Probable cause affidavit: SUBMITTED BY: CANFIELD, LAIRD 0544 (AR13-6713) (13-103661) DID DRIVE OR WAS IN ACTUAL PHYSICAL CONTROL OF A VEHICLE WHILE UNDER THE INFLUENCE OF AN ALCOHOLIC BEVERAGE, MODEL GLUE OR ANY SUBSTANCE CONTROLLED UNDER CHAPTER 893 OR CHAPTER 877.111 TO THE EXTENT HIS NORMAL FACULTIES WERE IMPAIRED, IN VIOLATION OF FLORIDA STATE STATUTE 316.193; AND THE DRIVER OF ANY VEHICLE INVOLVED IN A CRASH RESULTING ONLY IN DAMAGE TO A VEHICLE OR OTHER PROPERTY DRIVEN OR ATTENDED BY ANY PERSON, SHALL IMMEDIATELY STOP SUCH VEHICLE AT THE SCENE OF SUCH CRASH OR AS CLOSE THERETO AS POSSIBLE, AND SHALL, FORTHWITH RETURN TO AND IN EVERY EVENT SHALL REMAIN AT THE SCENE OF THE CRASH UNTIL HE HAD FULFILLED THE REQUIREMENTS OF 316.062; AND DID REFUSED TO SUBMIT TO A CHEMICAL OR PHYSICAL TEST OF HIS OR HER BREATH, BLOOD, OR URINE, AS DESCRIBED IN FLORIDA STATE STATUTE 316.1932 AND WHOSE DRIVING PRIVILEGE WAS PREVIOUSLY SUSPENDED FOR A PRIOR REFUSAL TO SUBMIT TO A LAWFUL TEST OF HIS OR HER BREATH, BLOOD, OR URINE. \tdid, knowing HIS driver's license or driving privilege had been cancelled, suspended or revoked, drive a motor vehicle upon the highways of this state while such license or privilege was cancelled, in violation of Florida Statute 322.34(2)(a). ON 080113 AT 1911 HOURS, I WAS DISPATCHED TO 4015 EAST LAKE PARK DRIVE IN HERNANDO IN REFERENCE TO A TRAFFIC CRASH. PRIOR TO MY ARRIVAL, DEPUTY B VICK ADVISED ME THAT THE DEFENDANT HAD BEEN INVOLVED IN A CRASH, HIS DRIVER’S LICENSE WAS SUSPENDED, AND HE WAS DRIVING UNDER THE INFLUENCE. DEPUTY B VICK ALSO ADVISED OFFICER CHARETTE (AN OFF-DUTY WILDWOOD POLICE OFFICER) had witnessed the defendant driving and made contact with the defendant. deputy b vick stated officer charette advised the defendant had been driving erratic, he was staggering, his speech was slurred, and his eyes were glassy and bloodshot. deputy b vick also noted the same observations as officer charette. upon my arrival at 1926 hours, i observed fresh skid marks in the dirt road that stopped just before a large tree, then other tire marks that lead to the defendant’s vehicle, which was parked in the carport area of the residence. i observed the vehicle was a blue ford two-door, bearing georgia tag azr3137, with damage on the right rear bumper, right rear fender, and under the rear bumper area. i photographed the damage, see crime scene technician (cst) report. i next responded to the intersection of east carl g rose highway and east lake park drive. i observed skid marks leading from the southbound lane of east carl g rose highway to a culvert/ditch just south of east lake park drive. i then observed acceleration marks leading away from the ditch to a line of trees. the acceleration marks then headed north and i observed where the vehicle had struck some small trees. i then observed the acceleration marks cross east lake park drive. i then observed the ACCELERATION marks continue eastbound in the grass/westbound lane of east lake park drive. i photographed this area, see cst report. i next responded to a location on east carl g rose highway near east sapphire lane. i observed skid/yaw marks leading from the southbound lane into the grass. i then observed the lower portion of a road sign leaning to the south. i next observed the upper portion of the sign, a “do not pass” sign laying face up in the grass. i next observed a small black foam piece that appeared to be part of a bumper with “ford” stamped into it in the grass. i next observed tire marks and tire impressions in the grass/dirt. i photographed this area, see cst report. i next responded to the citrus county detention facility to make contact with the defendant. upon arrival, i made contact with the defendant and observed his eyes were glassy and watery and his speech was slurred and thick tongued. i then read the defendant his miranda warnings via an agency pre-printed card. at that time, the defendant became agitated and uncooperative and stated he did not wish to speak with me. correctional officer bowermaster informed me the defendant refused to submit to a test of his breath and provided the paperwork, which was later turned in to records. the defendant was issued driving under the influence (dui) citation number 7275xga, for driving under the influence; uniform traffic citation number 7380wkb, for driving while license suspended with knowledge; uniform traffic citation number 7381wkb, for refusal to submit to a blood alcohol level test; uniform traffic citation number 7379wkb, for leaving the scene of a crash with property damage, and uniform traffic citation number 7383wkb for leaving the scene of a crash, all with a mandatory court date to be set by the judge.
