SUBMITTED BY: BLAIR, EDWARD 0469 (AR07100670) DID UNLAWFULLY AND KNOWINGLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: COCAINE, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A) AND DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: COCAINE, SAID OBJECT BEING A METAL PIPE, IN VIOLATION OF FLORIDA STATE STATUTES 893.145 AND 893.147(1) AND DID DRIVE A MOTOR VEHICLE UPON A HIGHWAY IN THE STATE OF FLORIDA WITHOUT HAVING A VALID DRIVER'S LICENSE AUTHORIZING HIM TO DO SO, IN VIOLATION OF FLORIDA STATE STATUTE NUMBER 322.03(1). ON 120707 AT APPROXIMATELY 2343 HOURS WHILE CONDUCTING TRAFFIC ENFORCEMENT, THIS DEPUTY OBSERVED A MAROON BUICK FOUR DOOR VEHICLE TRAVEL SOUTH ON NORTH CARLEEN DRIVE, AT WHICH TIME THE VEHICLE TURNED EAST ON WEST BALLOON LANE. THIS DEPUTY OBSERVED THE VEHICLE TRAVEL SOUTH ON TO WEST TURKEY OAK LANE, AT WHICH TIME THIS DEPUTY RAN THE VEHICLE'S TAG THROUGH THE DEPARTMENT OF HIGHWAY SAFETY AND MOTOR VEHICLE (DHSMV,) YIELDING THE INFORMATION THAT THE TAG WAS EXPIRED AS OF 100707. THIS DEPUTY INITIATED A TRAFFIC STOP AT THE INTERSECTION OF STATE ROAD 44. UPON ACTIVATING MY EMERGENCY LIGHTS, THE VEHICLE CONTINUED TO TRAVEL WEST ON STATE ROAD 44 AT A SLOW PACE. THIS DEPUTY CONTINUED TO FOLLOW THE VEHICLE WHICH THEN TURNED ONTO WEST CRYSTAL STREET, CONTINUING TO DRIVE AT A SLOW PACE. THE VEHICLE CAME TO REST, AT WHICH TIME I EXITED MY PATROL VEHICLE AND APPROACHED THE DRIVER SIDE DOOR. THIS DEPUTY OBSERVED THE DEFENDANT, LATER IDENTIFIED AS MR RAYMOND BROOKS, JUNIOR, TO BE CONCEALING HIS HANDS WITHIN THE COMPARTMENT. THIS DEPUTY INSTRUCTED THE DRIVER/DEFENDANT TO SHOW HIS HANDS, AT WHICH TIME THE DEFENDANT HESITATED AND THEN SLOWLY OPENED THE DOOR. THE DEFENDANT WAS ASKED FOR HIS DRIVER'S LICENSE AND REGISTRATION, AT WHICH TIME HE STATED HE DID NOT HAVE HIS DRIVER'S LICENSE. HE STATED IT WAS VALID. DUE TO SAFETY CONCERNS, THE DEFENDANT WAS ASKED TO EXIT THE VEHICLE, TO WHICH HE COMPLIED. THIS DEPUTY RESPONDED TO MY PATROL VEHICLE, AT WHICH TIME I CONDUCTED A DRIVER'S LICENSE CHECK WHICH SHOWED THE DEFENDANT TO HAVE A FLORIDA IDENTIFICATION CARD ONLY. THE DEFENDANT WAS CONFRONTED WITH THIS INFORMATION, AT WHICH TIME HE ADMITTED THAT HE DID NOT HAVE A VALID DRIVER'S LICENSE. THE DEFENDANT WAS ADVISED HE WAS BEING PLACED UNDER ARREST FOR NO VALID DRIVER'S LICENSE. THE DEFENDANT WAS SEARCHED INCIDENT TO ARREST WHICH YIELDED A BROKEN "305" MENTHOL CIGARETTE AS WELL AS MISCELLANEOUS COINS AND CASH ON HIS PERSON. HE WAS HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK AND ASKED IF THERE WAS ANYTHING ILLEGAL IN HIS VEHICLE. THE DEFENDANT STATED NO. THE DEFENDANT WAS SEATED IN THE REAR SEAT OF MY PATROL VEHICLE. WITNESS ONE WAS ASKED TO EXIT THE VEHICLE, AT WHICH TIME HE COMPLIED. WITNESS ONE WAS ASKED IF THERE WAS ANY ILLEGAL CONTRABAND WITHIN THE VEHICLE, TO WHICH HE STATED HE DID NOT KNOW. HOWEVER, WITNESS ONE ADDED THAT THE DEFENDANT HAD ATTEMPTED TO CONCEAL AN UNKNOWN ITEM WHILE STILL SEATED IN THE VEHICLE. WITNESS ONE FURTHER ADDED THAT HE HAD GOTTEN A RIDE FROM THE DEFENDANT TO GO GET CIGARETTES. WITNESS ONE STATED THAT WHILE EN ROUTE TO BUY CIGARETTES, THE DEFENDANT STOPPED AT A RESIDENCE ON NORTH CARLEEN DRIVE ONLY TO EXIT THE RESIDENCE A FEW MINUTES LATER AND DRIVE AWAY. A SEARCH OF THE VEHICLE INCIDENT TO ARREST YIELDED A GREEN "305" MENTHOL CIGARETTE PACKAGE ON THE DRIVER'S SEAT, NEAR THE CENTER CONSOLE. THIS DEPUTY OBSERVED THE CIGARETTE PACK TO BE OPEN WITH A METAL OBJECT PROTRUDING FROM THE OPENING, IN PLAIN VIEW. A SEARCH OF THE CIGARETTE PACKAGE YIELDED A BURNT METAL PIPE, COMMONLY USED TO SMOKE CRACK COCAINE, AS WELL AS SEVERAL PIECES OF A HARD WHITE SUBSTANCE CONSISTENT WITH THAT OF CRACK COCAINE. IT SHOULD BE NOTED THAT A FIELD TEST OF THE SUBSTANCE YIELDED A POSITIVE RESULT FOR CRACK COCAINE WITH AN APPROXIMATE WIGHT OF 1.0 GRAMS. A FURTHER SEARCH OF THE VEHICLE WAS MET WITH NO OTHER CONTRABAND BEING LOCATED. THE COCAINE, METAL PIPE, MENTHOL CIGARETTE AND THE "305" CIGARETTE PACKAGE WERE COLLECTED AND LATER TURNED IN TO EVIDENCE. THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. UPON ARRIVAL, THE DEFENDANT WAS ISSUED UNIFORM TRAFFIC CITATION NUMBER 8780-FGW, FOR NO VALID DRIVER'S LICENSE. THE DEFENDANT'S TOTAL BOND WAS SET AT $5,650.00, PER THE BOND SCHEDULE. *NOT-EXEMPT* |
