Probable cause affidavit: SUBMITTED BY: MARSHALL, EVAN 1336 (AR15-16550) DID UNLAWFULLY AND KNOWINGLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: CANNABIS, COMMONLY REFERRED TO AS MARIJUANA, IN AN AMOUNT OF 20 GRAMS OR LESS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(B). ON 092315, I WAS TRAVELING NORTH ON SOUTH FLORIDA AVENUE IN THE AREA OF SOUTH AIRPORT ROAD, RUNNING MOVING RADAR AND CONDUCTING TRAFFIC ENFORCEMENT. I OBSERVED A GRAY IN COLOR KIA TRAVELING SOUTHBOUND ON SOUTH FLORIDA AVENUE AT A HIGH RATE OF SPEED. I TURNED ON MY RADAR AND HEARD AN AUDIO DOPPLER TONE, ALONG WITH A DIGITAL READOUT OF 59 MILES PER HOUR. I THEN TURNED MY RADAR OFF AND BACK ON AGAIN, AND HEARD ANOTHER AUDIO DOPPLER TONE WITH A DIGITAL READOUT OF 59 MILES PER HOUR. THE POSTED SPEED LIMIT IN THAT AREA IS 45 MILES PER HOUR. I MADE A U-TURN AND CONDUCTED A TRAFFIC STOP ON THE VEHICLE BEARING FLORIDA LICENSE PLATE NUMBER AZYP93. UPON MAKING CONTACT WITH THE DRIVER/DEFENDANT, MR MICHAEL NEAL, I INFORMED HIM THAT HE WAS SPEEDING, TRAVELING 59 MILES PER HOUR IN A 45 MILES PER HOUR ZONE. I ASKED TO SEE THE DEFENDANT’S DRIVER'S LICENSE AND NOTICED THAT WHEN HE HANDED IT TO ME HIS HAND WAS VERY SHAKY. I ALSO SMELLED THE ODOR OF MARIJUANA COMING FROM THE VEHICLE. I ASKED THE DEFENDANT IF THERE WAS ANYTHING ILLEGAL IN THE VEHICLE OR IF HE HAD A LITTLE BIT OF MARIJUANA. THE DEFENDANT STATED THAT HE DID NOT HAVE ANY MARIJUANA IN THE VEHICLE. I OBSERVED SEVERAL OPEN CONTAINERS OF ALCOHOL IN THE BACK SEAT AND ASKED THE DEFENDANT IF HE HAD BEEN DRINKING WHILE DRIVING. THE DEFENDANT STATED THAT HE HAD A BEER EARLIER IN THE NIGHT, BUT WAS NOT DRINKING WHILE DRIVING. I ASKED THE PASSENGER/WITNESS, MS DESIREE HILTON, IF SHE MINDED LETTING ME LOOK AT HER DRIVER'S LICENSE AND SHE STATED THAT WAS OK AND HANDED ME HER DRIVER'S LICENSE. I THEN RETURNED TO MY PATROL VEHICLE TO RUN THE DEFENDANT AND THE PASSENGER THROUGH FCIC/NCIC. AT THAT TIME, FHP K-9 OFFICER PEARCE PULLED BEHIND MY PATROL VEHICLE AS BACK UP. I DECIDED TO GIVE THE DRIVER OF THE VEHICLE A VERBAL WARNING FOR HIS SPEED AND ASKED THE DEFENDANT TO STEP OUT OF THE VEHICLE AND WALK BACK TO MY PATROL VEHICLE. I AGAIN ASKED THE DEFENDANT IF HE HAD ANYTHING ILLEGAL IN THE VEHICLE AND HE STATED NO. I THEN OBSERVED PARTICLES OF MARIJUANA ON THE DEFENDANT’S CLOTHING, WHICH WERE PHOTOGRAPHED ON THE DEFENDANT’S PERSON BY FHP K-9 OFFICER PEARCE. AT THAT TIME, DUE TO SMELLING MARIJUANA AND THE DEFENDANT HAVING MARIJUANA PARTICLES ON HIS CLOTHING I INFORMED HIM THAT HE WAS BEING DETAINED. THE DEFENDANT WAS HANDCUFFED AND SEATED IN THE REAR OF MY PATROL VEHICLE. I ASKED MS HILTON TO STEP OUT OF THE VEHICLE AND STAND WITH K-9 OFFICER PEARCE WHILE I CONDUCTED A SEARCH OF THE VEHICLE. I OBSERVED PARTICLES OF MARIJUANA LOCATED IN THE CUP-HOLDER AREA AND THE ASHTRAY AREA, WHICH WERE PHOTOGRAPHED BY K-9 OFFICER PEARCE. INSIDE THE CENTER CONSOLE TO THE VEHICLE, I LOCATED ONE ROLLED MARIJUANA CIGARETTE WITH A TOTAL APPROXIMATE WEIGHT OF 1.3 GRAMS. I CONTINUED TO SEARCH THE REST OF THE VEHICLE, WHICH YIELDED NEGATIVE RESULTS. I READ MS HILTON MIRANDA AND SHE STATED THAT SHE UNDERSTOOD HER RIGHTS AND SHE WISHED TO SPEAK WITH ME. I ASKED MS HILTON WHOSE MARIJUANA CIGARETTE WAS IN THE CONSOLE AND SHE STATED THAT IT BELONGED TO THE DEFENDANT. I ASKED MS HILTON IF SHE WANTED TO WRITE A SWORN STATEMENT AND SHE STATED THAT SHE DID INDEED. I COLLECTED THE SWORN WRITTEN STATEMENT FROM MS HILTON AND IT WAS LATER TURNED IN TO RECORDS. I READ THE DEFENDANT MIRANDA AND THE DEFENDANT STATED THAT HE UNDERSTOOD HIS RIGHTS AND WISHED TO SPEAK WITH ME. I ASKED THE DEFENDANT WHOSE MARIJUANA CIGARETTE WAS IN THE CENTER CONSOLE AND HE STATED THAT HE DID NOT KNOW THERE WAS ONE IN THERE. I ASKED THE DEFENDANT WHOSE MARIJUANA PARTICLES WERE IN THE CUP-HOLDER AND ASHTRAY AREA OF THE VEHICLE THAT HE WAS OPERATING AND HE STATED THAT HE DID NOT REALIZE THEY WERE THERE. I ASKED THE DEFENDANT WHY HE HAD MARIJUANA PARTICLES ALL OVER HIS CLOTHING WHEN HE STEPPED OUT OF THE VEHICLE TO SPEAK TO ME. THE DEFENDANT STATED THAT HE HAD NO IDEA HOW THOSE GOT THERE. AT THAT TIME, I INFORMED THE DEFENDANT THAT HE WAS BEING PLACED UNDER ARREST FOR POSSESSION OF MARIJUANA LESS THAN 20 GRAMS AND HE WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANT’S BOND WAS SET AT $1,000.00, PER THE BOND SCHEDULE. THE MARIJUANA CIGARETTE WAS PACKAGED AND TURNED IN TO EVIDENCE. THE VEHICLE THAT THE DEFENDANT WAS DRIVING WAS TOWED BY SCALLY’S ROTATION WRECKER, DUE NOT BEING ABLE TO START THE VEHICLE AND IT BLOCKED THE ROADWAY. I ALSO GAVE THE DEFENDANT A VERBAL WARNING FOR HIS SPEED AND DID NOT WRITE HIM ANY CITATIONS FOR OPEN CONTAINER. FHP K-9 HANDLER PEARCE EMAILED ME THE PHOTOGRAPHS DESCRIBED ABOVE AND THE PHOTOGRAPHS WERE TURNED IN TO RECORDS.
