Probable cause affidavit: |
SUBMITTED BY: MACIAS, JOSEPH 0756 (AR13-6485) DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: OVER $8,000.00 IN CASH OVER THE LAST TWO YEARS OF THE VALUE OF THREE HUNDRED DOLLARS ($300.00) OR MORE, BUT LESS THAN TWENTY THOUSAND DOLLARS ($20,000.00), WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATUTES 812.014. ON 071713, AT APPROXIMATELY 1722 HOURS, I WAS DISPATCHED TO THE FLORAL CITY FIRE DEPARTMENT LOCATED AT 7880 EAST SPANISH TRAIL IN FLORAL CITY, IN REFERENCE TO A THEFT THAT HAD ALREADY OCCURRED. UPON ARRIVAL, I MADE CONTACT WITH THE COMPLAINANT, MS STACIE BESSLER, WHO IS THE PRESIDENT OF THE FLORAL CITY VOLUNTEER FIRE FIGHTERS. THE COMPLAINANT STATED THAT DURING THE LAST MEETING THEY HAD VOTED IN A NEW TREASURER AND UPON GOING TO THE DEFENDANTâS, MS PANSEY CLEAVELAND, RESIDENCE TO PICK UP THE TREASURY BOOKS, THE DEFENDANT ALSO GAVE THEM A LETTER OF CONFESSION, WHICH STATED THAT SHE HAD USED MONEY FROM THE FLORAL CITY VOLUNTEER FIREFIGHTERS BANK ACCOUNT AND HAD TAKEN $8,075.68 OVER THE LAST TWO YEARS. AT THAT TIME, THE VICTIM MET WITH THE MEMBERS OF THE FLORAL CITY VOLUNTEER FIREFIGHTERS AND DECIDED TO CALL THE CITRUS COUNTY SHERIFF'S OFFICE. SHE STATED THAT HER NEW TREASURER AND MEMBERS OF THE BOARD WILL BE DOING AN INVESTIGATION AND PUTTING TOGETHER AN EXACT AMOUNT WHICH THEY WILL TURN INTO THE STATE ATTORNEY'S OFFICE. SHE PROVIDED ME WITH A COPY OF THE CONFESSION LETTER FROM THE DEFENDANT. AT THAT TIME, I MADE CONTACT WITH THE DEFENDANT AT 7450 SOUTH ROY TERRACE IN FLORAL CITY. THE DEFENDANT STATED THAT SHE HAD TAKEN THE MONEY DUE TO HER GRANDCHILD BEING SICK AND FOR GAS FOR DOCTOR TRIPS. THE DEFENDANT STATED THAT SHE DID NOT HAVE PERMISSION TO USE THE MONEY FOR HER OWN PERSONAL USE. THE DEFENDANT FILLED OUT A SWORN WRITTEN STATEMENT THAT WAS COLLECTED AND WILL LATER BE TURNED IN TO RECORDS. THE DEFENDANT WAS PLACED UNDER ARREST, HANDCUFFED, (DOUBLE LOCKED), BEHIND HER BACK, SECURED IN THE REAR OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING, WHERE THE DEFENDANT'S BOND WAS SET AT $2,000.00, PER THE BOND SCHEDULE. THE COMPLAINANT WAS ISSUED AN AGENCY CASE CARD CONTAINING MY NAME AND CASE NUMBER AND WAS ADVISED TO CONTACT THE STATE ATTORNEY'S OFFICE IN REFERENCE TO FURTHER INFORMATION. |
