Probable cause affidavit: SUBMITTED BY: LAMBERT, BOBBY 0480 (AR10114298) REID, JUSTIN 0706 DID UNLAWFULLY AND KNOWINGLY TAKE, OBTAIN OR USE OR ENDEAVOR TO TAKE, OBTAIN OR USE THE PROPERTY OF THE BEALL'S DEPARTMENT STORE, TO WIT: ONE BLACK AND WHITE SMALL IN SIZE SOUTHPOLE T-SHIRT, ONE BLACK AND WHITE CHECKERED, SIZE 10, SOUTHPOLE SHORTS, CARRYING AWAY THE SAID MERCHANDISE, WITH INTENT TO TEMPORARILY OR PERMANENTLY DEPRIVE, A MERCHANT, OF THE POSSESSION, USE, BENEFIT, OR FULL RETAIL VALUE OF SAID PROPERTY, SAID PROPERTY BEING OF A VALUE OF LESS THAN $300.00, IN VIOLATION OF FLORIDA STATE STATUTE 812.014(3)(A). ON 041410 AT APPROXIMATELY 1520 HOURS, I WAS DISPATCHED TO THE BEALL'S DEPARTMENT STORE AT 2851 EAST GULF TO LAKE HIGHWAY IN INVERNESS IN REFERENCE TO A RETAIL THEFT. UPON ARRIVAL, I MADE CONTACT WITH THE BEALL'S DISTRICT MANAGER, WHO STATED THAT SHE AND THE RETAIL SECURITY OFFICER WITNESSED THE SUSPECT, MR MITCHELL MANINGER, PLACE A BLACK AND WHITE SOUTHPOLE T-SHIRT, WITH AN ESTIMATED VALUE OF $28.00, AND ONE PAIR OF BLACK AND WHITE CHECKERED SOUTHPOLE SHORTS, WITH AN ESTIMATED VALUE OF $38.00, INTO THE PAIR OF SHORTS HE WAS WEARING. AT THAT TIME, THE SECURITY OFFICER APPROACHED THE SUSPECT AND ASKED HIM WHAT HE WAS DOING. WHEN THE SUSPECT ATTEMPTED TO LEAVE THE STORE, THE SECURITY OFFICER APPROACHED HIM AND THEN DETAINED HIM AND ESCORTED THE SUSPECT TO THE DEPARTMENT STORE'S HOLDING AREA, WHERE HE QUESTIONED THE SUSPECT. THE SECURITY OFFICER THEN STATED THAT THE SUSPECT ADMITTED TO PLACING THE ITEMS IN HIS SHORTS AND DID NOT INTEND TO PAY FOR THEM. THE SECURITY OFFICER WAS ABLE TO RETRIEVE THE STOLEN ITEMS FROM THE SUSPECT'S POSSESSION. I THEN READ THE SUSPECT HIS MIRANDA WARNINGS VIA A PRE-PRINTED MIRANDA CARD. THE SUSPECT ADVISED THAT HE WAS AWARE OF HIS MIRANDA RIGHTS AND AGREED TO CONTINUE TO TALK TO ME. AT THAT TIME, THE SUSPECT STATED THAT WHAT HE DID WAS STUPID AND THAT TIMES WERE TOUGH AND HE DOES NOT KNOW WHY HE DID IT. THE SUSPECT DID STATE THAT HE HAD MONEY IN HIS WALLET, BUT THAT IT WAS GOING TO BE USED FOR OTHER PURPOSES. THE SUSPECT ALSO STATED THAT HIS GIRLFRIEND HAD NO INVOLVEMENT IN HIS ACTIONS AND WAS NOT AWARE THAT HE WAS NOT GOING TO PAY FOR THE ITEMS. I THEN ASKED HIS GIRLFRIEND WHAT HER INVOLVEMENT WAS IN THIS CASE. THE GIRLFRIEND STATED THAT SHE DID HAND THE ITEMS TO THE SUSPECT BELIEVING THAT HE WAS GOING TO PAY FOR THEM. SHE STATED THAT THE SUSPECT JUST CASHED A CHECK ON 041410 FOR $2,100.00 AND SHE DID NOT SEE ANY REASON WHY HE COULD NOT HAVE PAID FOR THE ITEMS. SHE WAS THEN ADVISED THAT HER BOYFRIEND WAS BEING ARRESTED AND THE SUSPECT'S PROPERTY WAS HANDED OVER TO HER, BY REQUEST OF THE SUSPECT. THE COMPLAINANT AND WITNESS BOTH COMPLETED SWORN WRITTEN STATEMENTS. THE COMPLAINANT AND WITNESS ALSO PROVIDED ME WITH A DIGITAL VIDEO DISC (DVD) RECORDING OF THE ACTUAL CRIME TAKING PLACE. THE COMPLAINANT AND WITNESS WERE GIVEN A PROPERTY RECEIPT STATING THAT THE STOLEN PROPERTY WAS BEING RETURNED TO THEM. BOTH THE COMPLAINANT AND WITNESS WERE GIVEN AN AGENCY CASE CARD BEARING THIS CASE NUMBER AND MY INFORMATION. THE WRITTEN STATEMENT AND PROPERTY RECEIPT WERE LATER TURNED IN TO THE CITRUS COUNTY SHERIFF'S OFFICE (CCSO) RECORDS DIVISION. THE DVD WAS ALSO LATER TURNED IN TO THE CCSO EVIDENCE DIVISION. THE SUSPECT WAS THEN HANDCUFFED (DOUBLE LOCKED), IN THE BACK AND PLACED IN THE REAR OF MY PATROL VEHICLE AND TRANSPORTED TO CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. *NOT-EXEMPT*
