Probable cause affidavit: SUBMITTED BY: REID, JUSTIN 0706 (AR12-2856) DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: APPROXIMATELY 1938 HYDROCODONE 325 MILLIGRAM TABLETS, 1785 HYDROCODONE 500 MILLIGRAM TABLETS, 35 HYDROCODONE 7.5 - 500 MILLIGRAM TABLETS, AND 65 LORAZEPAM 0.5 MILLIGRAM TABLETS, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HER OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, AND THE PROPERTY WAS ANY AMOUNT OF A CONTROLLED SUBSTANCE, IN VIOLATION OF FLORIDA STATUTE 812.014(2)(C)(13). ON 092112 AT APPROXIMATELY 0838 HOURS, I WAS DISPATCHED TO 6885 SOUTH SUNCOAST BOULEVARD, IN HOMOSASSA, THE WALMART DEPARTMENT STORE, IN REFERENCE TO A THEFT OF PRESCRIPTION MEDICATIONS. UPON MY ARIVAL, I MADE CONTACT WITH THE COMPLAINANT, MS ARELYS LEON, WHO IS THE LOSS PREVENTION DIRECTOR OF WALMART STORE NUMBER 1029. SHE ADVISED THAT SHE HAD DOCUMENTED PROOF THAT THE DEFENDANT, MS NICOLE BUCKLEY, WHO WAS A PHARMACY TECHNICAN AT THE WALMART DEPARTMENT STORE, HAD BEEN STEALING CONTROLLED PRESCRIPTION NARCOTICS FROM THE SHELVES OF THE PHARMACY AND HAD ALSO BEEN INGESTING THEM WHILE ON THE CLOCK. SHE STATED THAT WALMART PERSONELLE BECAME SUSPICOUS OF THESE ACTIVITIES ON 081412, WHEN THE PHARMACY MANAGER, MS THELMA MENDEZ, NOTICED THE DEFENDANT WAS VERY LETHARGIC, HAD SLURRED SPEECH, AND DID NOT APPEAR TO BE HERSELF. THE COMPLAINANT THEN BEGAN AN INTERNAL INVESTIGATION AND DISCOVERED THAT FROM THE TIME THE DEFENDANT STARTED WORKING AT THE NEW WALMART IN APRIL OF 2012, APPROXIMATELY 1938 HYDROCODONE 325 MILLIGRAM TABLETS, 1785 HYDROCODONE 500 MILLIGRAM TABLETS, 35 HYDROCODONE 7.5 - 500 MILLIGRAM TABLETS, AND 65 LORAZEPAM 0.5 MILLIGRAM TABLETS ALL WITH AN UNKNOWN VALUE, WERE MISSING FROM THEIR PHARMACY RECORDED INVENTORY. THE COMPLAINANT PROVIDED ME WITH TWO PRINTOUT SHEETS CONTAINING THE BEGINNING AND ENDING PRESCRIPTION MEDICATION INVENTORY THAT WAS LATER TURNED IN TO RECORDS. SHE ALSO PROVIDED ME WITH STILL PHOTOGRAPHS OF THE DEFENDANT WITH SEVERAL PRESCRIPTION PILLS IN HER HANDS AND STILL PHOTOGRPAHS OF THE DEFENDANT INGESTING THE MEDICATION WHILE WORKING AT THE PHARMACY. SHE ALSO PROVDIED ME WITH A COPY OF VIDEO SURVEILLANCE SHOWING THE DEFENDANT SELECTING VARIOUS PRESCRIPTION BOTTLES OFF OF THE PHARMACY SHELVES, THEN OPENING THE BOTTLES AND THEN PLACING SEVERAL PRESCRIPTION MEDICATIONS FROM WITHIN THOSE BOTTLES INTO THE DEFENDANT’S FRONT LEFT PANTS POCKET. THE STILL PHOTOGRAPHS WERE LATER