SUBMITTED BY: FISHER, AUSTIN 1335 (AR15-14227) DID, KNOWING her DRIVERâS LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(2)(A). DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: A MARIJUANA PIPE, IN VIOLATION OF FLORIDA STATE STATUTE 893.147(1). ON 031315, WHILE CONDUCTING A SECURITY CHECK OF THE HIGHLANDS, I OBSERVED A GOLD IN COLOR, FOUR DOOR VEHICLE, BEARING FLORIDA LICENSE PLATE Y4KWS, RUN A STOP SIGN AT APOPKA AVENUE AND HIGHLANDS BOULEVARD. I FOLLOWED THE VEHICLE AND INITIATED A TRAFFIC STOP AT 0017 HOURS, AT SOUTH OSCEOLA AVENUE AND WEST GRACE STREET. UPON THE VEHICLE PULLING OVER, I MADE CONTACT WITH THE DEFENDANT/DRIVER, MS MICHELLE CLAIRE JONES. I ASKED THE DEFENDANT FOR HER DRIVER'S LICENSE, VEHICLE REGISTRATION, AND PROOF OF INSURANCE, TO WHICH SHE STATED SHE DID NOT HAVE HER DRIVER'S LICENSE ON HER, BUT SHE WOULD PROVIDE ME HER NAME, DATE OF BIRTH, AND SOCIAL SECURITY NUMBER. UPON receiving THE DEFENDANTâS INFORMATION, I VERIFIED THE IDENTIFY OF THE DEFENDANT AND DISCOVERED HER DRIVER'S LICENSE WAS SUSPENDED INDEFINITELY IN 2005. I ASKED THE DEFENDANT IF SHE KNEW HER DRIVER'S LICENSE WAS SUSPENDED, TO WHICH SHE STATED YES. AT THAT TIME, I ASKED THE DEFENDANT TO STEP OUT OF THE VEHICLE, TO WHICH SHE DID. UPON THE DEFENDANT EXITING HER VEHICLE, DEPUTY SUDLOW (0759) AND I OBSERVED THE DEFENDANT STUFF SOMETHING IN HER TOP LEFT BRA CUP. WHEN THE DEFENDANT TOOK HER HAND AWAY, I OBSERVED WHAT APPEARED TO BE A PAPER TOWEL STICKING OUT OF HER LEFT BRA CUP. I ASKED THE DEFENDANT WHAT SHE HAD PLACED IN HER BRA, TO WHICH SHE STATED A PIPE USED FOR MARIJUANA. I THEN ASKED THE DEFENDANT TO REMOVE THE PIPE FROM HER BRA, AT WHICH TIME SHE DID. THE PIPE WAS WRAPPED IN A BROWN PAPER TOWEL. UPON OBSERVING THE PIPE, IT WAS METALLIC AND HAD CHORE BOY AND BURNT RESIDUE MARKS AT THE TIP. THE PIPE WAS SEIZED AND LATER TURNED IN TO EVIDENCE. I THEN PLACED THE DEFENDANT UNDER ARREST FOR DRIVING WHILE LICENSE SUSPENDED (KNOWINGLY) AND FOR POSSESSION OF DRUG PARAPHERNALIA. THE DEFENDANT WAS HANDCUFFED, (DOUBLE LOCKED) BEHIND HER BACK, SEARCHED, AND SECURED IN THE REAR OF MY PATROL VEHICLE. PRIOR TO LEAVING THE SCENE, THE DEFENDANTâS FATHER, WHO OWNS THE VEHICLE, WAS CONTACTED TO PICK UP THE VEHICLE, TO WHICH HE DID. I THEN TRANSPORTED THE DEFENDANT TO THE CITRUS COUNTY DETENTION FACILITY, WHERE HER BOND WAS SET AT $1,500.00, PER THE BOND SCHEDULE. I ISSUED THE DEFENDANT WRITTEN WARNING, WARNING NUMBER 38556B, FOR RUNNING A STOP SIGN. I ALSO ISSUED THE DEFENDANT FLORIDA UNIFORM TRAFFIC CITATION, CITATION NUMBER A1BTSDP, FOR DRIVING WHILE LICENSE SUSPENDED (KNOWINGLY), WITH A MANDATORY COURT DATE ON 033015 AT 0815 HOURS, AT THE CITRUS COUNTY COURT HOUSE. |
