SUBMITTED BY: AGUILERA, EMANUEL 1238 (AR16-17880) (16-3139)\t DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: CRYSTAL METHAMPHETAMINE, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). ON 010716 AT APPROXIMATELY 2012 HOURS, I RESPONDED TO THE AREA OF J P COURT AND WEST GREENFIELD TERRACE, IN REFERENCE TO BACKING UP K-9 DEPUTY LABORDA ON A TRAFFIC STOP. UPON ARRIVAL, DEPUTY LABORDA ADVISED THAT HE HAD WALKED HIS CANINE PARTNER GUNNY AROUND THE EXTERIOR OF THE VEHICLE. HE ADVISED HIS CANINE PARTNER HAD ALERTED TO THE VEHICLE AND THAT HE WAS going TO CONDUCT A HAND SEARCH OF THE INTERIOR OF THE VEHICLE. AT THAT TIME, HE ASKED THIS DEPUTY TO STAY WITH THE DRIVER, LATER IDENTIFIED as the DEFENDANT, MR RICHARD CANFIELD, AT THE FRONT OF HIS PATROL VEHICLE, AS WELL AS THE WITNESS, MR SHAWN WATERS, WHO WAS A PASSENGER INSIDE THE VEHICLE, ALSO AT THE FRONT OF HIS PATROL VEHICLE. DURING DEPUTY LABORDA'S HANDS SEARCH OF THE VEHICLE, HE ADVISED THIS DEPUTY THAT HE HAD LOCATED A CRYSTAL LIKE SUBSTANCE THAT THROUGH HIS TRAINING AND EXPERIENCE BELIEVED TO BE CRYSTAL METHAMPHETAMINE INSIDE A BUD LIGHT CAN. WHEN I ASKED the DEFENDANT WHO THE CRYSTAL LIKE SUBSTANCE BELONGED TO, HE ADVISED IT BELONGED TO HIM. AT THAT TIME, I READ the DEFENDANT HIS MIRANDA RIGHTS FROM A PREPRINTED CARD, TO WHICH HE ADVISED HE WOULD SPEAK WITH ME. I ASKED HIM WHAT THE CRYSTAL LIKE SUBSTANCE WAS, TO WHICH HE ADVISED IT WAS CRYSTAL METHAMPHETAMINE. I ASKED HIM HOW MUCH WAS IN THE BAGGIE, TO WHICH HE ADVISED IT WAS APPROXIMATELY $10.00 WORTH. I ASKED HIM HOW LONG HE HAD BEEN USING CRYSTAL METHAMPHETAMINE, TO WHICH HE ADVISED HE DOES NOT USE IT OFTEN, HOWEVER, HE WAS IN PAIN FROM JUST HAVING A HIP REPLACEMENT AND THAT WAS THE REASON HE WAS USING IT. DEPUTY LABORDA TESTED the CRYSTAL LIKE SUBSTANCE, WHICH TESTED POSITIVE FOR CRYSTAL METHAMPHETAMINE. I ADVISED THE DEFENDANT HE WAS BEING PLACED UNDER ARREST FOR POSSESSION OF A CONTROLLED SUBSTANCE. HE WAS HANDCUFFED (DOUBLE LOCKED), SEARCHED AND THEN SECURED IN THE REAR SEAT OF MY PATROL VEHICLE. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WHERE HE WAS TURNED OVER TO DETENTION STAFF. THE DEFENDANT'S VEHICLE WAS LEFT ON SCENE PER HIS REQUEST FOR A FAMILY MEMBER TO PICK UP. DEPUTY LABORDA ISSUED THE DEFENDANT A WRITTEN WARNING, NUMBER 395955B, FOR RUNNING A STOP SIGN AT MEADOW and BAMA. THE DEFENDANT'S BOND WAS SET AT $2,000.00 PER the BOND SCHEDULE. |
