DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: SCALES AND PLASTIC BAGGIES, IN VIOLATION OF FLORIDA STATE STATUTES 893.145 AND 893.147(1). ON 060910, A CONTROLLED PURCHASE OPERATION WAS COMPLETED DURING WHICH A CONFIDENTIAL INFORMANT PURCHASED CANNABIS FROM THE DEFENDANT, MR NATHAN DICK. EVIDENCE OF THE TRANSACTION WAS COLLECTED BY DETECTIVE MARSHALL AT the CONCLUSION OF THE CONTROLLED PURCHASE OPERATION. THIS EVIDENCE DEPICTED A TRANSACTION FOR THE AFOREMENTIONED CANNABIS OVER 20 GRAMS. ON 070910, A SEARCH WARRANT OPERATION AT the DEFENDANT'S ADDRESS LOCATED AT 7795 WEST FLORASUN LANE IN CRYSTAL RIVER WAS CONDUCTED DURING WHICH SURVEILLANCE OBSERVED THE DEFENDANT LEAVE THE RESIDENCE IN A VEHICLE. A TRAFFIC STOP WAS COMPLETED AND DEPUTY TACKETT MADE CONTACT WITH THE DEFENDANT and SECURED HIM IN HANDCUFFS. BASED on the PROBABLE CAUSE FOR THE PREVIOUS SALE AND POSSESSION OF CANNABIS, THE DEFENDANT WAS TRANSPORTED BACK TO HIS RESIDENCE WHERE THE SEARCH WARRANT WAS EXECUTED. ALSO LOCATED in the RESIDENCE WAS THE DEFENDANT'S WIFE. THE DEFENDANT AND HIS WIFE WERE SEATED IN the KITCHEN OF THE RESIDENCE, AT WHICH TIME, thIS DETECTIVE READ A COPY OF THE SEARCH WARRANT, AS WELL AS THE MIRANDA WARNINGS VIA PRE PRINTED CARD. BOTH SUBJECTS STATED THEY UNDERSTOOD THEIR RIGHTS AND would SPEAK WITH THIS DETECTIVE. A SEARCH OF THE RESIDENCE YIELDED SEVERAL ITEMS OF EVIDENTIARY VALUE. THESE ITEMS CONSISTED OF CANNABIS having BEEN LOCATED IN TWO AREAS OF the RESIDENCE. APPROXIMATELY THREE QUARTERS OF A POUND OF CANNABIS WAS LOCATED IN the STORAGE ROOM INSIDE the RESIDENCE. IT SHOULD BE NOTED, PRIOR TO THE ARRIVAL AT the RESIDENCE this DETECTIVE ADVISED NATHAN DICK OF HIS MIRANDA WARNINGS VIA PRE PRINTED CARD. NATHAN DICK ADVISED HE UNDERSTOOD HIS RIGHTS AND WOULD SPEAK WITH THIS DETECTIVE. THE DEFENDANT ADMITTED APPROXIMATELY ONE POUND OF CANNABIS would BE LOCATED IN A STORAGE ROOM AT HIS RESIDENCE. THE CANNABIS WAS LOCATED BY DEPUTY LAKATIS AFTER the DEFENDANT POINTED TO THE SPECIFIC LOCATION. FURTHER SEARCH OF THE RESIDENCE YIELDED A SECOND BAG CONTAINING APPROXIMATELY THREE QUARTERS OF A POUND OF CANNABIS IN A DRESSER IN the MASTER BEDROOM OF THE RESIDENCE. THE DEFENDANT and HIS WIFE WERE CONFRONTED WITH THE DISCOVERY OF THE CANNABIS IN the BEDROOM, TO WHICH THE DEFENDANT DID NOT REMEMBER, BUT THE DEFENDANT'S WIFE DID ACKNOWLEDGE THAT THERE WAS A LARGE AMOUNT OF CANNABIS in the BEDROOM. ALSO LOCATED IN THE DRESSER WERE SEVERAL MEDICATION PRESCRIPTION TABLETS. THESE TABLETS INCLUDED ONE 30 MILLIGRAM TABLET ACETAMINOPHEN CODEINE, ONE 1.5 MILLIGRAM TABLET ALPRAZOLAM, 13 HYDROCODONE TABLETS. SAID TABLETS WERE CONTAINED IN PLASTIC BAGGIES. SEVERAL OTHER ITEMS OF PARAPHERNALIA, INCLUDING SCALES AND PLASTIC BAGGIES, WERE LOCATED IN the SAME DRESSER AS THE CANNABIS. THE DEFENDANT'S WIFE WAS CONFRONTED AS TO THE DISCOVERY OF THE TABLETS, TO WHICH SHE STATED SHE HAD RECEIVED THE HYDROCODONE FROM A SUBJECT NAMED ALLEN JACKSON AND THE CODEINE TABLET FROM A FRIEND SHE REFERRED TO AS "PATTY". A FURTHER SEARCH OF THE BEDROOM YIELDED ONE HYDROCODONE TABLET HAVING BEEN LOCATED IN A PAIR OF MEN'S JEANS. ALSO LOCATED IN the BEDROOM OF the RESIDENCE WAS A WOMEN'S PURSE. THE DEFENDANT'S WIFE STATED THAT THE PURSE WAS HERS. A SEARCH OF the PURSE YIELDED ONE OXYCODONE 30 MILLIGRAM TABLET. THE DEFENDANT'S WIFE ADMITTED THE PILL WAS HERS AND SHE WAS GOING TO "SNORT" THE TABLET. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WHERE HIS BOND WAS SET AT $20, 500.00, PER THE BOND SCHEDULE. *NOT-EXEMPT*
