SUBMITTED BY: STRICKLAND, JASON 0583 (AR09109809) DID UNLAWFULLY HAVE IN HIS HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: CANNABIS MORE THAN TWENTY GRAMS WEIGHED AT THIRTY TWO GRAMS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). AND DID UNLAWFULLY RESIST, OBSTRUCT, OR OPPOSE DEPUTY STRICKLAND , WHO WAS THEN AND THERE IN THE LAWFUL EXECUTION OF A LEGAL DUTY, OR EXECUTION OF LEGAL PROCESS, TO WIT: THE DEFENDANT HAD STRUCK BOTH MYSELF AND DEPUTY ROWAND WITH HIS FIST AND ELBOWS WITH OFFERING OR DOING VIOLENCE TO THE PERSON OF SUCH OFFICER, IN VIOLATION OF FLORIDA STATE STATUTE 843.02. AND DID UNLAWFULLY RESIST, OBSTRUCT OR OPPOSE DEPUTY ROWAND, WHO WAS THEN AND THERE IN THE LAWFUL EXECUTION OF A LEGAL DUTY, OR EXECUTION OF LEGAL PROCESS, TO WIT: THE DEFENDANT HAD STRUCK BOTH DEPUTY STRICKLAND AND DEPUTY ROWAND WITH HIS FIST AND ELBOWS WHILE OFFERING OR DOING VIOLENCE TO THE PERSON OF SUCH OFFICER, IN VIOLATION OF FLORIDA STATE STATUTE 843.02. ON 070209, AT APPROXIMATELY 1817 HOURS, WHILE CONDUCTING STATIONARY RADAR ON NORTH LECANTO HIGHWAY AND BLACK DIAMOND LOOP, I OBSERVED FOUR DOOR SILVER IN COLOR SEDAN TRAVELLING SOUTH ON NORTH LECANTO HIGHWAY ABOVE THE POSTED SPEED LIMIT. AT WHICH TIME, I ESTIMATED THE VEHICLE'S SPEED TO BE AT FIFTY TWO MILES PER HOUR IN A FORTY MILE PER HOUR ZONE. AT WHICH TIME, I ACTIVATED MY FRONT RADAR ANTENNA AND RECEIVED A CLEAR AUDIO DOPPLER TONE REVEALING MY TARGET VEHICLE SPEED TO BE FIFTY THREE MILES PER HOUR. AT THAT TIME, I ATTEMPTED TO CATCH UP TO the VEHICLE WHERE I INITIATED A TRAFFIC STOP AT the INTERSECTION OF NORTH LECANTO AND WEST FLARE LANE BY ACTIVATING MY OVERHEAD EMERGENCY LIGHTS. the VEHICLE CAME TO A STOP ON WEST FLARE LANE AND I MADE CONTACT WITH THE DRIVER/DEFENDANT, MR MICHAEL VENTICINQUE AND ADVISED HIM OF THE REASON FOR THE TRAFFIC STOP. the DEFENDANT THEN PROVIDED ME WITH HIS DRIVER'S LICENSE, REGISTRATION, AND PROOF OF INSURANCE. AT THAT TIME, I THEN ASKED THE DEFENDANT IF HE WOULD BE WILLING TO LET ME CONSENSUALLY, SEARCH HIS VEHICLE AT THE END OF MY TRAFFIC STOP TO WHICH THE DEFENDANT STATED "NO" HE DID NOT WANT ME SEARCHING HIS VEHICLE. AT THAT TIME, I THEN NOTIFIED DISPATCH TO SEND K9 DEPUTY ROWAND TO MY LOCATION IN REFERENCE TO A REFUSAL TO SEARCH. UPON DEPUTY ROWAND'S ARRIVAL AT MY LOCATION, HE CONDUCTED A SEARCH OF THE EXTERIOR OF the VEHICLE WITH K9 TUCK AT WHICH TIME, DEPUTY ROWAND ADVISED ME THAT K9 TUCK HAD ALERTED TO THE PRESENCE OF NARCOTICS. IT WAS AT THAT TIME, I ADVISED THE DEFENDANT TO EXIT the VEHICLE. UPON THE DEFENDANT EXITING HIS VEHICLE, I ADVISED THE DEFENDANT TO PLACE HIS HANDS ON THE HOOD OF MY VEHICLE TO WHERE I ATTEMPTED TO CONDUCT A SEARCH OF HIS PERSON. I THEN SEARCHED THE DEFENDANTS LEFT FRONT POCKET OF HIS SHORTS AND LOCATED A HUGE AMOUNT OF CURRENCY which WAS LATER DETERMINED TO BE THE AMOUNT OF $1,615.00 which WAS PLACED ON THE HOOD OF MY PATROL VEHICLE. IT WAS AT THAT TIME, THE DEFENDANT STARTED RESISTING THIS DEPUTY BY TRYING TO PUT HIS HANDS INTO HIS FRONT POCKETS AND ALSO ATTEMPTED TO GRAB THE LARGE AMOUNT OF CURRENCY FROM the HOOD OF MY PATROL