Charge description: Michael Yoon-Soo Song was convicted of Driving While Intoxicated 2nd Offense by a jury on January 15, 2015 after deliberating for approximately one hour. Presiding Judge Jeffrey A. McMeans sentenced the 62-year old Sugar Land man to a year-long probation one day later. Song was charged with the crime in 2011 after demonstrating signs of intoxication. According to Assistant District Attorney Sherman Hatton, Song was driving home on September 16, 2011 without using his headlights, weaving across lanes of traffic, and hitting multiple curbs. Harris County Sheriffs Deputy Coddou had noticed the defendants erratic driving and followed him into Sugar Land. After notifying Sugar Land Police, the deputy stopped the defendant and held him until Officer Brian Dirks arrived. Officer Dirks evaluated Song for impairment as part of a DWI investigation and determined that there was probable cause to arrest him. Song refused to give a breath sample and a search warrant was issued for a blood draw. The resulting blood test indicated the defendants blood alcohol content was over twice the legal limit of .08. DWIs are serious and a second offense is more than a mistake, said Hatton. Hopefully a second conviction and this probation will deter Mr. Song from drinking and driving and endangering other citizens on our roadways. Song was tried in County Court at Law No. 2. Driving While Intoxicated in this case is a Class A Misdemeanor punishable by 30 days to one year in jail and/or a fine up to $4,000. Song will pay a $750 fine, perform 40 hours of community service and be required to install an interlock ignition device on his car as part of his probation. He will also spend three days in jail and attend a DWI subsequent offender program in addition to two Victim Impact Panel presentations. Assistant District Attorneys Sherman Hatton and Jenna Rudoff prosecuted the case. Attorney Anthony Segura represented the defendant.
