SUBMITTED BY: RAMOS, ROBALDO 0515 (17-42637) (AR17-23143) DID UNLAWFULLY AND KNOWINGLY TAKE, OBTAIN OR USE OR ENDEAVOR TO TAKE, OBTAIN OR USE THE PROPERTY OF WAL-MART, TO WIT: MISCELLANEOUS FOOD ITEMS, TOOLS, AND A FLASHLIGHT TOTALING $138.20, CARRYING AWAY THE SAID MERCHANDISE, WITH INTENT TO TEMPORARILY OR PERMANENTLY DEPRIVE, A MERCHANT, OF THE POSSESSION, USE, BENEFIT, OR FULL RETAIL VALUE OF SAID PROPERTY, SAID PROPERTY BEING OF A VALUE OF MORE THAN $100.00 BUT LESS THAN $300.00, IN VIOLATION OF FLORIDA STATE STATUTE 812.014(2)(E). ON 032517, I RESPONDED TO THE WAL-MART LOCATED AT 2461 EAST GULF TO LAKE HIGHWAY, IN INVERNESS, IN REFERENCE TO A PAST PETIT THEFT. UPON ARRIVAL, I MADE CONTACT WITH THE COMPLAINANT, MR JOSEPH COMPOSTELLA, WHO ADVISED HE OBSERVED THE DEFENDANT, MS NICHOLE MANDAT, ON 032217, LOADING UP A SHOPPING CART WITH MISCELLANEOUS HOUSEHOLD GOODS AND TOOLS. WHEN SHE WAS DONE LOADING ITEMS IN THE SHOPPING CART, SHE PROCEEDED TO THE FRONT OF THE STORE THEN HANDED OFF THE SHOPPING CART TO MR JONATHAN DUARTE. MR DUARTE THEN EXITED THE STORE WITH THE SHOPPING CART OF MERCHANDISE PASSING ALL POINTS OF SALE WITHOUT MAKING ANY ATTEMPT TO PAY FOR SAID ITEMS. AFTER READING THE DEFENDANT HER MIRANDA RIGHTS, SHE STATED SHE UNDERSTOOD HER RIGHTS AND STILL WISHED TO SPEAK WITH ME. SHE PROVIDED A SWORN WRITTEN STATEMENT ADVISING SHE WAS INSTRUCTED BY MR DUARTE TO SELECT THE ITEMS IN THE SHOPPING CART THEN HAND THE CART OFF TO HIM AND HE WOULD EXIT THE STORE WITH THEM. THE DEFENDANT ADVISED THAT ONCE SHE HANDED THE SHOPPING CART OFF TO MR DUARTE, HE ADVISED HER TO GO TO THEIR VEHICLE. HE THEN EXITED THE STORE, EMPTIED THE CART INTO THE VEHICLE AND LEFT THE WAL-MART PARKING LOT. THE DEFENDANT WAS THEN PLACED UNDER ARREST FOR ONE COUNT OF RETAIL PETIT THEFT. SHE WAS THEN HANDCUFFED, DOUBLE-LOCKED, BEHIND THE BACK, SEATED AND SECURED IN THE REAR OF MY PATROL VEHICLE THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANT'S BOND WAS SET AT $1,000.00 PER THE BOND SCHEDULE. THE DEFENDANT'S WRITTEN STATEMENT WAS COLLECTED AND LATER TURNED IN TO RECORDS. |