VEHICLE AND TRIED TO STUFF IT BACK INTO THE FRONT POCKETS OF HIS SHORTS . AT THAT TIME, DEPUTY ROWAND ATTEMPTED TO ASSIST ME WITH RESTRAINING THE DEFENDANT'S HANDS SO THAT THE SEARCH OF HIS PERSON COULD BE COMPLETED WHERE the DEFENDANT BEGAN PHYSICALLY ELBOWING MYSELF PER THIS DEPUTY AND ALSO PUNCHING DEPUTY ROWAND IN THE CHEST. I THEN STEPPED BACK AND DREW MY AGENCY ISSUED TASER WHERE I ADVISED DEPUTY ROWAND TO LET GO OF THE SUBJECT SO THAT I COULD TASER HIM. AT THAT TIME, THE SUBJECT KEPT PHYSICALLY RESISTING ANY COMMANDS THAT WERE GIVEN TO HIM AND DEPUTY ROWAND THEN ADVISED THE DEFENDANT THAT IF HE DID NOT STOP RESISTING, HE WAS GOING TO BE APPREHENDED BY HIS K9 DOG. THE DEFENDANT THEN STRIPPED HIMSELF OUT OF HIS SHIRT AND BEGAN RUNNING IN A SOUTHWARDLY DIRECTION TO A NEARBY WOODED AREA WHERE IT WAS AT THAT TIME, DEPUTY ROWAND THEN POPPED HIS REAR DOOR RELEASING K9 TUCK. SHORTLY THEREAFTER, K9 TUCK AND DEPUTY ROWAND ENTERED the WOODED AREA AFTER THE DEFENDANT WHERE I WAS THEN ADVISED BY DEPUTY ROWAND THAT K9 TUCK HAD APPREHENDED the SUSPECT. IT SHOULD BE NOTED, DURING THE SCUFFLE WITH the DEFENDANT, THE DEFENDANT HAD STRUNG THE CURRENCY ON THE ROADWAY AND ALSO HAD DROPPED A BLUE IN COLOR PLASTIC BAGGIE CONTAINING CANNABIS AND ALSO A DIGITAL SCALE AND SIX SMALLER CELLOPHANE BAGGIES WHICH WERE LOCATED IN the DEFENDANT'S RIGHT FRONT OF HIS SHORTS. AT THAT TIME, I THEN PLACED THE CANNABIS ALONG WITH THE MONEY HE TRIED SNATCHING OFF the FRONT OF MY HOOD BACK ONTO THE HOOD OF MY PATROL VEHICLE. I THEN RESPONDED TO DEPUTY ROWAND'S LOCATION AND PLACED THE DEFENDANT UNDER ARREST, HANDCUFFED (DOUBLED LOCKED) AND ESCORTED the DEFENDANT BACK TO MY PATROL VEHICLE WHERE DEPUTY ROWAND THEN NOTIFIED SERGEANT FISHER AND LIEUTENANT GREEN OF THE INCIDENT. DISPATCH WAS NOTIFIED TO SEND EMERGENCY MEDICAL SERVICES TO OUR LOCATION IN REFERENCE TO THE K9 APPREHENSION. AT THAT TIME, THE DEFENDANT REVEALED TO ME THAT HIS VEHICLE WAS PAID FOR TO WHERE I ADVISED HIM THAT WE WOULD BE FORFEITING HIS VEHICLE. UPON THE ARRIVAL OF EMERGENCY MEDICAL SERVICES, THE DEFENDANT WAS THEN TRANSPORTED TO the CITRUS MEMORIAL HOSPITAL FOR MEDICAL CARE. DURING THAT TIME, THE DEFENDANT'S VEHICLE WAS DRIVEN TO the CITRUS COUNTY SHERIFFS OFFICE FORFEITURE YARD WHERE ALL PROPER PAPERWORK WAS COMPLETED BY THIS DEPUTY FOR THE VEHICLE AND CURRENCY WHICH TOTALED $1,615.00. THE AFOREMENTIONED CURRENCY WAS COUNTED BY MYSELF AND DEPUTY ROWAND. UPON COMPLETING THE FORFEITURE PAPERWORK, I RESPONDED TO CITRUS MEMORIAL HOSPITAL WHERE I MADE CONTACT WITH the DEFENDANT AND MEDICAL STAFF. I THEN RECEIVED ALL PROPER PAPERWORK CLEARING THE DEFENDANT FROM THE HOSPITAL. THE DEFENDANT WAS THEN TRANSPORTED TO the CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. WHILE AT THE CITRUS COUNTY DETENTION FACILITY, THE DEFENDANT'S BOND WAS SET AT A TOTAL OF $15,000.00 PER THE BOND SCHEDULE. THE DEFENDANT ALSO SIGNED THE FORFEITURE PAPERWORK FOR THE VEHICLE AND CURRENCY. IT SHOULD BE ANNOTATED THAT THE ENTIRE TRAFFIC STOP WAS RECORDED FROM MY IN CAR VIDEO RECORDING SYSTEM WHICH WILL BE TURNED INTO EVIDENCE. *not-exempt* |
