SUBMITTED BY: RUBY, SAMUEL 0562 (AR10116734) DID UNLAWFULLY AND FELONIOUSLY SELL, MANUFACTURE OR DELIVER OR POSSESS WITH INTENT TO SELL, MANUFACTURE OR DELIVER OR CAUSE TO BE SOLD, MANUFACTURED OR DELIVERED TO ANOTHER PERSON, A CONTROLLED SUBSTANCE, TO WIT: MARIJUANA IN VIOLATION OF FLORIDA STATUTE 893.13(1)(A)(2). ON 090810 AT 1800 HOURS, WHILE CONDUCTING ROUTINE PATROL OF WEST TURKEY OAK DRIVE, DISPATCH ADVISED THAT THERE WAS A BLACK MALE AT THE CRYSTAL RIVER MALL WITH HIS PANTS DOWN. THEY ADVISED THAT THE SUBJECT HAD LEFT THE MALL IN A RED PONTIAC GRAND AM, EASTBOUND ON TURKEY OAK DRIVE. THEY ADVISED THE SUBJECT WAS A BLACK MALE WITH A YELLOW SHIRT. IN THE AREA OF NORTH BAY AVENUE, I OBSERVED THE VEHICLE TRAVELING EASTBOUND, DRIVEN BY A WHITE FEMALE, WITH A BLACK MALE WEARING A YELLOW SHIRT IN THE PASSENGER SEAT. AT THAT TIME I ADVISED DISPATCH THAT I WAS BEHIND THE VEHICLE. THE VEHICLE MADE A RIGHT HAND TURN ONTO NORTH BAY AVENUE, TRAVELING SOUTHBOUND. I ACTIVATED MY OVERHEAD LIGHTS AND CONDUCTED A TRAFFIC STOP ON THE VEHICLE IN FRONT OF 3578 NORTH BAY AVENUE. I MADE CONTACT WITH THE OCCUPANTS OF THE VEHICLE, BEING ONE WHITE FEMALE DRIVER AND THREE BLACK MALE PASSENGERS. THE BLACK MALE IN THE FRONT SEAT THAT WAS WEARING A YELLOW SHIRT AND KHAKI SHORTS HAD LONG DREAD LOCKS AND IDENTIFIED HIMSELF AS RICHARD E MORRIS. THE DRIVER PROVIDED A FLORIDA DRIVER'S LICENSE AND ONE OF THE OCCUPANTS OF THE BACKSEAT ALSO PROVIDED A FLORIDA DRIVER'S LICENSE AND THE OTHER PROVIDED A NAME AND DATE OF BIRTH. WHILE ASKING THE SUBJECTS WHAT HAD HAPPENED AT THE MALL, THE DEFENDANT ADVISED THAT HIS PANTS WERE DOWN BELOW HIS WASTE, BUT HE DID NOT EXPOSE HIMSELF. HE STATED THAT HE HAD ARGUED WITH MALL SECURITY AND THEN LEFT THE AREA. WHILE RUNNING ALL OCCUPANTS FOR WANTS AND WARRANTS THROUGH NCIC/FCIC, DEPUTY POLLARD 0677 ARRIVED ON SCENE. WHILE SPEAKING WITH THE DRIVER, THE DRIVER GOT OUT OF THE VEHICLE AND STOOD AT THE FRONT OF MY PATROL VEHICLE. I OVERHEAD DEPUTY POLLARD ASK IF THERE WERE ANY DRUGS IN THE VEHICLE, IN WHICH SHE STATED THAT SHE DID NOT HAVE ANY. DEPUTY POLLARD ASKED TO CONDUCT A SEARCH OF THE VEHICLE AND SHE STATED YES. DEPUTY POLLARD BEGAN WITH THE FRONT PASSENGER. UPON ASKING THE DEFENDANT TO STEP OUT OF THE VEHICLE, I OBSERVED DEPUTY POLLARD REMOVE A CLEAR PLASTIC BAG, WHICH CONTAINED 30 INDIVIDUAL BLUE PLASTIC BAGS OF MARIJUANA, FROM THE LEFT FRONT POCKET OF THE DEFENDANT'S SHORTS. AT THAT TIME I EXITED MY VEHICLE AND DEPUTY POLLARD REMOVED $337.00 IN CASH FROM THE DEFENDANT'S LEFT FRONT POCKET, WHICH HAD ALSO CONTAINED THE DRUGS. THE DRIVER ADVISED THAT THE CASH BELONGED TO HER, BUT DUE TO THE INDIVIDUAL PACKAGING, WHICH ALLOWS FOR A QUICK SALE, IT APPEARED THAT THE DEFENDANT HAD INTENT TO SELL THE MARIJUANA. THE DRUGS AND CASH WERE PLACED IN A SMALL MANILA ENVELOPE BY THIS DEPUTY. THE DEFENDANT WAS HANDCUFFED (DOUBLE LOCKED) BEHIND THE BACK AND PLACED IN THE REAR OF MY PATROL VEHICLE AND WAS ADVISED THAT HE WAS BEING PLACED UNDER ARREST FOR POSSESSION OF MARIJUANA WITH THE INTENT TO SELL. EACH SMALL BLUE PLASTIC BAGGIE WEIGHED APPROXIMATELY ONE GRAM. THE BAGGIES APPEARED TO BE SEALED BY BURNING THE TOP OPENING. UPON ARRIVAL AT THE DETENTION FACILITY THE CLEAR PLASTIC BAG CONTAINING THE INDIVIDUAL PACKAGES WERE WEIGHED AND IT WAS DETERMINED TO BE 35.5 GRAMS. SEVERAL OF THE BAGS WERE WEIGHED INDIVIDUALLY AND SHOWED APPROXIMATELY ONE GRAM PER PACKAGE. THE MONEY AND MARIJUANA WILL BE PACKAGED AND TURNED INTO EVIDENCE, ALONG WITH THE PROPERTY RECEIPT. THE DEFENDANT'S BOND WAS SET AT $5,000.00 PER THE BOND SCHEDULE.
