Probable cause affidavit: | did unlawfully commit battery upon the victim by actually and intentionally touching or striking said person against said person's will, or by intentionally causing bodily harm, to-wit: striking the victim in the face causing injury to said person in violation of Florida Statute 784.03.1.A.1 ON 12-31-08 I WAS DISPATCHED TO 31 N JEFFERSON ST IN BEVERLY HILLS IN REFERENCE TO A BATTERY. UPON ARRIVAL I MADE CONTACT WITH THE WITNESS WHO ADVISED THAT WHEN SHE WALKED THROUGH THE VICTIMS FRONT DOOR SHE OBSERVED THE VICTIM BACKED INTO THE CORNER OF THE KITCHEN BY THE DEFENDANT (MICHAEL ROYER). SHE THEN ADVISED THAT THE DEFENDANT MICHAEL ROYER THEN WALKED OUT OF THE RESIDENCE AND WENT NEXT DOOR TO HIS HOUSE AND WAS STANDING IN THE CAR PORT THREATENING HER. THIS DEPUTY THEN MADE CONTACT WITH THE DEFENDANT MICHAEL ROYER WHO WAS EXTREMELY INTOXICATED AND HAD PROBLEMS BALANCING WHILE STANDING NEXT TO A TRUCK IN THE DRIVE WAY OF HIS RESIDENCE WHICH WAS NEXT DOOR TO THE VICTIMS HOUSE. I ASKED THE DEFENDANT WHAT HAD HAPPENED AND THE DEFENDANT SAID, "NOTHING HAPPENED". HE THEN STATED, "I WAS NEVER IN THAT HOUSE". SHORTLY THEREAFTER I MADE CONTACT WITH THE VICTIM WHO HAD A LARGE SWELLED AREA IN THE MIDDLE OF HIS NOSE AND BLOOD COMING OUT OF HIS NOSE. I ASKED THE VICTIM WHAT HAD OCCURRED AND HE ADVISED THAT THE DEFENDANT MICHAEL ROYER HAD BROUGHT OVER A BOTTLE OF BEER FOR THE VICTIM AND THEY BEGAN TALKING AND THEN THE DEFENDANT MADE STATEMENTS THAT THE VICTIM WAS A TRAITOR AND THEN THE DEFENDANT PUNCHED THE VICTIM IN THE FACE POSSIBLY BREAKING THE VICTIMS NOSE. THE VICTIM ADVISED THAT HE WAS IN SHOCK AND DIDN'T DO ANYTHING WHEN THE DEFENDANT STRUCK HIM. THIS DEPUTY OBSERVED BLOOD DROPS AND SMEARED BLOOD ON THE FLOOR OF THE VICTIMS KITCHEN AS WELL AS ON THE VICTIMS FACE AND SEVERAL BROKEN BEER BOTTLES. THE VICTIM ADVISED THAT HE WISHED TO PURSUE CHARGES AGAINST THE DEFENDANT AND WANTED THE DEFENDANT ARRESTED FOR BATTERING HIM. THIS DEPUTY THEN MADE CONTACT AGAIN WITH THE DEFENDANT WHO BEGAN TO CHANGE HIS STORY ABOUT WHAT HAD OCCURRED. THE DEFENDANT WAS THEN ARRESTED HANDCUFFED DOUBLE LOCKED AND WAS SEAT BELTING IN THE REAR OF MY PATROL VEHICLE. SHORTLY THEREAFTER THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR FURTHER PROCESSING. THE VICTIM WAS GIVEN A CASE CARD BEARING THE APPROPRIATE CASE NUMBER. EMS RESPONDED TO THE SCENE TO TREAT THE VICTIMS INJURY. PHOTOS WERE TAKEN OF THE VICTIMS INJURIES AND WRITTEN STATEMENTS WERE OBTAINED FROM THE WITNESS AND VICTIM.
