Probable cause affidavit: SUBMITTED BY: PAYNE, JONATHAN 0305 (AR08104787) did knowingly, willfully, and feloniously BE IN the actual constructive possession of a controlled substance, to wit: psilocybin (mushrooms) in violation Of florida statute 893.13(6)(a) and 893.03(1)(c) (AND) DID UNLAWFULLY AND WILLFULLY ENTER OR REMAIN on property, TO WIT: farm pasture land , THE PROPERTY OF THE VICTIM, WITHOUT BEING AUTHORIZED, LICENSED, OR INVITED TO DO SO BY THE OWNER, LESSEE, OR THEIR AGENT, IN VIOLATION OF FLORIDA STATE STATUTES 810.09(1)(a) AND 810.08(2)(A). on 081908 at apprOximately 1831 hours i was dispatched to the area of 10211 west riverwood drive in reference to a vehicle parked on the side of the road. upon my arrival i made contact with the complaiNant who advised me that they have had problems in the past with people parking their veHicles along the roadway and entering into the wooded area to the cow pasture for the purpose of picking (PSILOCYBIN) mushrooms. myself and deputy doyle walked through the wooded area where we came upon a pasture. it should be noted that there were two fences to get into the pasture. at that TIME I observed a white male and white female walking across the pasture. the white female was carrying a burgundy colored bag. through my training and knowledge i know that after a rain the psilocybin mushrooms sprout from cow manure. i observed the two subjects, later identified as defendant one MS sarah decuir, and defendant two MR nathan hall, walking across the pasture. at one point i observed the female bend over and IT appeared she had picked UP something and placed it into the bag. they exited the fence and into the wooded area where myself and deputy doyle made contact with the defendants. inside the burgundy bag i located approximately 11 mushrooms and some bits and pieces of mushrooms. both subjects were placed under arrest. the mushrooms WILL be turned over to evidence. MIRANDA WAS READ TO BOTH DEFENDANT ONE AND DEFENDANT TWO. DEFENDANT ONE, MS SARAH DECUIR STATED THAT SHE HAD NO IDEA THE MUSHROOMS WERE ILLEGAL. DEFENDANT TWO, MR NATHAN HALL, STATED HE HAD DONE MUSHROOMS WHEN HE WAS 16 YEARS OLD AND DID ADMIT TO PICKING THE MUSHROOMS. IT SHOULD BE NOTED THAT I ALLOWED DEFENDANT TWO TO USE HIS CELLULAR TELEPHONE AND WHEN I OPENED THE TELEPHONE TO GIVE IT TO HIM, THE BACKGROUND ON THE CELLULAR TELEPHONE WAS A PICTURE WHICH APPEARED TO HAVE BEEN TAKEN WITH THE CAMERA PHONE OF A PERSON BENDING DOWN AND LOOKING AT SOME PSILOCYBIN MUSHROOMS. i was able to make contact with the landowner and he advised he wished to press charges. therefore, the subjects were ARRESTED AND CHARGED with trespassing and were THEN transpoRted to the citrus county detention facility for booking and processing. THE defendant's bond WAS set at $5500.00 per bond schedule. *NOT-EXEMPT*
