SUBMITTED BY: GATER, DAVID 0263 (AR 15-17241) (15-155627) DID UNLAWFULLY ENTER OR REMAIN IN A CERTAIN STRUCTURE OR CURTILAGE THEREOF, TO-WIT: TAMPERING WITH THE ATM MACHINE IN AN ATTEMPT TO REMOVE CASSETTES OF MONEY, LOCATED AT GTE FEDERAL CREDIT UNION LOCATED AT 5700 NORTH SUNCOAST BOULEVARD, CRYSTAL RIVER, IN CITRUS COUNTY, FLORIDA, THE PROPERTY OF GTE FEDERAL CREDIT UNION, WITHOUT SAID PERSON'S CONSENT, WITH THE INTENT TO COMMIT AN OFFENSE THEREIN, TO-WIT: ATTEMPTED GRAND THEFT AND WAS ARMED WITH A SMITH AND WESSON .380 CALIBER PISTOL, IN VIOLATION OF FLORIDA STATUTE 810.02(2)(B). ON 112815, AT APPROXIMATELY 0616 HOURS, A BURGLARY WAS REPORTED AT THE GTE FEDERAL CREDIT UNION LOCATED AT 5700 NORTH SUNCOAST BOULEVARD, CRYSTAL RIVER. AT THE TIME OF THE REPORT, AN UNKNOWN SUBJECT HAD ATTEMPTED TO UNLAWFULLY BREAK IN AND ATTEMPTED TO REMOVE CASH FROM AN ATM MACHINE LOCATED IN THE CURTILAGE OF THE BANK. AT APPROXIMATELY 0900 HOURS, I WAS CONTACTED BY SERGEANT FASS (0361), ROAD PATROL SERGEANT, WHO ADVISED THAT DEPUTIES HAD DETAINED A SUSPECT IN THE PROCESS OF COMMITTING A SIMILAR OFFENCE. THE DEFENDANT WAS DETAINED AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. AT APPROXIMATELY 1100 HOURS, I MADE CONTACT WITH THE SUBJECT, MR NICHOLAS HOLMES, LATER IDENTIFIED AS THE DEFENDANT AT THE CITRUS COUNTY DETENTION FACILITY. I READ THE DEFENDANT MIRANDA RIGHTS VIA PREPRINTED AGENCY CARD AND ASKED IF HE UNDERSTOOD HIS RIGHTS, TO WHICH HE REPLIED THAT HE DID. I THEN ASKED HIM IF HE WISHED TO SPEAK WITH ME AT THIS TIME, TO WHICH HE ADVISED THAT HE WOULD. DURING THE INTERVIEW, THE DEFENDANT CONFESSED TO GOING TO THE GTE FEDERAL CREDIT UNION LOCATED AT 5700 NORTH SUNCOAST BOULEVARD, CRYSTAL RIVER AND ATTEMPTED TO BREAK IN TO THE ATM MACHINE AND REMOVE THE MONEY FROM INSIDE THE MACHINE. THE DEFENDANT ADVISED HE BELIEVED THERE TO BE APPROXIMATELY $40,000.00 IN CASH IN THE MACHINE. THE DEFENDANT ADVISED HE HAD REMOVED A POWER PANEL FROM THE SIDE OF THE BANK IN AN ATTEMPT TO SHUT OFF THE POWER TO THE SECURITY SYSTEM OF THE BANK. THE DEFENDANT ADVISED AS SOON AS HE TURNED OFF THE POWER HE REALIZED THERE WAS A BACK UP GENERATOR AND IT HAD TURNED ON. HE ADVISED AS SOON AS HE REALIZED THE BACK UP GENERATOR HAD TURNED ON THAT THE ALARM SYSTEM WOULD STILL ON HE ADVISED HE FLED FROM THE SCENE EMPTY HANDED. AT THE TIME THE DEFENDANT WAS TAKEN IN TO CUSTODY HE WAS FOUND TO BE IN POSSESSION OF A SMITH AND WESSON .380 CALIBER PISTOL. DURING THE RECORDED INTERVIEW HE ADMITTED TO HAVING THE PISTOL ON HIS PERSON DURING THE TIME OF THE BURGLARY. THE DEFENDANT WAS CHARGED WITH ONE COUNT OF ARMED BURGLARY. DEFENDANTâS BOND WAS SET AT $25,000.00 PER THE BOND SCHEDULE. THE DEFENDANT IS A SUSPECT IN AT LEAST THREE SIMILAR INCIDENTS REFERENCE CITRUS COUNTY SHERIFF'S OFFICE CASE NUMBERS 2015-155602, 2015-153260, AND 2015-155618. |
