Probable cause affidavit: | SUBMITTED BY: SETTLES, KATHY 0113 (AR09108402) DID UNLAWFULLY AND KNOWINGLY OBTAIN OR USE, OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, BEALLS OUTLET, TO WIT: MISCELLANEOUS CLOTHING ARTICLES, SAID PROPERTY BEING OF A VALUE OF $66.97, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HER OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATE STATUTES 812.014(1) and 812.014(3)(A). ON 033009 AT 1338 HOURS, I RESPONDED TO THE BEALLS OUTLET IN CRYSTAL RIVER WHERE I MADE CONTACT WITH LOSS PREVENTION AGENT OF BEALLS OUTLET. HE ADVISED THAT AN UNKNOWN FEMALE LATER IDENTIFIED AS THE DEFENDANT (MS MONIQUE GARDENIER) WAS OBSERVED SELECTING FOUR PAIRS OF BLACK PANTS, THREE PAIRS OF BLUE JEANS, ONE PAIR OF WHITE PANTS AND A BLACK SWIM SUIT. HE STATED SHE THEN ENTERED THE FITTING ROOM WITH THE ITEMS AND WHEN SHE EXITED THE FITTING ROOM SHE DID NOT HAVE ANY OF THE ITEMS WITH HER. HE STATED HE CHECKED THE FITTING ROOM AND FOUND ALL OF THE ITEMS SHE TOOK WITH HER WITH THE EXCEPTION OF ONE PAIR OF BLACK PANTS, ONE PAIR OF BLUE JEANS AND THE BATHING SUIT. HE ADVISED THE DEFENDANT THEN EXITED THE STORE, PASSING ALL POINTS OF SALE, WITHOUT PAYING FOR ITEMS CONCEALED. HE ADVISED HE THEN EXITED THE STORE AND MADE CONTACT WITH THE DEFENDANT, AT WHICH TIME SHE WAS BROUGHT BACK INTO THE BREAK ROOM AND ADVISED THAT THE ARTICLES WERE RECOVERED FROM HER PURSE. LOSS PREVENTION PROVIDED A WRITTEN STATEMENT FORM. THE DEFENDANT, WHO IS 6 MONTHS PREGNANT. ADVISED THAT THIS WAS THE FIRST TIME SHE HAD DONE THIS AND THAT SHE HAS NOT BEEN ARRESTED FOR SHOPLIFTING EVER BEFORE. SHE ADVISED THAT SINCE SHE HAS GOTTEN LARGER SHE WAS NOT ABLE TO FIT INTO HER CLOTHES AND SHE DID NOT FEEL SHE HAD ANY OTHER MEANS TO OBTAIN THESE ITEMS. THE DEFENDANT CAME TO THE STORE IN HER VEHICLE; HOWEVER, SHE HAD HER THREE MONTH OLD POMERANIAN PUPPY IN THE CAR WITH HER. HER BOYFRIEND RESIDES IN INGLIS AND SHE HAD THE ONLY PHONE THEY HAD WITH HER. THIS DEPUTY REQUESTED ANIMAL CONTROL TO RESPOND TO PICK UP THE PUPPY FROM THE VEHICLE. I LEFT THE DEFENDANT'S VEHICLE KEYS WITH LOSS PREVENTION FOR THEM TO RETRIEVE THE PUPPY OUT OF THE CAR, AT WHICH TIME I WILL RESPOND TO BEALLS OUTLET, OBTAIN THE DEFENDANT'S KEYS AND BRING THEM BACK TO THE CITRUS COUNTY JAIL FOR THEM TO BE SECURED WITH THE DEFENDANT'S PROPERTY. THIS DEPUTY CONTACTED INGLIS POLICE TO HAVE THEM MAKE CONTACT WITH HER BOYFRIEND SO HE CAN MAKE ARRANGEMENTS TO COME PICK UP HER VEHICLE FROM THE BEALLS OUTLET PARKING LOT AT HER REQUEST. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WITHOUT INCIDENT. HER BOND WAS SET AT $250.00, PER THE BOND SCHEDULE. A PROPERTY RECEIPT WAS COMPLETED FOR THE ITEMS TAKEN AND ALL ARTICLES WERE TURNED BACK OVER TO BEALLS. PHOTOGRAPHS WERE TAKEN OF THE ITEMS. *NOT-EXEMPT* |
