Date of birth: Dec 7, 1956
Probable cause affidavit: SUBMITTED BY: RAMOS, ROBALDO 0515 (AR931) THE DEFENDANT, MR RICHARD E VAN ETTEN, DID WILLINGLY ATTACH TO A MOTOR VEHICLE OR MOTOR HOME, A REGISTRATION LICENSE PLATE, VALIDATION STICKER OR MOBILE HOME STICKER, TO WHICH SAID ITEM WAS NOT ASSIGNED OR LAWFULLY TRANSFERRED, TO WIT: A LICENSE PLATE NOT REGISTERED TO THE VEHICLE TO WHICH IT WAS ATTACHED, IN VIOLATION OF FLORIDA STATE STATUTE 320.261. THE DEFENDANT, MR RICHARD E VAN ETTEN, DID, KNOWING HIS/her DRIVER’S LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(2)(A). ON 042812 I RESPONDED NEAR THE INTERSECTION OF TURNER CAMP ROAD AND HOWARD STREET, TO ASSIST DEPUTY WILSON WITH A TRAFFIC STOP. UPON MY ARRIVAL, I MADE CONTACT WITH DEPUTY WILSON, WHO ADVISED this deputy THAT HE HAD RAN THE TAG ATTACHED TO A 1988 WHITE CHEVROLET PICKUP TRUCK, DRIVEN BY THE DEFENDANT, LATER IDENTIFIED AS MR RICHARD E VAN ETTEN. DEPUTY WILSON ADVISED THAT THE TAG HAD COME BACK TO A 1995 WHITE CHEVROLET PICKUP. DEPUTY WILSON ALSO NOTED THAT TAG WAS REGISTERED TO A DRIVER, also identified as the defendant, WHOSE LICENSE HAD BEEN SUSPENDED TO DRIVING UNDER THE INFLUENCE. DEPUTY WILSON WAS ABLE TO IDENTIFY THE DRIVER AS MATCHING THE PHOTOGRAPH ON D.A.V.I.D., AFTER CONDUCTING A TRAFFIC STOP ON THE VEHICLE. DEPUTY WILSON ADVISED THAT the DEFENDANT STATED THAT HE HAD PLACED HIS TAG ON, “HIS BUDDY’S TRUCK,” WHICH HE WAS DRIVING TO GO TO THE STORE, AND THAT HE WAS AWARE THAT HIS LICENSE HAD BEEN SUSPENDED. I THEN PLACED THE DEFENDANT UNDER ARREST FOR DRIVING WHILE LICENSE SUSPENDED OR REVOKED FOR DRIVING UNDER THE INFLUENCE, AND FOR ATTACHING A TAG NOT ASSIGNED TO THE BEARING VEHICLE. THE DEFENDANT WAS HANDCUFFED, DOUBLE LOCKED BEHIND HIS BACK, AND PLACED IN THE REAR OF MY PATROL VEHICLE. I THEN TRANSPORTED THE DEFENDANT TO THE CITRUS COUNTY DETENTION FACILITY, WHERE HE WAS RELEASED TO DETENTION FACILITY STAFF FOR BOOKING AND PROCESSING tHE TAG WHICH WAS ATTACHED WAS REMOVED AND TAKEN INTO EVIDENCE. THIS VEHICLE WAS LEFT ON THE SIDE OF the ROADway FOR THE OWNER TO RETRIEVE IT. THE DEFENDANT WAS given TWO TRAFFIC CITATIONS, THE FIRST BEARING BEING FLORIDA UNIFORM TRAFFIC CITATION NUMBER 5689GQF8, FOR DRIVING WHILE LICENSE SUSPENDED OR REVOKED FOR DRIVING UNDER THE INFLUENCE KNOWINGLY, AND THE SECOND BEING FLORIDA UNIFORM TRAFFIC CITATION, bearing NUMBER 5690GQF1, FOR ATTACHING A TAG NOT ASSIGNED . THE DEFENDANT WAS GIVEN A COURT DATE OF 051712 AT 1300 HORUS AT THE CITRUS COUNTY COURTHOUSE IN INVERNESS. THE DEFENDANT’S BOND WAS SET AT $10,250.00, PER THE BOND SCHEDULE.
