Probable cause affidavit: | SUBMITTED BY: LUDLOW, CHRISTOPHER 0214 (AR 14-12650) (14-150784) DID UNLAWFULLY CULTIVATE WITH INTENT TO SELL, MANUFACTURE OR DELIVER OR CAUSE TO BE SOLD, MANUFACTURED OR DELIVERED TO ANOTHER PERSON, A CONTROLLED SUBSTANCE, TO WIT: MARIJUANA, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(1)(A)(2). On November 2, 2014 members of the Tactical Impact vice/narcotics unit WERE CONTACTED by detectives who were on the scene of a disturbance at 11346 South Ann Point in Homosassa Florida. Citrus County Deputies and Detectives responded to this location after receiving reports of a disturbance with possible shots fired. Deputies and Detectives arrived on scene and gathered information from neighbors that the resident who lives at 11346 South Ann Point was looking for two black males who were said to be located underneath of his residence. Deputies and Detectives approached the residence located at 11346 South Ann Point in an attempt to make contact with the resident and check his well being. Deputies and Detectives walked to the rear of the residence and visually observed the skirting pulled down and checked under the residence for possible suspects. During this time Detectives made observations to include smelling the odor of fresh cannabis emitting from the residence in addition to observing potting soil discarded in the woods next to the residence. During this time the defendant Nathaniel Fox was inside the residence communicating with Deputies and Detectives via phone and through the closed door. Nathaniel Fox eventually walked outside and was secured by Detectives on scene. Deputy Perry and I responded to the residence and made the same observations regarding the odor of fresh cannabis emitting from the residence and the discarded potting soil. I then prepared a search warrant for the residence located at 11346 S Ann Point in Homosassa and the search warrant was signed by the Honorable Judge Kautz. Deputy Perry and I responded back to the residence and the search warrant was executed by the Tactical Impact Unit and Community Crimes Detectives. I then read the search warrant aloud to the defendant Nathaniel Fox. At the conclusion of reading the search warrant I read Nathaniel Fox Miranda via SAO card and agreed to speak with me. Nathaniel Fox was visually upset and immediately stated that everything inside belonged to him. I then left Nathaniel Fox in the company of Deputy Settles to gain his composure. I then walked inside the residence which was a single family mobile home and observed Cannabis plants growing throughout the bedrooms and living room. I also observed there to be items such as fluorescent lighting, water, filters, fans, CO2, fertilizer, and extension cords. These items are consistent with items that are typically part of Cannabis grow operations. There was also plastic material that was made into small separate rooms/tents which contained cannabis plants. These small tent/rooms were located in the living room and contained fluorescent lighting and fans. I then returned to Nathaniel Fox (Defendant) and conducted a recorded interview with him regarding the Cannabis grow operation. Post Miranda Defendant Nathaniel Fox admitted to constructing the cannabis grow and indicated he had approximately 10,000 dollars in equipment. Nathaniel Fox indicated that he smokes marijuana and figured he would make extra money selling it. Nathaniel discussed harvest times and details of the profit for selling the product. Defendant indicated that he learned how to grow the cannabis from looking on the internet. Items associated with the grow to include cannabis, light, ballast, paper documents and other miscellaneous items were collected and placed into evidence. The remainder of the items associated with the cannabis grow were destroyed on scene. There was a total of 261 cannabis plants inside the residence. Nathaniel was placed under arrest and transported to the Citrus County Detention facility for processing. THE DEFENDANTâS BOND WAS SET AT $2,000.00 PER THE BOND SCHEDULE.
