT HIS EYE AND HE ADVISED THAT HE HAD FALLEN DOWN ON THE ROAD. I ASKED THE DEFENDANT WHEN HE FELL ON THE ROAD DID HE CURSE AT THE PASSING TRAFFIC AND HE ADVISED NO. I THEN STATED TO THE DEFENDANT THAT WE HAD A CALL ABOUT THE DEFENDANT'S ACTIONS ON THE ROADWAY AND ASKED HIM WHY HE WAS CURSING AT THE TRAFFIC WHEN, HE ADVISED "MAYBE I DID, BUT I APOLOGIZE". THE DEFENDANT ADVISED THAT HIS BROTHER OWNED "MACK ONE SIGNS" AND THAT HE USED TO BE THE DIRECTOR OF A CHURCH AND A MINISTRY. WHILE ON SCENE, I MADE CONTACT WITH THE COMPLAINANT WHO ADVISED THAT WHILE HE WAS GETTING READY TO LIE DOWN, HE HEARD THE DEFENDANT CURSING AND SCREAMING AT PASSING VEHICLES. WHEN THE COMPLAINANT EXITED HIS RESIDENCE; HE OBSERVED THE DEFENDANT STANDING IN THE ROADWAY WHILE OTHER VEHICLES WERE HAVING TO SWERVE TO GO AROUND HIM. THE DEFENDANT WAS THEN PLACED UNDER ARREST, HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK AND SECURED IN THE REAR SEAT OF MY PATROL AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. UNIFORM TRAFFIC CITATION NUMBER 8677-GJX-8 WAS ISSUED FOR POSSESSION OF A SUSPENDED DRIVER'S LICENSE WITH A MANDATORY COURT DATE OF 042111 AT 1300 HOURS AT THE CITRUS COUNTY COURTHOUSE. THE DEFENDANT'S BOND WAS SET AT $250.00 PER CHARGE FOR A TOTAL BOND OF $500.00 PER THE BOND SCHEDULE.
