Probable cause affidavit: SUBMITTED BY: FWC CRANE, RYAN N223 (AR16-21217) did drive or was in the actual physical control of a veSSEL while under the influence of alcoholic beverages, model glue or any substance controlled under Chapter 893 or Chapter 877.111 to the extent HIS normal faculties were impaired, in violation of Florida Statute 327.35(1)(A). On October 5th at approximately 1810 hrs, I, Ofc. Ryan Crane of the Florida Fish and Wildlife Conservation Commission (FWC) was on land patrol with Ofc. Chandler Wells (FWC) when we received a call from dispatch reporting a boating accident in the area of Rutland on the Withlacoochee River. We arrived on scene at 1915 hrs at 13503 Shawnee Trail in Inverness. I made contact with the resident at the address (Kenneth Jay Lacey, DOB 4-21-65). Lacey informed me that he was in his back yard when he heard an airboat approaching his part of the river and then a loud crash. He observed a blue airboat (FL-9006HT) in an inverted position up against a tree. He was able to take a vessel over to the accident site and found a white male (Norman William Anderson, FL-ID-A536-639-61-260-0) sitting by himself in his airboat seat. Lacey was able to bring Anderson back to his property until help arrived. I made contact with the Citrus County Sheriff Deputy on scene and he advised me the subject attempted to hide from him under Lacey’s house but was cooperative. I made contact with Anderson and I asked him if he had any injuries and he said no. I asked him where he was coming from on his airboat and he said “The Damn Pub”. I asked him to describe the accident and he said he “never would hurt anyone” and became confused with what I had asked him. I asked again to describe the accident and he said he was going too fast and missed his turn. I asked him if he was alone on his boat and he said “yes”. I asked him if he had anything to drink since the accident and he said “no”. Throughout my interaction with Anderson he slurred his speech, mumbled words, and lost his train of thought easily. He displayed glassy, bloodshot eyes, and appeared disheveled. I asked Anderson to walk with me to the front of the residence and he had difficulty maintaining his balance and stumbled several times. At this point based on my probable cause I determined that Anderson had been operating his vessel while impaired. I asked Anderson if he would consent to field sobriety tasks to which he answered “yes”. \tI asked Anderson to take a comfortable seated position on the tailgate of Ofc. Wells patrol truck. I read the sobriety tasks from prepared text and demonstrated each task for Anderson. I observed the following indicators of impairment: \tHorizontal Gaze Nystagmus: Moved head three times contrary to directions. Lack of smooth pursuit in both the left and right eye. Distinct & sustained nystagmus at max deviation in left and right eye. Onset of nystagmus prior to 45 degrees in both left and right eye. Finger to nose: Started at wrong time. Did not tilt head. Moved head during task five times. Wrong hand one time. Hesitated one time. Missed nose twice (bridge of nose) Did not bring down hands to his side five times, he kept them outstretched during entire task Palm Pat: Did not increase speed. Did not perform task properly, did not turn hand over at all and continued in a clapping motion. Hand Coordination: Improper touch, just rolled fists. Seven claps instead of three. Did not return to memorized position. Did not count during task three. Improper touch of task three, just rolled his hands At this point I asked Anderson to stand and I found a solid level part of the driveway in order to complete the one leg stand. One Leg Stand: Continuously swayed while standing during instructions. At the count of four thousand he used his arm to balance, put foot down, stumbled to his side and then nearly fell down. I asked Anderson to continue the task he made one more attempt and used his arm to balance, put foot down, and nearly fell down again at the count of two thousand. Anderson made no more attempts at this task. At this point based on my probable cause I placed Anderson under arrest for boating while impaired. Anderson was handcuffed and double locked and placed into a Citrus County Sheriff Deputy patrol car for transport to Citrus County Jail. Anderson was read his applied consent at the jail and refused to give a lawful test of his breath. Anderson was charged with operating a vessel while impaired in violation of State Statute 327.35(1)(a). Anderson was also cited for careless operation in violation of Coast Guard Navigational Rule 8, action to avoid collision. TYPED BY OFFICER RYAN CRANE (FWC).
