SUBMITTED BY: RAMOS, ROBALDO 0515 (AR11122328) DID UNLAWFULLY AND KNOWINGLY OBTAIN OR USE, OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, WAL-MART, TO WIT: AUTOMOTIVE AND GROCERY ITEMS, SAID PROPERTY BEING OF A VALUE OF $71.09, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATE STATUTES 812.014(1) and 812.014(3)(A). ON 082011, I WAS DISPATCHED TO WAL-MART LOCATED AT 2461 EAST GULF TO LAKE HIGHWAY IN INVERNESS, IN REFERENCE TO A SHOPLIFTER WHO WAS ALREADY IN CUSTODY. UPON MY ARRIVAL, I MADE CONTACT WITH THE COMPLAINANT/WITNESS LOSS PREVENTION OFFICER WILLIAMS. HE PROVIDED A WRITTEN STATEMENT AND ADVISED THAT HE OBSERVED THE DEFENDANT, WHO WAS LATER IDENTIFIED AS MICHELLE SPIVEY, SELECT A VARIETY OF AUTOMOTIVE AND GROCERY MERCHANDISE. SOME ITEMS SHE CONCEALED INSIDE HER PURSE AND SOME ITEMS SHE HAD PLACED ON THE CHILD'S SEAT IN THE SHOPPING CART. SHE THEN PROCEEDED TO THE CASH REGISTER WHERE SHE PAID FOR THE ITEMS SHE HAD IN HER SHOPPING CART, BUT NOT THE ONES SHE HAD CONCEALED INSIDE HER PURSE. SHE THEN EXITED THE STORE PASSING ALL POINTS OF SALE, AT WHICH TIME, OFFICER WILLIAMS IDENTIFIED HIMSELF AND PLACED HER IN TO CUSTODY UNTIL THE SHERIFF'S OFFICE COULD ARRIVE. I THEN SPOKE WITH THE DEFENDANT AND READ HER, HER MIRANDA RIGHTS. THE DEFENDANT WAIVED HER RIGHTS. THE DEFENDANT'S STATEMENT CORROBORATED WITH THAT OF OFFICER WILLIAMS' STATEMENT. SHE WAS PLACED UNDER ARREST, HANDCUFFED (DOUBLE LOCKED) AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE GROCERIES SHE DID PAY FOR WERE HELD FOR HER BOYFRIEND TO COLLECT AT A LATER TIME. THE DEFENDANT'S BOND WAS SET AT $250.00, PER THE BOND SCHEDULE.
