| Commentaries: | Comments According to Official documents. Kirkham was found guilty by Jury verdict on 2-15-2006 for the following crimes: Assault 3rd Degree-Domestic Violence, Assault 2nd Degree-Domestic Violence, Rape 3rd Degree-Domestic Violence, Malicious Mischief 2nd Degree, Assault 3rd Degree, Tampering with a Witness-Domestic Violence, Attempted Escape 3rd Degree and Violation of a Domestic Violence Protection Order. For these crimes he was given a term of 75 months in prison. Kirkham threatened, intimidated and physically assaulted his 21 year old girlfriend. Kirkham broke the victim's nose during one assault. The victim was again assaulted by Kirkham on another occasion in which he hit her with a bamboo stick on her legs and arms. Kirkham established boundaries within the residence as to where his victim could or could not go. He pointed a pellet rifle at the victim and sometime during the assault he shot the victim in the foot with a staple gun. After being assaulted over a period of 7 hours, the victim was able to escape and reported the crime to the police. On the Rape conviction, Kirkham forced sexual contact with the victim and had tied her to the bed during the assault. Kirkham was arrested and was being transported to jail, when he kicked out the rear window of the patrol vehicle and attempted to escape on I-5. Deputies were able to wrestle Kirkham to the ground, but during the struggle, Kirkham bit one of the deputies causing a serious flesh wound. Kirkham declined to participate in Sex Offender Treatment while in Prison. GPS tracking device on Offender. Have no direct or indirect contact with the victim of his crime. Sex Offender Treatment. Shall not access the internet without prior approval by his Community Corrections Officer and treatment therapist. Shall not attend X-rated movies, peep shows or adult bookstores. Shall not consume any controlled substances without a lawful RX. Shall not own, use or possess firearms or ammunitions. Shall not possess or peruse pornographic materials. Shall not purchase, possess or use alcohol and submit to testing and searches to monitor compliance. Shall not travel South of the City limits of Marysville. |
