Probable cause affidavit: SUBMITTED BY: STOKES, ERIC 0736 (AR13-6609) (13-100226) ON 072513, I WAS DISPATCHED TO THE LECANTO WAL-MART IN REFERENCE TO A RETAIL THEFT. UPON ARRIVAL, I MADE CONTACT with LOSS PREVENTION OFFICER, BRIAN ELAM, WHO ADVISED THAT HE OBSERVED THE TWO DEFENDANTS ENTER THE STORE AND WALKED TO THE HEALTH AND BEAUTY SECTION. HE ADVISED WHILE THEY WERE IN THAT DEPARTMENT, DEFENDANT KEITH RUNNELS SELECTED INDIVIDUAL BOTTLES OF MAKE-UP AND PLACED THEM INSIDE HIS VEST POCKET. HE ADVISED HE THEN OBSERVED the TWO DEFENDANTS WALK TO THE SPORTING GOODS DEPARTMENT AND HE ADVISED THEY THEN SELECTED FOLDING POCKET KNIVES AND THEN CONTINUED TO THE HARDWARE DEPARTMENT WHERE THEY OPENED THE KNIFE PACKAGES AND CONCEALED THE KNIVES ON their PERSON. HE ADVISED HE THEN FOLLOWED the DEFENDANTS AS THEY EXITED the STORE THROUGH THE GARDEN DEPARTMENT PASSING ALL POINTS OF SALE MAKING NO ATTEMPTS TO PAY FOR THE ITEMS. HE ADVISED HE THEN APPROACHED the TWO DEFENDANTS AND IDENTIFIED HIMSELF AS A LOSS PREVENTION OFFICE FOR WAL-MART AND REQUESTED THAT THEY COME INTO THE LOSS PREVENTION OFFICE WITH HIM. BRIAN ADVISED THAT NATHAN GRABBED HIS BICYCLE AND TOOK OFF AND KEITH WENT FOR HIS BICYCLE. BRIAN ADVISED HE ATTEMPTED TO STOP HIM AND KEITH THEN TOOK OFF ON FOOT. BRIAN ADVISED THAT HE YELLED “IT WOULD BE BETTER FOR YOU GUYS TO COME IN” AND HE ADVISED THEY THEN RETURNED AND FOLLOWED HIM INTO THE LOSS PREVENTION OFFICE. I THEN SPOKE WITH DEFENDANT NATHAN JONES. AFTER BOTH SUBJECTS WERE MIRANDIZED, I ASKED NATHAN IF HE HAD ANY MONEY TO PAY FOR THE ITEMS HE HAD TAKEN AND HE ADVISED HE DID NOT; HOWEVER, HE COULD GET THE MONEY IF IT WAS NECESSARY. I THEN ASKED HIM WHAT HIS REASONING WAS FOR COMING TO WAL-MART TODAY AND HE ADVISED THAT HE INTENDED TO STEAL. I THEN SPOKE WITH DEFENDANT KEITH RUNNELS AND HE ADVISED THAT HE DID NOT HAVE ANY MONEY TO PAY FOR THE ITEMS EITHER AND THAT HE WANTED TO STEAL THE MAKEUP FOR HIS GIRLFRIEND. DEFENDANT RUNNELS WAS ISSUED A NOTICE TO APPEAR, NUMBER 19760, AND DEFENDANT JONES WAS ISSUED A NOTICE TO APPEAR, NUMBER 19761, BOTH FOR RETAIL PETIT THEFT. A WRITTEN STATEMENT WAS COMPLETED BY LOSS PREVENTION OFFICER BRIAN ELAM. A VOIDED RECEIPT WITH THE TOTAL AMOUNT ($67.64) OF THE STOLEN/RECOVERED ITEMS WAS PRINTED OUT AND TURNED INTO RECORDS, ALONG WITH THE WRITTEN STATEMENT. BOTH DEFENDANTS WAS GIVEN A MISDEMEANOR COURT DATE OF 081513 AT 1300 HOURS.
