SUBMITTED BY: TITUS, JOSHUA 1243 (AR14-12264) (14-136733) DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: .5 OF ECSTASY, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A); AND DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: 1.5 GRAMS OF METHAMPHETAMINE, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A); AND DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: METHAMPHETAMINE AND MARIJUANA, IN VIOLATION OF FLORIDA STATE STATUTES 893.145 AND 893.147(1)(B). ON 100514, I WAS TRAVELING SOUTHBOUND ON HIGHWAY 41 APPROACHING THE AREA OF EDEN DRIVE WHEN I OBSERVED A CAR TRAVELING NORTHBOUND ON HIGHWAY 41 TO HAVE A FRONT RIGHT HEADLIGHT TO BE OUT. AT THAT TIME, I TURNED AROUND AND WAS TRAVELING NORTH ON HIGHWAY 41 AND OBSERVED THE VEHICLE TO BE WHITE IN COLOR TO TURN EAST ON HIGHWAY 44. I PACED THE VEHICLE AT A SPEED OF 69 MILES PER HOUR (MPH), AT which TIME I CONDUCTED A TRAFFIC STOP, INITIATING MY OVERHEAD LIGHT, ON FLORIDA TAG CGNL52, AT THE INTERSECTION OF HIGHWAY 41 and SOUTH COVE WALK. AT THAT TIME, I APPROACHED the VEHICLE AND made CONTACT WITH MR CHARLES MARSHALL AND STATED THE REASON FOR PULLING HIM OVER. I ASKED HIM FOR HIS DRIVER'S LICENSE, REGISTRATION AND PROOF OF INSURANCE, AT which TIME HE FAILED TO PROVIDE ME WITH ANY INFORMATION. AT THAT TIME, I ASKED THE FRONT PASSENGER, A WHITE FEMALE, LATER IDENTIFIED AS MS MISTY MILES, FOR HER IDENTIFICATION. I theN RESPONDED BACK TO MY PATROL VEHICLE WHERE I ASKED FOR K-9 DEPUTY VIGGIANO TO RESPOND TO MY LOCATION. A SHORT TIME LATER, HE ARRIVED ON SCENE AND HIS CANINE CONAN ALERTED ON the VEHICLE. BOTH OCCUPANTS WERE ASKED TO EXIT THE VEHICLE, AT which TIME MS MILES BEGAN TO CRY AND STATED "IT'S NOT MINE". SHE THEN PULLED A BLACK PLASTIC BAGGIE FROM HER UPPER BRA AREA, WITH A SUBSTANCE INSIDE. THE SUBSTANCE WAS IDENTIFIED AS 1.5 GRAMS OF METHAMPHETAMINE. AT THAT TIME, MS MILES ALSO STATED SHE HAD AN UNKNOWN AMOUNT OF ECSTASY IN ONE OF HER BAGS that WAS IN THE CAR WITH HER BELONGINGS. AT THAT TIME, DEPUTY CHENOWETH FOUND .5 GRAMS OF ECSTASY, WHICH WAS LOCATED IN HER PURSE IN A CLEAR SMALL PLASTIC BAGGIE. IT DID TEST POSITIVE THROUGH AN AGENCY ISSUED FIELD TEST KIT. ALSO IN MS MILES' BELONGINGS WERE TWO STRAWS WITH BURNT TIPS, ONE WOOD PIPE THAT TESTED POSITIVE FOR MARIJUANA RESIDUE, ONE FOIL PIPE which TESTED POSITIVE OF MARIJUANA RESIDUE, AND ONE EMPTY 305 CIGARETTE PACK WITH TWO "ROACHES" THAT TESTED POSITIVE FOR MARIJUANA. THE ABOVE ITEMS WERE COLLECTED AND TURNED INTO EVIDENCE. AT THAT TIME, MS MILES COMPLETED A SWORN WRITTEN STATEMENT WHERE she STATED THAT SHE BOUGHT THE 1.5 GRAMS OF METHAMPHETAMINE FROM MR MARSHALL, BUT MR MARSHALL NEVER HAD THE METHAMPHETAMINE IN HIS POSSESSION. AT THAT TIME, I ADVISED MS MILES SHE WAS UNDER ARREST FOR TWO COUNTS OF POSSESSION OF A CONTROLLED SUBSTANCE AND ONE COUNT OF POSSESSION OF DRUG PARAPHERNALIA. SHE WAS HANDCUFFED (DOUBLE LOCKED) BEHIND THE BACK and TRANSPORTED TO the CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. HER BOND WAS SET AT A TOTAL OF $5,000.00 PER THE BOND SCHEDULE. |
