Probable cause affidavit: | SUBMITTED BY: BAIRD, MATTHEW 0624 (AR13-7338) DID UNLAWFULLY AND MALICIOUSLY PUNISH THE JUVENILE VICTIM T.H. , A PERSON UNDER THE AGE OF EIGHTEEN (18) YEARS, DATE OF BIRTH: 04/40/2001, BY HOLDING A LIT CIGARETTE AGAINST HIS BARE SKIN CAUSING MULTIPLE BURNS, IN VIOLATION OF FLORIDA STATUTE 827.03(2)(A); ON 091113 THIS AGENCY RECEIVED A REPORT CONCERNING ALLEGATIONS OF CHILD ABUSE. THE COMPLAINANT, MS SNYDER, ADVISED THAT SHE HAD TURNED BOTH VICTIMS OVER TO THE CUSTODY OF THEIR FATHER, JAMES HUGGINS, ON 090813 AND HAD TAKEN THEM BACK INTO HER CUSTODY ON 091113. MS SNYDER ADVISED THAT UPON THE VICTIMS RETURNING TO HER RESIDENCE SHE HAD GIVEN THEM A BATH AT WHICH TIME VICTIM T.H. HAD BEGUN TO CRY. MS SNYDER OBSERVED A WOUND UNDER THE RIGHT ARM OF VICTIM T.H. AT WHICH TIME HE STATED âTIMMY HURT MEâ. SEVERAL OTHER WOUNDS WERE OBSERVED ON T.H. AT THAT TIME BY MS SNYDER. SHORTLY AFTER DISCOVERING THE WOUNDS ON T.H., A WOUND WAS DISCOVERED ON THE RIGHT HIP OF VICTIM A.H. VICTIM A.H. STATED THIS WOUND WAS FROM UNCLE TIMMYâS CIGARETTE. THE DEPARTMENT OF CHILDREN AND FAMILIES AND THE CITRUS COUNTY SHERIFFâS OFFICE WERE NOTIFIED AND RESPONDED TO MS SNYDERâS RESIDENCE. THE INCIDENT WAS DOCUMENTED AND THE INJURIES PHOTOGRAPHED. A MEDICAL EXAM AND FORENSIC INTER WERE SCHEDULED WITH THE CHILD PROTECTION TEAM FOR 091313. BOTH VICTIMS WERE TRANSPORTED BY MS SNYDER TO SEVEN RIVERS HOSPITAL FOR TREATMENT. THE CHILD PROTECTION TEAM MEDICAL EXAM REVEALED A ROUND .6 CM BURN ON THE RIGHT HIP OF A.H. ACCORDING TO CHILD PROTECTION TEAM MEDICAL STAFF THIS WOUND IS CONSISTENT WITH A BURN FROM A CIGARETTE. DURING THE CHILD PROTECTION TEAM FORENSIC INTERVIEW A.H. STATED THAT âUNCLE TIMMYâ HAD BURNED HIM WITH A CIGARETTE. A.H. ALSO MADE THE SAME STATEMENT TO CPT MEDICAL STAFF. HE ALSO ADVISED THAT âUNCLE TIMMYâ WAS MAD AT THE TIME. A.H. STATED THAT âUNCLE TIMMYâSâ GIRLFRIEND âTRISHâ HAD BURNED T.H. MORE THAN ONE TIME WITH A CIGARETTE. T.H. WAS FOUND TO HAVE SEVERAL WOUNDS CONSISTENT WITH CIGARETTE BURNS DURING HIS EXAM. A FORENSIC INTERVIEW WAS NOT CONDUCTED WITH T.H. DUE TO HIS AGE. THE CHILD PROTECTION TEAM MEDICAL EXAMINATION OF T.H. REVEALED AT LEAST SIX SEPARATE WOUNDS CONSISTENT WITH BURNS FROM A CIGARETTE. THREE WOUNDS WERE LOCATED UNDERNEATH THE RIGHT ARM, ONE .8 CM ROUND WOUND ON HIS RIGHT SHOULDER, AND ONE .7 CM ROUND WOUND ON HIS LEFT BUTTOCK. THE NUMBER OF THESE WOUNDS IS CONSISTENT WITH THE STATEMENT MADE BY A.H. THAT âTRISHâ HAD BURNED T.H. WITH A CIGARETTE MORE THAN ONE TIME. MS. SNYDER DID CONFIRM THAT WHILE THE VICTIMS WERE IN THE CARE OF THEIR FATHER, JAMES HUGGINS, HE HAD LEFT THEM IN THE CUSTODY OF THE DEFENDANTS TIMOTHY HUGGINS AND PATRICIA BAKER. A.H. DID STATE TO THIS DETECTIVE THAT âUNCLE TIMMYâ AND âTRISHâ WERE RESPONSIBLE FOR THE BURNS SUSTAINED BY HIM AND T.H. HE ALSO ADVISED THE INCIDENT HAD OCCURRED IN HOMOSASSA. ON 091813, CONTACT WAS MADE WITH JAMES HUGGINS IN REFERENCE TO THIS CASE. MR HUGGINS CONFIRMED THAT THE VICTIMâS WERE LEFT IN THE CARE OF THE DEFENDANTS WHILE THEY HAD BEEN IN HIS CUSTODY FROM 090813 TO 091113. CONTACT WAS ALSO MADE WITH THE DEFENDANTS, TIMOTHY HUGGINS AND PATRICIA BAKER, IN REFERENCE TO THIS CASE. BOTH DEFENDANTS DID DENY THE ALLEGATIONS AND WERE THEN PLACED UNDER ARREST, HANDCUFFED (DOUBLE LOCKED BEHIND THEIR BACK) AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. MS BAKERâS BOND WAS SET AT $20,000.00 PER THE BOND SCHEDULE. UPON ARRIVAL AT THE CITRUS COUNTY DETENTION FACILITY MS BAKER WAS READ HER MIRANDA RIGHTS AND REQUESTED AN ATTORNEY. MS BAKER WAS TURNED OVER TO JAIL STAFF FOR BOOKING AND PROCESSING. |
