| Probable cause affidavit: | Submitted by: FLORIDA FISH AND WILDLIFE CONSERVATION COMMISSION OFFICER (FWC) SEILER, SWAIN (AR15-16145) On august 23, 2015 at approximately 1900 hrs while on patrol, i was driving north on u.s. hwy 19 in the inside lane, just north of dunnellon rd., when a red 4-door car passed my marked patrol vehicle in the same direction at a high rate of speed. My vehicle speed at the time was approximately 64 mph. I accelerated to within approximately 6-8 car lengths of the defendantâs vehicle and maintained that following distance for approximately 2 miles. During that time i observed the defendant change lanes without signaling twice, fail to maintain single lane, and travel at speeds up to 80 mph. The posted speed limit in this area is 60 mph. I initiated a traffic stop as we crossed over the barge canal bridge and upon making contact with the driver, identified by his florida driver license as nolan patrick wissel, (defendant), i detected a strong odor of alcoholic beverage, and observed his eyes to be bloodshot and watery. I instructed the defendant to produce a driver license and a vehicle registration. I advised the defendant that i pulled him over for excessive speed at which time he stated he had no idea what the speed limit was. The defendantâs speech was slow and slurred. At this time based on my training and experience i suspected the defendant was driving under the influence of an alcoholic beverage. I informed the defendant of my suspicion and asked him to exit the vehicle, and upon doing so, i observed him to be unsteady on his feet. I asked the defendant if he had any physical defects or disabilities, or any defects with his eyes. The defendant answered ânoâ to these questions. I checked the defendantâs eyes for horizontal gaze nystagmus and observed the following clues of impairment in both eyes: lack of smooth pursuit Distinct and sustained nystagmus at maximum deviation Onset of nystagmus prior to 45 degrees I then asked the defendant to perform some field sobriety tasks, and he indicated he would comply. For each task the instructions were clearly read from prepared text, and the tasks were demonstrated. The following tasks were then performed by the defendant: Finger-to-nose Walk and turn One leg stand The finger-to-nose task was explained and demonstrated for the defendant, and i observed the following clues of impairment: Did not close eyes Moved head during task Opened eyes during task Hesitated (three times) Missed nose (once) Used other than fingertip (six times) Did not return hand to side (twice) The walk and turn task was explained and demonstrated for the defendant, and i observed the following clues of impairment: Lost balance during instruction Started before told Stopped while walking (twice) Did not touch heel to toe (twelve times) Stepped off the line (five times) Used arms to balance Improper turn Wrong # of steps The one leg stand was explained and demonstrated and i observed the following clues of impairment: Swayed while balancing Used arms to balance Based on my probable cause i placed the defendant under arrest for driving under the influence in violation of fs 316.193(1). I read the implied consent warning to the defendant requesting him to submit to an approved test of his breath to determine his breath alcohol content. The defendant stated that he would submit to the approved test of his breath. I transported the defendant to the citrus county jail where he submitted to an approved test of his breath with the results being .169, and .151. At this time the defendant was issued dui uniform traffic citation #4462-xfb, for driving under the influence, and uniform traffic citation 2152-gvi for violation of traffic control device.
