Probable cause affidavit: | SUBMITTED BY: AMATO, ANTHONY 1393 (AR16-19472) WILLFULLY VIOLATE A PROVISION OF AN INJUNCTION FOR PROTECTION AGAINST DOMESTIC VIOLENCE OR REPEAT VIOLENCE, IN VIOLATION OF FLORIDA STATE STATUTE NUMBER 784.047(5), TO WIT: ON 051516, AT APPROXIMATELY 1620 HOURS, I RESPONDED TO 7364 WEST GROVER CLEVELAND BOULEVARD, WHICH IS ALSO DAN'S CLAM STAND, IN REFERENCE TO STOLEN ITEMS POSSIBLY BEING SOLD AT THAT LOCATION. WHEN I ARRIVAL ON SCENE, I OBSERVED A WHITE MALE SITTING IN A CHAIR IN FRONT OF DAN'S CLAM STAND, WHO I IMMEDIATELY IDENTIFIED AS THE DEFENDANT, MR MICHAEL JAMES MILLER, SR. DURING MY NONCUSTODIAL INTERVIEW, I ASKED MR MILLER IF HE HAD CONTACTED THE VICTIM RECENTLY. HE ADVISED THAT HE DID CONTACT THE VICTIM POSSIBLY BETWEEN 050716 AND 050916. HE FURTHER ADVISED HE DID CONTACT THE VICTIM AND LEFT SEVERAL VOICEMAIL MESSAGES BY TELEPHONE APPROXIMATELY THREE DIFFERENT TIMES. HE ADVISED THE FIRST TIME WAS ON 050716, AT APPROXIMATELY 1900 HOURS, ON 050816, AT APPROXIMATELY 1600 HOURS, AND ON 050916, AT APPROXIMATELY 1500 HOURS. I THEN ASKED MR MILLER WHICH PHONE NUMBERS HE HAD CONTACTED THE VICTIM WITH. MR MILLER THEN ADVISED ME HE DID NOT KNOW BECAUSE HE WAS USING UNKNOWN PERSONS' PHONES AND COULD NOT REMEMBER THE NUMBERS. MR MILLER ADVISED HE HAD CALLED SO MANY TIMES BECAUSE IT WAS HIS SON'S BIRTHDAY AND HE REALLY WANTED TO TALK TO HIS SON. I ASKED MR MILLER IF HE WAS AWARE HE HAD AN INJUNCTION AGAINST HIM AND HE ADVISED ME THAT HE DID KNOW, BUT HE DID NOT CARE BECAUSE HE WANTED TO SPEAK TO HIS SON FOR HIS BIRTHDAY. I CONTACTED THE CITRUS COUNTY SHERIFF'S OFFICE WARRANTS DIVISION TO VERITY THE VIOLATION OF INJUNCTION INFORMATION. I WAS PROVIDED WITH COURT CASE NUMBER 2014-CR-00258 AND ADVISED THE INJUNCTION WAS SERVED ON 032114 AND AGAIN IN PERSON BY DEPUTY WHITTEN (0110) ON 040314. WITH BOTH DOCUMENTS BEING SIGNED BY JUDGE EIMON, I WAS FURTHER ADVISED THAT BOTH DOCUMENTS HAD NO EXPIRATION DATE AND THE INJUNCTION WOULD NOT EXPIRE. AT THAT TIME, MR MILLER WAS PLACED UNDER ARREST. HE WAS HANDCUFFED (DOUBLE LOCKED) AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANT WAS CHARGED WITH ONE COUNT VIOLATION OF INJUNCTION FLORIDA STATE STATUTE NUMBER 784.047(5) WITH HIS BOND SET AT , PER THE BOND SCHEDULE. DURING A POST-CUSTODIAL INTERVIEW WITH THE DEFENDANT, HE ADVISED ME HE KNEW IT WAS WRONG TO CONTACT THE VICTIM, BUT HE REALLY WANTED TO SPEAK TO HIS SON BECAUSE IT WAS HIS BIRTHDAY. A VICTIMS NOTIFICATION FORM WAS COMPLETED WITH ONE COPY BEING TURNED IN TO RECORDS AND ONE COPY TURNED IN TO THE JAIL. NO FURTHER ACTION WAS TAKEN BY THIS DEPUTY. |
