Probable cause affidavit: | SUBMITTED BY: POLLARD, RANDALL 0677 (AR11122482) did knowingly, willfully and feloniously be in the actual or constructive possession of a controlled substance, to-wit: THE DEFENDANT DID HAVE IN HIS POSSESSION A 5 MILLIGRAM METHADONE PILL, in violation of Florida Statutes 893.13(6)(A). ON 082811 I OBSERVED A WHITE MALE WALKING WESTBOUND ON MAIN STREET IN THE AREA OF TROUT AVENUE IN INVERNESS. AT THAT TIME I CHECKED OUT with THAT SUBJECT ON A CONSENSUAL ENCOUNTER. I ASKED the SUBJECT IF I COULD I SPEAK WITH HIM AND SEE ANY FORM OF IDENTIFICATION. AT that TIME DEPUTY LAMBERT ARRIVED ON SCENE WHERE I ASKED DEPUTY LAMBERT IF HE COULD STAY WITH THE SUBJECT WHILE I RAN THE SUBJECT FOR WANTS AND WARRANTS. DEPUTY LAMBERT DID ADVISE THE SUBJECT NOW IDENTIFIED AS THE DEFENDANT, PHILLIP ALLISON, THAT HE WAS FREE TO GO AT ANY TIME SINCE HE WAS WALKING TO WORK. MR ALLISON STATED THAT HE WAS FINE AND ALLOWED MYSELF AND DEPUTY LAMBERT TO SEARCH THE BACKPACK HE WAS CARRYING AND HIS BELONGINGS. MR ALLISON STATED THAT HE had NOTHING TO HIDE AND CONSENTED TO THE SEARCH. WHILE SEARCHING IN THE DEFENDANT'S BACKPACK, DEPUTY LAMBERT FOUND A PRESCRIPTION PILL BOTTLE WITH THE LABEL PEELED OFF INSIDE A A LEFT FOOT TENNIS SHOE. INSIDE THE PILL BOTTLE WAS ONE WHITE PILL. I ASKED THE DEFENDANT IF HE HAD A PRESCRIPTION FOR THE PILL INSIDE THE PILL BOTTLE. THE DEFENDANT THEN STATED TO MYSELF AND DEPUTY LAMBERT THAT HE THOUGHT IT WAS JUST ASPIRIN AND THAT HE HAS NO PRESCRIPTION. AT THAT TIME I CALLED POISON CONTROL WHO IDENTIFIED THE PILL BY ITS MARKINGS AS A 5 MILLIGRAM METHADONE PILL, which IS A SCHEDULED TWO NARCOTIC. THE DEFENDANT WAS THEN PLACED UNDER ARREST FOR POSSESSION OF A CONTROLLED SUBSTANCE AND READ HIS MIRANDA RIGHTS VIA PRE-PRINTED CARD. WHILE IN THE BACK SEAT OF MY PATROL VEHICLE THE DEFENDANT STATED THAT HE GOT THE PILL FROM A FRIEND, HOWEVER, WOULD NOT GIVE THE NAME OF THE FRIEND. HE ALSO STATED THAT HE KNEW BETTER THAN TO HAVE THAT ON HIM AND HE WAS TAKING THE PILL FOR PAIN PURPOSES. THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING WHERE HIS BOND WAS SET AT $2,000.00 PER THE BOND SCHEDULE. THE METHADONE PILL WAS SEIZED AND WILL BE PLACED IN TO EVIDENCE AT THE CITRUS COUNTY SHERIFF'S OFFICE OPERATIONS CENTER BY DEPUTY LAMBERT.
