DEFENDANT DID UNLAWFULLY ENTER OR REMAIN IN A CERTAIN CONVEYANCE, TO-WIT: THE VICTIM’S VEHICLE, WITHOUT SAID PERSON'S CONSENT, WITH THE INTENT TO COMMIT AN OFFENSE THEREIN, TO-WIT: THEFT OF THE VICTIM’S PROPERTY, TO WIT: ONE DIGITAL CAMERA AND $15.00 IN CASH, AND THE SAID CONVEYANCE WAS NOT OPEN TO THE PUBLIC AT THE TIME, AND THE DEFENDANT WAS NOT LICENSED OR INVITED TO ENTER OR REMAIN IN SAID CONVEYANCE, IN VIOLATION OF FLORIDA STATUTE, 810.02(4)(B). DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: OF THE VALUE OF $100.00 OR MORE BUT LESS THAN $300.00, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, AND THE PROPERTY WAS TAKEN FROM A DWELLING OR FROM THE UNENCLOSED CURTILAGE OF A DWELLING, IN VIOLATION OF FLORIDA STATUTE, 812.014((2)(D). ON 061514, DEPUTY JOHNSON (0178) RESPONDED TO 48 NORTH AZALEA TERRACE IN INVERNESS, IN REFERENCE TO A BURGLARY THAT HAD ALREADY OCCURRED. UPON ARRIVAL DEPUTY JOHNSON MADE CONTACT WITH THE VICTIM, MR RALPH MACKINNON, WHO ADVISED THAT HE WAS AWAKENED AT APPROXIMATELY 0730 HOURS ON THIS DATE BY A NEIGHBOR WHO ADVISED THAT THEY FOUND HIS WALLET IN THE ROADWAY NORTH OF HIS RESIDENCE. THE VICTIM ADVISED HE THEN CHECKED IN HIS CAR, WHICH WAS PARKED INSIDE THE GARAGE. AT THAT TIME, HE DISCOVERED THAT HE HAD ACCIDENTALLY LEFT HIS GARAGE DOOR OPEN OVER NIGHT AND THAT AN UNKNOWN PERSON(S) HAD STOLEN THE WALLET OUT OF HIS CAR, ALONG WITH A PANASONIC DIGITAL CAMERA. UPON CHECKING FURTHER, THE VICTIM ADVISED THAT A FIRE EXTINGUISHER HAD BEEN PULLED FROM THE WALL INSIDE THE GARAGE AND CASH HAD BEEN REMOVED FROM A SECOND WALLET WHICH WAS IN A DRESSER INSIDE THE GARAGE. THE VICTIM ADVISED THAT HE HAD APPROXIMATELY $15.00 IN THE WALLET IN HIS CAR, AND APPROXIMATELY $130.00 IN THE WALLET IN THE DRESSER. THE VICTIM also found that he was missing a bottle of wine and some gardening gloves IN THE GARAGE. AFTER GATHERING INFORMATION FROM THE VICTIM, deputy johnson BEGAN A NEIGHBORHOOD CANVASS. AT 76 NORTH AZALEA TERRACE, DEPUTY JOHNSON OBSERVED FIRE EXTINGUISHER POWDER SPRAYED ON A VEHICLE PARKED IN THE DRIVEWAY AT THAT LOCATION. deputy johnson then MADE CONTACT WITH THE OWNER OF THE VEHICLE, mr SHAWN KOCINSKI, WHO ADVISED THAT HE DID NOT SEE OR HEAR ANYTHING DURING THE NIGHT. MR KOCINSKI'S CAR WAS NOT DAMAGED AND HE DID NOT WISH TO HAVE A REPORT TAKEN. EARLIER IN deputy johnson’s SHIFT, PRIOR TO RECEIVING THE BURGLARY CALL, HE RESpONDED TO 5390 East TANGELO LANE IN REFERENCE TO GARBAGE AND POWDER BEING DUMPED ONTO VEHICLES PARKED IN FRONT OF THE RESIDENCE, HOWEVER, THE VEHICLES WERE NOT DAMAGED. THE GARBAgE WAS PICKED UP AND REMOVED AND THE VICTIM DID NOT WISH TO HAVE A REPORT taken. deputy johnson LOCATED THE FIRE EXTINGUISHER IN A WOODED LOT JUST WEST OF 5330 EAST TANGELO LANE, WHICH HE COLLECTED AND TURNED IN TO EVIDENCE. deputy johnson advised that A PERSON OF INTEREST IN THIS CASE MAY POSSIBLY BE mr RAYMOND PILETTE, who resides at 5235 EAST TANGELO LANE IN INVERNESS. on 061914 at approximately 1245 hourS, deputy johNson and i responded to suspect raymond piletteS’ residence in reference to this case. UPON ARRIVAL, i made contact with the suspect in his front yard. i advised him that i was investigating this case, along with several criminal MISCHIEF INCIDENTS that took place. the suspect at that time admitted to dumping trash on a vehicle. i then asked the suspect about SPRAYING the vehicle with a fire EXTINGUISHER and he also admitted to spraying the FIRE EXTINGUISHER. after the suspect stated THAT he useD the fire EXTINGUISHER, he would not state where he got it from. i then advised the suspect that the fire EXTINGUISHER he useD was reported stolen. i then advised him THAT i was looking for a digital camera, and approximately $15.00 in cash which was taken from the victim’s car which was parked inside his garage. i FURTHER advised the suspect that the victim was also missing $130.00 from a dresser inside of his garage and a bottle of wine. at that time, the suspect sTATED that he had the digital camera and went inside his residence to get the camera. THE SUSPECT RETRIEVED THE CAMERA and turned it over to this detective. the suspect would not admit to entering the VICTIM’S garage or THE VICTIM’S vehicle, and STATED that he obtained the items from other friends of his. i then made contact with the other friends of the suspect, WHO both deniED knowing anything about the suspect OR this case. the suspect was at that time advised that he was going to be placeD under arrest for one count of burglary to a RESIDENCE; one count of burglary to a CONVEYANCE, and one count of grand theft. miranda warning was read to the defendant VIA A PRE-PRINTED AGENCY CARD. THE DEFENDANT was then transported to the citrus county DETENTION CENTER where his bond was set at a total of $12,000.00 PER THE ABOVE LISTED CHARGES.
