Probable cause affidavit: SUBMITTED BY: FULLER, DAVID 0267 (AR07100795) DID UNLAWFULLY AND KNOWINGLY TAKE, OBTAIN OR USE OR ENDEAVOR TO TAKE, OBTAIN OR USE THE PROPERTY OF THE VICTIM, BEALLS DEPARTMENT STORE, TO WIT: ONE BLACK TEE-SHIRT VALUED AT APPROXIMATELY $26.00 BY THE DEFENDANT TAKING POSSESSION OF OR CARRYING AWAY THE SAID MERCHANDISE, WITH THE INTENT TO TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM, A MERCHANT, OF THE POSSESSION, USE, BENEFIT, OR FULL RETAIL VALUE OF SAID PROPERTY, SAID PROPERTY BEING OF A VALUE OF LESS THAN $300.00, IN VIOLATION OF FLORIDA STATE STATUTES 812.015, 812.014(1), AND 812.014(2)(B). ON 121607 AT 1949 HOURS, I ARRIVED AT 2851 EAST GULF TO LAKE HIGHWAY, BEALLS DEPARTMENT STORE, IN RESPONSE TO A CALL FROM THE LOSS PREVENTION DEPARTMENT ABOUT AN INCIDENT THAT HAD OCCURRED in the STORE. UPON ARRIVAL, I MADE CONTACT WITH THE LOSS PREVENTION OFFICER IN HIS OFFICE. HE ADVISED THAT HE HAD OBSERVED THE DEFENDANT (MR MICHAEL ZOOK) GRAB A FEMALE BY HER SHIRT, PULL HER TOWARDS HIM AND APPEARED TO BE YELLING AT HER. IT WAS AT THAT TIME, THIS AGENCY WAS CONTACTED. WHILE SPEAKING TO LOSS PREVENTION OFFICER, BOTH HE AND MYSELF CONTINUED TO WATCH the DEFENDANT inSIDE the STORE VIA VIDEO CAMERA. WE OBSERVED the DEFENDANT AND HIS FEMALE FRIEND GO TO THE REGISTER AND PAY FOR A SHIRT. THE DEFENDANT THEN WENT BACK OVER TO the TEE-SHIRT SECTION in the MEN'S DEPARTMENT AND THE FEMALE SUBJECT, WHO HAD THE BEALLS BAG, DROPPED THE BAG NEAR THE EXIT AND SHE LEFT THE STORE. WE THEN OBSERVED THE DEFENDANT GO BACK OVER AND PICK UP THE BAG OFF THE FLOOR, WALK OVER TO THE TEE-SHIRT SECTION IN the MEN'S DEPARTMENT and PLACE THE BLACK TEE-SHIRT inSIDE the BEALLS BAG. I THEN OBSERVED THE DEFENDANT EXIT THE STORE, AT WHICH TIME, I EXITED THROUGH THE LOSS PREVENTION DOOR AND MADE CONTACT WITH THE E DEFENDANT OUTSIDE THE STORE. I ASKED HIM WHAT HE HAD IN the BAG, TO WHICH HE STATED HE HAD A SHIRT AND HE SAID HE HAD PAID FOR IT; HOWEVER, HE WAS NOT ABLE TO PROVIDE THE RECEIPT. IN the BAG WAS the ONE SHIRT HE HAD PAID FOR AND the BLACK TEE-SHIRT HE HAD STOLEN. THE DEFENDANT WAS PLACED UNDER ARREST FOR RETAIL THEFT. HE WAS HANDCUFFED DOUBLE LOCKED BEHIND HIS BACK. HE WAS READ HIS MIRANDA RIGHTS VIA CARD, TO WHICH HE STATED HE UNDERSTOOD. I ASKED HIM IF HE WISHED TO CONTINUE TO SPEAK TO ME, TO WHICH HE STATED HE DID. HE STATED he was just IN A HURRY AND HAD FORGOTTEN TO PAY. THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING. THE DEFENDANT WAS ALSO TRESPASSED FROM THE STORE. THE COPY OF THE VIDEO SURVEILLANCE TAPE WAS TURNED INTO THE CITRUS COUNTY SHERIFF'S OFFICE (CCSO) EVIDENCE SECTION and the DEFENDANT'S BOND WAS SET $250.00, PER THE BOND SCHEDULE. A SWORN WRITTEN STATEMENT WAS COLLECTED FROM THE LOSS PREVENTION OFFICER AND LATER TURNED IN TO THE CCSO RECORDS DEPARTMENT. *NOT-EXEMPT*
