SUBMITTED BY: MATOS, THOMAS 0675 (AR12-2730) DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: FIVE ALPRAZOLAM ONE MILLIGRAM TABLETS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). ON 091312, I RESPONDED TO A CALL AT 6027 SOUTH SUNCOAST BOULEVARD, IN REFERENCE TO POSSIBLE SICK INDIVIDUALS IN A VEHICLE. UPON ARRIVAL, I NOTICED A RED SEDAN OFF THE SIDE of the ROAD WITH THE DRIVERâS SIDE DOOR OPEN. K-9 DEPUTY VIGGIANO AND I APPROACHED THE VEHICLE WITH CAUTION AND NOTICED TWO INDIVIDUALS SLUMPED OVER TOWARDS THE CENTER OF THE VEHICLE. WE ANNOUNCED OUR PRESENCE AND BOTH INDIVIDUALS BEGAN TO SLOWLY AWAKEN. THE SUBJECT IN THE DRIVERâS SIDE WAS LATER IDENTIFIED AS DEFENDANT ONE, MS PAMELA DICKS. THE SUBJECT ON THE PASSENGER SIDE WAS LATER IDENTIFIED AS DEFENDANT TWO, MR EVERETT DICKS. BOTH DEFENDANTS ADVISED THAT THEY WERE SLEEPY AND DECIDED TO PULL OVER TO GET SOME REST. IT SHOULD BE NOTED THAT BOTH DEFENDANTS EXHIBITED SLURRED speech, GLASSY EYES, AND SLOW DELIBERATE MOVEMENTS. MR DICKS HAD TROUBLE KEEPING HIS BALANCE WHEN STANDING UP. BOTH MR AND MS DICKS CONSENTED TO A SEARCH OF THEIR PERSON AND PROPERTY. K-9 DEPUTY VIGGIANO LOCATED A PILL BOTTLE ON MR DICKS THAT WAS PRESCRIBED TO HIM FOR METHADONE 10 MILLIGRAM (MG) TABLETS, HOWEVER, ALONG WITH THE METHADONE TABLETS K-9 DEPUTY VIGGIANO LOCATED TWO UNKNOWN PILLS IN THE BOTTLE, LATER IDENTIFIED BY POISON CONTROL TO BE ALPRAZOLAM ONE MG. UPON SEARCHING MS DICKSâ PURSE, WHICH SHE HANDED TO ME FROM THE VEHICLE, A PRESCRIPTION PILL BOTTLE, BEARING THE NAME NICHOLAS GRIZZLE, WAS FOUND. THE PRESCRIPTION WAS FOR OMEPRAZOLE. MS DICKS ADVISED THAT NICHOLAS GRIZZLE WAS HER SON. ALONG WITH THE PRESCRIBED MEDICATION THERE WAS A CELLOPHANE WRAPPER INSIDE THAT BOTTLE WHICH CONTAINED FIVE PILLS WITH THE SAME MARKING AS THE PILLS THAT MR DICKS HAD, ALPRAZOLAM ONE MG. AT THAT TIME, BOTH SUBJECTS WERE READ MIRANDA FROM A PREPRINTED AGENCY CARD. MS DICKS ADVISED THAT THE PILLS WERE NOT HERS, THAT THEY WERE HER HUSBANDSâ. MR DICKS ADVISED THAT THEY WERE HIS PILLS, HOWEVER, HE DID NOT HAVE A PRESCRIPTION FOR THEM. AT THAT TIME, BOTH DEFENDANTS WERE PLACED UNDER ARREST FOR POSSESSION OF A CONTROLLED SUBSTANCE (SCHEDULE FOUR), PLACED IN HANDCUFFS (DOUBLE LOCKED) BEHIND THEIR BACKS, AND PLACED IN THE REAR SEAT OF MY PATROL VEHICLE FOR TRANSPORT TO COUNTY DETENTION FACILITY, WHERE BOND WAS SET AT $5,000.00 EACH AS PER THE BOND SCHEDULE. |
