Probable cause affidavit: | SUBMITTED BY: FELIX, REYSON 1284 (AR16-20499) (16-107146) THE DRIVER OF ANY VEHICLE INVOLVED IN A CRASH RESULTING ONLY IN DAMAGE TO A VEHICLE OR OTHER PROPERTY DRIVEN OR ATTENDED BY ANY PERSON, SHALL IMMEDIATELY STOP SUCH VEHICLE AT THE SCENE OF SUCH CRASH OR AS CLOSE THERETO AS POSSIBLE, AND SHALL, FORTHWITH RETURN TO AND IN EVERY EVENT SHALL REMAIN AT THE SCENE OF THE CRASH UNTIL HE HAD FULFILLED THE REQUIREMENTS OF 316.062 ON 080616, I WAS DISPATCHED TO A HIT AND RUN THAT OCCURRED AT THE SUNOCO GAS STATION LOCATED AT THE INTERSECTION OF CARL G ROSE HIGHWAY AND WITHLACOOCHEE TRAIL. UPON MY ARRIVAL, I MADE CONTACT WITH THE VICTIM, LATER IDENTIFIED AS MS CATHLEEN GRIPPE, WHO ADVISED WHILE SHE WAS PUMPING GAS A CHEVROLET PICKUP TRUCK BROWN IN COLOR, BEARING FLORIDA LICENSE PLATE KA1000078, WAS BACKING OUT AND HIT HER 2009 CHEVROLET IMPALA ON THE RIGHT REAR PASSENGER DOOR, CAUSING SOME DAMAGE. AT THAT TIME THE VICTIM ADVISED SHE WAS ABLE TO GO TO THE DRIVER'S WINDOW OF THE PICKUP TRUCK AND MAKE CONTACT WITH THE DEFENDANT, LATER IDENTIFIED AS MR MICHAEL SMITH. THE VICTIM ADVISED SHE COULD OBSERVE THAT THE DEFENDANT WAS POSSIBLY IMPAIRED BECAUSE SHE COULD SMELL A STRONG ODOR OF ALCOHOL COMING FROM INSIDE OF THE TRUCK. THE VICTIM ADVISED THAT SHE WAS ABLE TO TELL THE DEFENDANT THAT HE HAD JUST HIT HER VEHICLE. AT THAT POINT THE DEFENDANT ADVISED THE VICTIM THAT HE WAS GOING TO LOOK FOR HIS INSURANCE CARD SO THEY COULD EXCHANGE INFORMATION, BUT AT THAT TIME THE DEFENDANT TOOK OFF. THE VICTIM ADVISED SHE WAS ABLE TO FOLLOW THE DEFENDANT TO AN UNKNOWN NUMERICAL OFF OF RIVER ROAD IN HERNANDO. I WAS THEN ABLE TO TAKE ALL OF THE INFORMATION FROM THE VICTIM REGARDING THE HIT AND RUN ACCIDENT. I SHOULD BE NOTED THAT THERE WAS NO PAINT TRANSFER FROM THE DEFENDANT'S VEHICLE TO THE VICTIM'S VEHICLE. PHOTOGRAPHS WERE TAKEN AND SUBMITTED WITH THE CRASH REPORT. I THEN ASKED THE VICTIM TO PLEASE SHOW ME THE RESIDENCE WHERE THE DEFENDANT PULLED INTO WHEN SHE FOLLOWED HIM EARLIER. UPON ARRIVING AT 5792 EAST JACK RABBIT COURT WE COULD NOT OBSERVE THE PICKUP TRUCK AT THAT ADDRESS. THE VICTIM THEN ADVISED THAT THIS WAS THE ADDRESS THE DEFENDANT CAME TO HIS FINAL DESTINATION EARLIER TODAY WHEN SHE FOLLOWED HIM. WHILE HEADING BACK TOWARDS HIGHWAY 200, I MADE VISUAL CONTACT WITH WHAT APPEARED TO BE THE DEFENDANT'S PICKUP TRUCK PARKED AT 5199 EAST TURKEY TRAIL IN HERNANDO. I WAS ABLE TO ASK THE VICTIM IF THAT WAS THE TRUCK, AND AT THAT TIME THE DEFENDANT WAS WALKING TOWARDS THE TRUCK IN THE BACKYARD. THE VICTIM WAS ALSO ABLE TO IDENTIFY THE DEFENDANT AS THE DRIVER OF THE PICKUP TRUCK. IT SHOULD BE NOTED THAT THE VICTIM WAS ON THE SIDE OF THE ROAD INSIDE OF HER VEHICLE AT ALL TIMES WHILE SHE POINTED THE DEFENDANT OUT TO THIS DEPUTY. AT THAT TIME I ADVISED THE VICTIM TO PLEASE LEAVE THE AREA SO I COULD START MY HIT AND RUN INVESTIGATION. AT THAT TIME I MADE CONTACT WITH THE DEFENDANT WHO IMMEDIATELY ADVISED THIS DEPUTY, WITHOUT ME ASKING ANY QUESTIONS, THAT HE WAS SORRY THAT HE LEFT THE SCENE OF THE ACCIDENT BECAUSE HE HAD BEEN DRINKING AND DRIVING. I COULD IMMEDIATELY SMELL A STRONG ODOR OF ALCOHOL EMITTING FROM HIS BREATH. I COULD ALSO OBSERVE THE MAROON PICKUP TRUCK BEARING FLORIDA KA1000078 PARKED IN THE BACKYARD. I WAS THEN ABLE TO READ THE DEFENDANT HIS MIRANDA WARNINGS BEFORE I ASKED HIM ANY QUESTIONS. I THEN ASKED THE DEFENDANT IF HE WISHED TO SPEAK WITH THIS DEPUTY AND HE ADVISED YES. I THEN ASKED THE DEFENDANT WHAT HAPPENED AT THE GAS STATION AND HE ADVISED WHILE HE WAS BACKING OUT FROM A PARKING SPOT AT THE GAS STATION, LOCATED ON HIGHWAY 200 AND WITHLACOOCHEE TRAIL, HE HIT A SILVER IMPALA THAT WAS PARKED BEHIND HIM PUMPING GAS AND HE THEN LEFT THE SCENE BECAUSE HE DID NOT WANT TO GET CAUGHT DRINKING AND DRIVING. AT THAT TIME I WAS ABLE TO ASK THE DEFENDANT FOR HIS DRIVER'S LICENSE, REGISTRATION, AND PROOF OF INSURANCE SO THAT I COULD ADD IT TO THE CRASH REPORT. I THEN ADVISED THE DEFENDANT THAT THE CRASH INVESTIGATION WAS COMPLETED. THE DEFENDANT WAS ADVISED HE WAS BEING PLACED UNDER ARREST FOR LEAVING THE SCENE OF AN ACCIDENT. AT THAT TIME THE DEFENDANT WAS HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK, SEARCHED AND SECURED, AND PLACED IN THE REAR OF MY PATROL VEHICLE. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. THE DEFENDANT WAS ALSO ISSUED UNIFORM TRAFFIC CITATION, NUMBER A1BUADP, FOR LEAVING THE SCENE OF A CRASH WITH A MANDATORY COURT DATE OF 082516 AT 1300 HOURS AT THE CITRUS COUNTY COURTHOUSE. THE DEFENDANT'S BOND WAS SET AT $500.00 PER THE BOND SCHEDULE FOR LEAVING THE SCENE OF AN ACCIDENT. |
