Probable cause affidavit: SUBMITTED BY: CLARK, CORRY 0711 (AR12124608) DID UNLAWFULLY AND KNOWINGLY TAKE, OBTAIN OR USE OR ENDEAVOR TO TAKE, OBTAIN OR USE THE PROPERTY OF BEALL'S DEPARTMENT STORE, TO WIT: FOUR PAIRS OF UNDER GARMENTS, BY CARRYING AWAY THE SAID MERCHANDISE, WITH INTENT TO TEMPORARILY OR PERMANENTLY DEPRIVE, A MERCHANT, OF THE POSSESSION, USE, BENEFIT, OR FULL RETAIL VALUE OF SAID PROPERTY, SAID PROPERTY BEING OF A VALUE OF LESS THAN $300.00, IN VIOLATION OF FLORIDA STATE STATUTES 812.015, 812.014(1), AND 812.014(3)(A). ON 013112, AT APPROXIMATELY 1457 HOURS, I RESPONDED TO 2851 EAST GULF TO LAKE HIGHWAY IN INVERNESS, TO THE BEALL'S DEPARTMENT STORE, IN REFERENCE TO A SHOPLIFTER IN CUSTODY. UPON MY ARRIVAL I MADE CONTACT WITH MR CHAD WHITLER, WHO IS THE LOSS PREVENTION OFFICER FOR BEALL'S. HE ADVISED THAT AT APPROXIMATELY 1430 HOURS, HE OBSERVED THE DEFENDANT, MS PEGGY WOOD, ENTER INTO THE STORE WITH HER BOYFRIEND, WHERE MR WHITLER WAS ADVISED BY OTHER STORE EMPLOYEES, TO KEEP AN EYE ON THESE TWO SUBJECTS, DUE TO THEM RETURNING TO THE STORE FREQUENTLY. HE THEN ADVISED WHILE IN THE LOSS PREVENTION OFFICE HE WAS WATCHING SURVEILLANCE VIDEO WHERE HE OBSERVED THE DEFENDANT SELECT FOUR UNDER GARMENTS, ALONG WITH OTHER CLOTHING AND THEN ENTER INTO A FITTING ROOM. UPON THE DEFENDANT EXITING THE FITTING ROOM, MR WHITLER ADVISED THAT THE UNDER GARMENTS WERE MISSING. HE ADVISED THAT AT THAT TIME HE WENT INTO THE FITTING ROOM THE DEFENDANT HAD BEEN USING; HOWEVER, WAS UNABLE TO LOCATE THE ITEMS. HE STATED THAT THE DEFENDANT PURCHASED SOME OTHER ITEMS, AND THEN EXITED THE STORE WITHOUT PAYING FOR THE UNDER GARMENTS. MR WHITLER CONFRONTED THE DEFENDANT OUTSIDE OF THE STORE AND UPON CONFRONTATION THE DEFENDANT WILLINGLY WENT INTO THE LOSS PREVENTION OFFICE WITH MR WHITLER AND ADMITTED TO STEALING THE ITEMS. AT THAT TIME THE DEFENDANT REMOVED THE ITEMS FROM HER PURSE. I THEN MADE CONTACT WITH THE DEFENDANT WHERE SHE WAS READ MIRANDA VIA PREPRINTED MIRANDA CARD. SHE STATED SHE WOULD SPEAK WITH ME. I ASKED THE DEFENDANT IF SHE HAD STOLEN THE ITEMS WHICH SHE WAS ACCUSED OF, AND SHE STATED, YES. I ASKED THE DEFENDANT IF SHE HAD THE INTENT ON STEALING THE ITEMS PRIOR TO ARRIVING AT THE STORE, AT WHICH TIME SHE STATED, NO, ADVISING THAT IT WAS A SPUR OF THE MOMENT DECISION. I ASKED THE DEFENDANT IF SHE HAD EVER BEEN ARRESTED BEFORE AND SHE STATED, NO. I ASKED THE DEFENDANT IF SHE HAD EVER STOLEN FROM BEALL'S BEFORE, TO WHICH SHE STATED, NO NOT THIS ONE, BUT THE ONE IN OCALA BETWEEN A YEAR AND A YEAR AND A HALF AGO. HOWEVER, SHE COULD NOT RECALL WHAT SHE HAD STOLEN. AT THAT TIME THE DEFENDANT WAS PLACED UNDER ARREST FOR RETAIL THEFT. SHE WAS HANDCUFFED, DOUBLE LOCKED. MR WHITLER PROVIDED ME WITH A SWORN WRITTEN STATEMENT, A BEALL'S RECEIPT FOR THE CLOTHING ITEMS WHICH TOTALED $21.20. THE STATEMENT AND RECEIPT WERE COLLECTED AND LATER TURNED OVER TO RECORDS. HE ALSO PROVIDED ME WITH A PHOTOGRAPH OF THE FOUR UNDER GARMENTS AND STORE SURVEILLANCE DVD WHICH WERE COLLECTED AND TURNED OVER TO SHERIFF'S OFFICE EVIDENCE. I PROVIDED MR WHITLER WITH A CASE CARD BEARING THIS CASE NUMBER. THE DEFENDANT WAS TRANSPORTED TO CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANT'S BOND WAS SET AT $250.00 PER THE BOND SCHEDULE. .
