Probable cause affidavit: | SUBMITTED BY: LAMBERT, BOBBY 0480 (AR13-4524) DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: 1.5 GRAMS OF COCAINE, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). ON 021613 AT APPROXIMATELY 0345 HOURS, I WAS TRAVELING NORTHBOUND ON HIGHWAY 19 CONDUCTING TRAFFIC ENFORCEMENT IN THE AREA OF HOMOSASSA TRAIL. I OBSERVED A RED DODGE SUV TRAVELING SOUTHBOUND ON HIGHWAY 19, WHERE I VISUALLY ESTIMATED THE SPEED TO BE APPROXIMATELY 56 MILES PER HOUR IN A POSTED 45 MILES PER HOUR ZONE. I ACTIVATED MY RADAR AND RECEIVED A VISUAL DISPLAY OF 54 MILES PER HOUR ALONG WITH AN AUDIBLE TONE. I CONTINUED TO RECEIVED THIS READING UNTIL THE RED SUV PASSED MY PATROL VEHICLE, AT WHICH TIME IT WENT AWAY. I ALSO OBSERVED THAT THERE WERE NO OTHER VEHICLES ON THE ROAD AT THAT TIME. AFTER TURNING MY PATROL VEHICLE AROUND I WAS ABLE TO READ A FLORIDA LICENSE PLATE OF 873MWA. I THEN CONDUCTED A TRAFFIC STOP ON SAID VEHICLE AT THE INTERSECTION OF GROVER CLEVELAND JUST EAST OF HIGHWAY 19. I MADE CONTACT WITH THE DRIVER, WHERE I INFORMED HIM OF THE REASON FOR THE STOP AND REQUESTED HIS DRIVER'S LICENSE, REGISTRATION AND INSURANCE TO WHICH HE PROVIDED ME WITH THIS INFORMATION. I ALSO NOTICED SITTING IN THE PASSENGER SEAT A SUBJECT LATER IDENTIFIED AS THE DEFENDANT, MR MICHAEL SCHLAK. I ASKED THE DEFENDANT IF HE COULD PROVIDE ME WITH IDENTIFICATION AND HE GAVE ME A FLORIDA DRIVER'S LICENSE. I RETURNED TO MY PATROL VEHICLE TO CHECK FOR ANY WANTS AND WARRANTS AND COMPLETE A WARNING CITATION FOR THE SPEED VIOLATION. WHILE COMPLETING THIS TASK, K9 DEPUTY HRYC ARRIVED ON SCENE AT WHICH TIME HE DEPLOYED K-9 ZEUS ON THE VEHICLE THAT I HAD STOPPED. DEPUTY HRYC INFORMED ME THAT HIS K-9 DID ALERT TO SOME TYPE OF NARCOTICS BEING IN THE VEHICLE, PARTICULARLY TO THE PASSENGER SIDE OF THE VEHICLE. SEE K9 REPORT. AT THAT TIME, I ASKED THE PASSENGER/DEFENDANT TO STEP OUTSIDE OF THE VEHICLE TO WHICH HE COMPLIED. DEFENDANT SCHLAK ADVISED IMMEDIATELY THAT HE DID NOT HAVE ANYTHING ILLEGAL ON HIM AND PUT HIS HANDS IN THE AIR AND SAID YOU CAN SEARCH ME. UPON SEARCHING THE DEFENDANT, I WAS ABLE TO LOCATE A CLEAR BAGGIE CONTAINING A WHITE POWDER WHICH WAS LOCATED IN HIS REAR LEFT POCKET. UPON REMOVING THIS ITEM FROM THE DEFENDANTâS POCKET, HE INFORMED HE THAT IT WAS COCAINE. THE DEFENDANT WAS PLACED UNDER ARREST, HANDCUFFED, (DOUBLE LOCKED), BEHIND HIS BACK, SECURED IN THE REAR OF DEPUTY CRUZâS PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DRIVER WAS ISSUED WARNING CITATION NUMBER 324681B FOR UNLAWFUL SPEED OF 54 MILES PER HOUR IN A POSTED 45 MILES PER HOUR ZONE AND THEN RELEASED ON SCENE. THE SEARCH OF THE REST OF THE VEHICLE DID NOT YIELD ANY FURTHER CONTRABAND. THE COCAINE WAS FIELD TESTED WHICH YIELDED A POSITIVE RESULT AND IT WAS PACKAGED AND LATER TURNED IN TO EVIDENCE BY DEPUTY HRYC. THE DEFENDANT'S BOND WAS SET AT $5,000.00, PER THE BOND SCHEDULE |
