SUBMITTED BY: CROSNOE, ROBERT 0234 (AR08102633) DID UNLAWFULLY ENTER OR REMAIN IN A CERTAIN DWELLING OR CURTILAGE THEREOF, LOCATED IN THE COUNTY AND STATE AFORESAID, THE PROPERTY OF THE VICTIM, AS OWNER OR CUSTODIAN THEREOF, WITHOUT SAID PERSON'S CONSENT, WITH THE INTENT TO COMMIT AN OFFENSE THEREIN, TO WIT: BREAK WINDOWS AND DOORS, IN VIOLATION OF FLORIDA STATE STATUTES 810.02(1) AND 810.02(3), AND DID UNLAWFULLY, WILLFULLY AND MALICIOUSLY INJURE OR DAMAGE CERTAIN PROPERTY OF THE VICTIM, TO-WIT: BREAK THE WINDOWS AND DOORS, SAID DAMAGE BEING OF A VALUE OF $1,000.00 OR MORE, IN VIOLATION OF FLORIDA STATUTES 806.13(1)(B)3. ON 041008, AT APPROXIMATELY 1339 HOURS, WHILE ON PATROL IN THE CITY OF INVERNESS, I WAS DOING A SECURITY CHECK ON A VACANT RESIDENCE LOCATED AT 503 TOMPKINS STREET. AS I WAS CHECKING THE RESIDENCE, I OBSERVED THE FRONT DOOR AJAR, AT WHICH TIME, I THEN ENTERED THE RESIDENCE TO CONDUCT A SECURITY CHECK WHERE I OBSERVED FOUR DIFFERENT BOOK BAGS SETTING IN THE BACK BEDROOM. I THEN MADE CONTACT WITH MY ZONE PARTNER, DEPUTY HOLTZHOUSE WHO ADVISED ME THAT HE HAD CHECKED THE RESIDENCE AT APPROXIMATELY 1030 HOURS, ON THIS SAME DATE, AND THE RESIDENCE WAS SECURED WITH THE FRONT DOOR LOCKED, and THERE WERE NO SIGNS OF ANY BOOK BAGS OR VANDALISM INSIDE THE RESIDENCE. WHEN I ENTERED THE RESIDENCE, I IMMEDIATELY OBSERVED the DOOR LEADING FROM A GLASSED PORCH AREA INTO THE MAIN RESIDENCE AS BEING TOTALLY BUSTED OFF ITS HINGES AND THERE WERE NUMEROUS WINDOWS WITHIN THE HOUSE, WHICH WERE PREVIOUSLY JUST PAINTED, THAT WERE NOW BROKEN OUT. THERE WAS ALSO NUMEROUS JALOUSIE GLASS WINDOW PANELS FROM THE REAR WINDOWS BROKEN OUT AND SETTING BOTH INSIDE AND OUTSIDE OF THE RESIDENCE. IT SHOULD BE NOTED THAT I AM VERY FAMILIAR WITH THIS RESIDENCE AND CHECK IT QUITE FREQUENTLY, AND IT IS APPARENT THAT THIS VANDALISM OCCURRED ON THIS DATE. AT THAT TIME, I LEFT THE RESIDENCE WHERE I MOVED MY PATROL VEHICLE IN A PLACE WHERE IT COULD NOT BE SEEN, AND I WALKED BACK TO THE RESIDENCE TO AWAIT THE POSSIBLE ARRIVAL OF THE SUSPECT(S). AT APPROXIMATELY 1400 HOURS WHILE SITTING INSIDE THE RESIDENCE, THE FRONT DOOR WAS KICKED OPEN AND FOUR WHITE MALES RAN INSIDE; ONE OF WHO STATED "HURRY AND CLOSE THE DOOR." AT THAT TIME, I STEPPED OUT OF THE KITCHEN AREA AND ORDERED ALL FOUR WHITE MALES TO GET ON THE FLOOR WHERE THEY WERE ALL DETAINED. I ASKED ALL FOUR INDIVIDUALS IF THIS WAS THEIR HOUSE AND ALL FOUR STATED NO. ONCE MY BACK-UP ARRIVED, ALL FOUR INDIVIDUALS WERE SEPARATED. AT THIS TIME, I READ THE DEFENDANT, NATHAN LEGGETT, HIS MIRANDA RIGHTS, VIA PREPRINTED CARD, AND QUESTIONED HIM ON WHAT HAD OCCURRED. MR LEGGETT ADVISED THAT HE AND THE OTHER CO-DEFENDANTS WERE SKIPPING SCHOOL, AND THEY WENT TO THE RESIDENCE LOCATED ON TOMPKINS STREET WHERE ALL FOUR DEFENDANTS ENTERED THE RESIDENCE TO SMOKE SOME MARIJUANA. THE DEFENDANT STATED THAT WHILE THEY WERE INSIDE THE RESIDENCE, DEFENDANT ONE (CODY LONG) OPENED THE DOOR AND AFTER AWHILE, DEFENDANT LEGGETT JUST LEANED UP AGAINST THE DOOR AND THE DOOR BROKE OFF THE HINGES. ALL FOUR DEFENDANTS LEFT THE RESIDENCE AND AFTER AWHILE, THEY SAW SEVERAL COPS DRIVING IN THE NEIGHBORHOOD SO THEY RAN BACK TO THE HOUSE WHERE THEY ONCE AGAIN ENTERED THROUGH THE FRONT DOOR TO RETRIEVE THEIR BELONGINGS. DEFENDANT LEGGETT STATED THIS IS WHEN THEY MADE CONTACT WITH THIS DEPUTY. DEPUTY HOLTZHOUSE CONFIRMED THERE WAS NO DAMAGE TO THE DOORS AND WINDOWS IN THE RESIDENCE WHEN HE CONDUCTED HIS SECURITY CHECK EARLIER IN THE DAY. DEFENDANT LEGGETT WAS THEN PLACED UNDER ARREST, HANDCUFFED BEHIND HIS BACK (DOUBLE LOCKED) AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY BY DEPUTY BRADLEY SMITH.
