| Probable cause affidavit: | submitted by: cridland, todd 0277 (AR09106974AR) knowingly fail to register with the department of HIGHWAY safety and motor vehicles within 48 hours, by failing to obtain the proper sex offender designation on his driver's license, in violation of florida state statute 943.0435(4)(A). on 010109, at APPROXIMATELY 0923 hours, i responded to 8240 west edgehill court, crystal river, in reference to a sex offender check. upon my arrival, i made contact with mr normand briggs (defendant). mr briggs is a registered sex offender and had registered on 112508. as part of his registration, IT IS REQUIRED THAT 48 hours after the initial registration, he must report in person to the department of highway safety and motor vehicles to obtain a valid driver's license or identification card displaying 943.0435(f)(s). i asked mr briggs if i could see his identification, at which time he handed me his florida driver's license which did not bear the designation. i then asked mr briggs why he did not have it done, and he stated he did not know about It. mr briggs was then questioned about when he registered and if he had seen the paperwork, at which time he stated yes, but he did not know about it. mr briggs was then placed under arrest and transported to the citrus county detention facility WHERE his bond was set at $2,000.00 per the bond schedule. it should be noted that mr briggs was re-registered ONCE at the detention facility, at which time he refused to take a printed copy of the registration. it should be noted that on page five of six, it explains the part of getting designation on the driver's license. it also states that failure to comply with any of the requirements is a felony of the third degree. a copy of mr briggs' driver's license and the registration were turned in to records. *NOT-EXEMPT* |