TURNED IN TO REOCRS AND THE COPY OF THE SURVEILLANCE VIDEO WAS LATER TURNED IN TO EVIDENCE. I THEN MADE CONTACT WITH THE DEFENDNAT AT THE WALMART DEPARTMENT STORE AT APPROXIMATELY 1153 HOURS, THE DEFEDANNT WAS AT THE WALMART DEPARMENT STORE FOR THE INTERNAL INVESTIGATION OF WALMART, AT WHICH TIME, THE DEFENDANT WROTE OUT A SWORN WRITTEN STATEMENT FOR WALMART. UPON MAKING CONTACT WITH THE DEFENDANT, I ASKED HER IF THE STATEMENT SHE WROTE WAS THE TRUTH AND NOTHING BUT THE TRUTH AND IF SHE WAS IN FACT THE PERSON WHO WROTE THE STATEMENT, AT WHICH TIME, SHE RAISED HER RIGHT HAND THAT YES SHE DID WRITE THIS STATEMENT AND EVERYTHING IN IT WAS TRUE AND SHE WROTE THE STATEMENT UNDER HER OWN WILL. I THEN READ THE DEFENDANT HER MIRANDA WARNINGS AT 1230 HOURS, FROM A PREPRINTED AGENCY ISSUED MIRANDA CARD. THE DEFENDANT ADVISED THAT SHE DID INDEED UNDERSTAND HER RIGHTS AND AGREED TO ANSWER ANY QUESTIONS THAT I MAY HAVE. THE DEFENDANT THEN STATED THAT SHE DID IN FACT TAKE AN UNKNOWN AMOUNT OF HYDROCODONE AND SOMA PRESCRIPTION MEDICAITONS FROM THE SHELVES OF THE PHARMACY AND USE THEM FOR HER OWN PERSONAL REASONS. SHE STATED THAT SHE DID NOT HAVE ANY TYPE OF INSURANCE AND COULD NOT AFFORD MEDICATIONS, SO SHE DEICDED TO STEAL THEM FROM HER PLACE OF WORK FOR PAIN MANAGEMENT. SHE SAID SHE FIRST STARTED TAKING THE MEDICATIONS FROM THE PHARMACY SHELVES WHEN THE WALMART OPENED IN APRIL OF 2012. SHE SAID SHE WOULD TAKE HANDFULLS AT A TIME AND PLACE SEVERAL PILLS IN HER POCKET TO TAKE HOME WITH HER TO CONSUME. SHE SAID SHE HAD NO IDEA THE TOTAL AMOUNT OF PILLS THAT SHE TOOK FROM THE PHARMACY, BUT WOULD TAKE SEVERAL HANDFULLS ONCE OR TWICE A WEEK. SHE SAID SHE WOULD ALSO INGEST APPROXIMATELY SIX TO EIGHT PILLS AT ONE TIME WHILE ON THE CLOCK AT WORK. THE DEFENDNAT WENT ON TO STATE THAT SHE KNEW WHAT SHE DID WAS WRONG, BUT BECAME VERY ADICTED TO THE PRESCRIPTION MEDICATIONS AND COULD NOT STOP. THE DEFENDANT WAS ADVISED THAT SHE WAS BEING PLACED UNDER ARREST FOR GRAND THEFT OF PRESCRIPTION MEDICATIONS. SHE WAS THEN HANDCUFFED (DOUBLE LOCKED) BEHIND HER BACK, PLACED IN THE REAR OF MY PATROL VEHICLE AND TRANPSOTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING WHERE HE BOND AMOUNT WAS SET AT $5,000.00 PER THE BOND SCHEDULE. THE COMPLAINANT WAS ISSUED AN AGENCY CASE CARD CONTAINING MY NAME, IDENTIFICATION NUMBER, AND CASE NUMBER AND ADIVSED TO CONTACT ME AT THE SHERIFF’S OFFICE WITH ANY QUESTIONS CONCERNS OR INFORMATION ABOUT THIS CASE.
