\tSUBMITTED BY: HORTON, TIMOTHY 0614 (AR13-8169) \tdid, knowing HIS driver's license or driving privilege had been cancelled, suspended or revoked, drive a motor vehicle upon the highways of this state while such license or privilege was cancelled, in violation of Florida Statute 322.34(2). \t \tON 113013, AT APPROXIMATELY 0921 HOURS, I WAS PARKED IN the GRASS LOCATED JUST SOUTH OF THE INTERSECTION OF NORTH SUNCOAST BOULEVARD AND WEST ASHBURN LANE IN CRYSTAL RIVER CONDUCTING TRAFFIC ENFORCEMENT. I WAS WORKING STATIONARY RADAR WITH MY MARKED PATROL UNIT FACING IN A SOUTHBOUND DIRECTION ALONG THE SIDE OF the ROAD. AT THAT TIME, I OBSERVED A 2004, BEIGE DODGE PICKUP TRAVELLING NORTHBOUND IN the INSIDE TRAFFIC LANE OF NORTH SUNCOAST BOULEVARD. I VISUALLY ESTIMATED the VEHICLEâS SPEED TO BE APPROXIMATELY 58 MILES PER HOUR (MPH) IN A POSTED SPEED ZONE OF 45 MPH. AT THAT TIME, I ACTIVATED MY RADAR UNIT, WHICH IS A STALKER DSR UNIT, FRONT ANTENNA, BEARING SERIAL NUMBER DS30655, WHICH GAVE ME A HIGH DOPPLER TONE AND A VISUAL READING THAT THE VEHICLE WAS TRAVELLING AT 59 MPH. AT THAT TIME, ONCE THE VEHICLE PASSED MY POSITION, I INITIATED A TRAFFIC STOP ON the VEHICLE NEVER LOSING VISUAL SIGHT. \t \tTHE VEHICLE PULLED OVER AT LARUE-DENISE AND NORTH SUNCOAST BOULEVARD, WHERE I MADE CONTACT WITH THE DEFENDANT, WHO IDENTIFIED HIMSELF BY HIS FLORIDA DRIVERâS LICENSE AS MR PHILIP JOSEPH MCCROSSAN. \t \tI INFORMED THE DEFENDANT THE REASON I HAD STOPPED HIM WAS FOR HIS UNLAWFUL SPEED. HE IMMEDIATELY ADVISED ME THAT HIS DRIVERâS LICENSE WAS SUSPENDED FOR DRIVING UNDER THE INFLUENCE, WHICH HAD OCCURRED IN PASCO COUNTY. \t \tAT THAT TIME I CONDUCTED A COMPUTER CHECK AND DISCOVERED THAT THE DEFENDANTâS DRIVERâS LICENSE WAS REVOKED AS OF 03012011 FOR DRIVING UNDER the INFLUENCE. I ALSO DISCOVERED THAT THERE WERE OTHER SUSPENSIONS, WHICH ARE AS FOLLOWS: 060412 FOR FAIL TO COMPLETE SUBSTANCE ABUSE TREATMENT, 082912 FOR FAIL TO COMPLETE COURT ORDERED SCHOOL, AND ON 042112 FOR âFRâ SUSPENSION. \t \tI THEN RE-CONTACTED THE DEFENDANT AND HE ADVISED HE WAS ON HIS WAY TO SEE FAMILY AND that HE KNEW HE SHOULD NOT HAVE BEEN DRIVING. AT THAT TIME, I ASKED THE DEFENDANT TO EXIT THE VEHICLE and TO WALK BACK TO THE FRONT OF MY PATROL CAR. I INFORMED HIM THAT DUE TO HIS KNOWLEDGE OF HIS DRIVERâS LICENSE BEING SUSPENDED/REVOKED AND THE FACT IT WAS SUSPENDED/REVOKED FOR DRIVING UNDER THE INFLUENCE (DUI) THAT HE would BE PLACED UNDER ARREST. THE DEFENDANT WAS HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK AND SECURED IN the REAR OF MY PATROL VEHICLE. \t \tTHE DEFENDANTâS VEHICLE WAS TURNED OVER TO the OWNER, MS ASHLEE MINKS. \t \tTHE DEFENDANT WAS THEN TRANSPORTED TO the CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANT WAS CHARGED WITH ONE COUNT DRIVING WHILE LICENSE SUSPENDED/REVOKED FOR DUI. THE DEFENDANTâS TOTAL BOND WAS SET AT $10,000.00, PER THE BOND SCHEDULE. \t \tTHE DEFENDANT WAS ISSUED THE FOLLOWING CITATIONS: 7711-HBH7 FOR UNLAWFUL SPEED, WITH A FINE OF $206.00 PAYABLE WITHIN 30 DAYS. \t \tTHE DEFENDANT WAS ISSUED CRIMINAL CITATION NUMBER 7712-HBH8, FOR DRIVING ON A SUSPENDED/REVOKED DRIVERâS LICENSE FOR DUI, with A MANDATORY COURT APPEARANCE SET FOR 010914 AT 1300 HOURS AT THE CITRUS COUNTY COURTHOUSE. THE DEFENDANT WAS ALSO ISSUED CRIMINAL CITATION NUMBER 7713-HBH9, FOR EXPIRED âCDLâ MORE THAN 30 DAYS, WITH A MANDATORY COURT APPEARANCE SET AT 010914 AT 1300 HOURS, AT the CITRUS COUNTY COURTHOUSE. |
