submitted by: SANCHEZ, MICHAEL 1242 (AR16-20955)(16-126078) DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: ONE TEN MILLIGRAM OXYCODONE PILL WAS LOCATED BETWEEN THE DRIVER SEAT AND THE CENTER CONSOLE OF THE VEHICLE, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). DID DRIVE A MOTOR VEHICLE UPON A HIGHWAY IN THE STATE OF FLORIDA WITHOUT HAVING A VALID DRIVER'S LICENSE AUTHORIZING HIM TO DO SO, IN VIOLATION OF FLORIDA STATE STATUTE NUMBER 322.03(1). ON 091316, AT APPROXIMATELY 1730 HOURS, I WAS CONDUCTING TRAFFIC ENFORCEMENT IN THE AREA OF BEVERLY HILLS BOULEVARD AND DESOTO STREET WHERE I OBSERVED A WHITE IN COLOR FOUR-DOOR BUICK. UPON RUNNING THE LICENSE PLATE OF THAT VEHICLE IT CAME BACK THAT THAT LICENSE PLATE WAS EXPIRED AND HAD BEEN EXPIRED SINCE 012916. AT THAT TIME, I CONDUCTED A TRAFFIC STOP ON THAT VEHICLE WHERE WE WERE THEN AT the INTERSECTION OF NORTH HARRISON STREET AND ESSKAY STREET. I made CONTACT with THE DRIVER, LATER IDENTIFIED AS THE DEFENDANT, MR RALPH SCHMIDIHEINI. UPON MAKING CONTACT with THE DEFENDANT AND ASKING FOR HIS DRIVER'S LICENSE, REGISTRATION, AND PROOF OF INSURANCE HE ADVISED HE DID NOT have A DRIVER'S LICENSE. AT THAT TIME, I ASKED the DEFENDANT TO STEP OUT OF THE VEHICLE WHERE HE WAS HANDCUFFED (DOUBLE LOCKED), SEARCHED AND SEATED IN the REAR OF MY PATROL VEHICLE. AT THAT TIME, I RAN HIS FLORIDA IDENTIFICATION CARD NUMBER WHICH SHOWED IT WAS ONLY A VALID IDENTIFICATION CARD, AND HE DID NOT HAVE A VALID DRIVER'S LICENSE. A SHORT TIME LATER DEPUTY INDORATO (0712) ARRIVED ON SCENE AND CONDUCTED AN EXTERIOR SNIFF OF THE VEHICLE WITH HIS CANINE PARTNER REPO. DEPUTY INDORATO ADVISED THERE WAS A POSITIVE ALERT ON THE VEHICLE. AT THAT TIME, WE BEGAN TO SEARCH THE INTERIOR OF THE VEHICLE. BETWEEN THE DRIVER SEAT AND THE CENTER CONSOLE I LOCATED A WHITE PILL THAT HAD THE IMPRINT âA333â ON THE FRONT AND WAS OBLONG IN SHAPE. I THEN ENTERED THAT PILL INTO A PILL IDENTIFIER WHERE IT CAME BACK AS TEN MILLIGRAM OXYCODONE, WHICH THE DEFENDANT DID NOT have A PRESCRIPTION FOR. WHILE GATHERING THE VEHICLE INFORMATION I NOTICED THE DECAL THAT WAS ON the LICENSE PLATE DID NOT MATCH THE DECAL THAT WAS ASSIGNED TO THE LICENSE PLATE. AT THAT TIME, I RAN THAT SECOND DECAL NUMBER WHERE THAT DECAL SHOULD HAVE APPEARED ON A FLORIDA LICENSE PLATE K814YR, WHICH CAME BACK TO A 1998 PONTIAC STATION WAGON WHITE IN COLOR. THE DEFENDANT WAS ISSUED TWO FLORIDA UNIFORM TRAFFIC CITATIONS, CITATION NUMBER A1P2YBP, FOR DRIVING with NO DRIVER'S LICENSE. THE SECOND CITATION, NUMBER A1P2YDP, FOR ALTERED LICENSE PLATE OR DECAL. THE DEFENDANT WAS THEN TRANSPORTED to the CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANT'S BOND WAS SET AT $2,000.00 FOR POSSESSION OF A CONTROLLED SUBSTANCE AND $500.00 FOR OPERATING A VEHICLE WITHOUT A VALID DRIVER'S LICENSE. THE DEFENDANTâS TOTAL BOND WAS SET AT $2,500.00, PER THE BOND SCHEDULE. |
