| Probable cause affidavit: | SUBMITTED BY: MOORE, ANDREW 619 (AR08101935) DID DRIVE OR WAS IN ACTUAL PHYSICAL CONTROL OF A VEHICLE WHILE UNDER THE INFLUENCE OF AN ALCOHOLIC BEVERAGE, MODEL GLUE OR ANY SUBSTANCE CONTROLLED UNDER CHAPTER 893 OR CHAPTER 877.111 TO THE EXTENT HIS/HER NORMAL FACULTIES WERE IMPAIRED, IN VIOLATION OF FLORIDA STATE STATUTE 316.193 (1)(A). On 022708 I was dispatched to 92 WEST CYPRESS BOULEVARD in Homosassa in refERENCE to backing up a deputy that was on an off duty detail. Upon arrival, I made contact with DEPUTY SEFFERN who advised that he witnessed the defendant turn off of US Hwy 19 in to the exit of WEST Cypress BOULEVARD. Upon getting behind the defendants vehicle, DEPUTY Seffern observed the passenger of the vehicle to be throwing beer bottles out of the window and the tag TO HAVE been expired since October 2007. DepUTY Seffern initiated the traffic stop at 92 WEST Cypress BOULEVARD. DepUTY Seffern advised that he could smell a strong odor of an alcoholic beverage from, on, or about the defendant's person at which time, he requested another deputy. DEPUTY Seffern then requested that the defendant exit the vehicle and come back and speak with DepUTY Seffern and myself. At which time I observed the defendant to exit the vehicle. Upon walking back to speak, the defendant was swaying side to side, and upon speaking, THIS DEPUTY DID OBSERVE her speech was slurred. The defendant was asked if she had been drinking tonight. She stated that she had two beers and one bloody mary. The defendant was asked if she had been arrestED for driving under the influence (DUI) before to which she stated "YES back when I was TWENTY". The defendant then was asked if she had any mental or physical disabilities that would not allow her to perform Roadside Sobriety Tasks. The defendant stated that she was able to perform the tasks and that she would complete them. DepUTY Seffern then performed the Roadside Sobriety Tasks. Task One, One Leg Stand. The task was Explained and demonstrated to the defendant. The defendant had to have the task explained several times. The defendant failed to keep her arms to her side and did not stare at the tip of her right toe. The defendant swayed back and forth. The defendant did count to THIRTY. Task Two, Finger to Nose. The task was Explained and demonstrated to the defendant. The defendant would not listen to DepUTY Seffern and was laughing through out the task. On all of the attempts the defendant touched the bridge of her nose and asked if a sober person could perform these tasks. Task Three, Walk and Turn. The task was Explained and demonstrated to the defendant. While performing the task the defendant did not touch her heel to her toe and did not count out loud. The DEFENDANT was explained the task again. The defendant performed the task the same AS BEFORE AND fell off the line four times. IT WAS At that time, this deputy placed the defendant under arrest for driving under the influence, handcuffed (double locked) behind her back and secured in the rear of my patrol vehicle. The defendant was transported to Citrus County Detention Facility FOR BOOKING AND PROCESSING. Upon arrival to the detention Facility, the defendant was read implied consent. The defendant agreed to submit to the approved test of her breath with the test results being .131 and .128 The defendant was issued a written warning number 205695B for Disregarded of a Control Device. The defendant was issued a Uniform Traffic Citation for expired tag less then SIX months and a dui citation number 7192-xdo. The defendants bond was set at $1000.00 PER THE BOND SCHEDULE DUE to it being her second dui. *NOT-EXEMPT_ |
