SUBMITTED BY: VICK, BRYAN 0684 (AR10117933) did, knowing HIS driver's license or driving privilege had been cancelled, suspended or revoked AS A HABITUAL TRAFFIC OFFENDER, drive a motor vehicle upon the highways of this state while such license or privilege was cancelled, in violation of Florida Statute 322.34(5) ON 111510, WHILE ON PATROL IN the AREA OF WEST GROVER CLEVELAND, I OBSERVED A GREEN CHEVROLET CAMARO BEARING TAG 465WQV. AN NCIC/FCIC CHECK REVEALED that the REGISTERED OWNER HAD A SUSPENDED DRIVER'S LICENSE. I CONTINUED FOLLOWING THAT VEHICLE UNTIL IT CAME TO A STOP IN A DRIVEWAY AT THE INTERSECTION OF MISTFLOWER AND MICHIGAN. I OBSERVED A WHITE MALE GET OUT OF THE DRIVER'S SIDE. I MADE CONTACT with THE DRIVER/DEFENDANT, WHO PROVIDED ME WITH A NAME AND ADVISED THAT THE VEHICLE DID NOT BELONG TO HIM AND THAT IT BELONGED TO the PASSENGER. IT SHOULD BE NOTED, that AT NO TIME WERE MY OVERHEAD LIGHTS ACTIVATED DURING this CONSENSUAL ENCOUNTER. I ASKED THE DRIVER/DEFENDANT, MR PATRICK FAILLA, IF HE HAD A VALID DRIVER'S LICENSE TO WHICH HE REPLIED, NO. AN NCIC/FCIC CHECK OF THE DEFENDANT REVEALED HIS LICENSE WAS SUSPENDED FOR FIVE YEARS AS OF FEBRUARY 2008 and THAT HE WAS HABITUAL TRAFFIC OFFENDER. THE DEFENDANT WAS THEN PLACED UNDER ARREST, HANDCUFFED (DOUBLE-LOCKED) BEHIND HIS BACK AND SECURED IN the REAR SEAT OF MY PATROL VEHICLE. THE WITNESS ADVISED THAT HE DID NOT know ANYONE AT THE RESIDENCE THAT THE VEHICLE WAS CURRENTLY PARKED IN, AND THAT THE DEFENDANT PULLED INTO THE DRIVEWAY QUICKLY IN ATTEMPT TO EVADE THIS DEPUTY. I MADE CONTACT with the HOMEOWNER AT THAT RESIDENCE WHO ADVISED THAT THE VEHICLE COULD BE LEFT ON HER PROPERTY. THE DEFENDANT WAS ISSUED A UNIFORM TRAFFIC CITATION, CITATION NUMBER 3163GJX, WITH A MANDATORY COURT APPEARANCE OF 120210 AT 1300 HOURS. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANT'S BOND WAS SET AT $2,000.00, PER THE BOND SCHEDULE.
